              Five business days after a mutual closure of escrow, the title company has not refunded my $4,000 earnest money. For the last three days running, the title officer Joseph Fitzbibbons has told me his office is busy and he will wire me the funds later that day. I should have received the funds on Monday, and it is already Friday night. This title company is irresponsibility keeping my money that should have been promptly refunded.

              Incompentent, irresponsible and careless, possibly fraudulent. No checks and balances. Fidelity National Title (FNT), released the Earnest Money Deposit (EMD) that was held in escrow under their fudiciary managment and control. Isn't that what Escrow companies do, manage and safeguard the EMD held in a trust account. After we requested they retain the EMD, because the buyer of our property walked from the deal without a valid reason, Fidelity National Title's escrow officers released the EMD to the buyers contrary to our documented request NOT to release the funds. Say no more. Currently pursuing FNT in small claims court in Henderson, NV.
