      This shop LVD ******************************** Repair is owned by same owners of my husbands job and is located at the same address. We took it here because our car was having issues and never expected the owners to hold our vehicle hostage by refusing to allow us to pick it up. This shop never provided us with a written estimate as required by ****** statute ******** and now are claiming that the reason is because we did not pay for the work they claim to have done. We went to the shop to try and pick up our vehicle on 12/9/22 and ******* the shop manager said he spoke to **** one of the owners and was told that we could not pick up our vehicle. My husband tried contacting the owner but received no reply. On 12/12/22 I called and spoke to one of the owners *****(****) and asked him why he was refusing to release our vehicle as this is my family vehicle and he said he was not holding our vehicle and hung up on me. The next morning 12/13/22 we sent a tow truck to pick up our vehicle, but they refused to allow the tow truck to pick up our vehicle. My husband then called the owner *****(****) and asked him again why were they holding our vehicle and he claimed they did some work on it and we needed to pay for it. My husband explained we never approved any work or even received any estimate, he could not explain why were not given an estimate or why they would do any work without our approval, he eventually hung up on my husband. Then on 12/15 they send us an invoice for $548.18. On the invoice it has 12/14 as the date work was completed and invoice created. So the work they are claiming they did was done on 12/14 after we had attempted to pick up our vehicle twice and had spoke to them several times letting them know that we never received an estimate and never approved any work. Also after doing some research into this company I became aware that they do not have a business license and are not registered with the *** as required by ****** statute NRS *******. this shop is in violation of a few laws that I have become aware of so far. As of today 12/16 they still refuse to allow us to pick up our vehicle. I am not sure if this is a scam they do other consumers but I decided to file a complaint because this has caused my family and I much distress emotionally and financially.

      On November 25th, 2022 ********************* dropped the car to our shop and beceause of some technical issues he asked us to inspect it. The technician diagnosed the car about 1 hour, and he found that the thermostat needs to be replaced. We informed ***** that and he agreed. The coolant was drained and the thermostat was replaced. After that cusomer requested to replace the water pump, the tech started to disassemble the water pump and found that is not the water pump issue, but a **fitting, then on December, 2nd 2022  the customer decided to bring his own part (that **fitting). He never brought the part and he didn't agree us to replace it, which means he refused the **fitting to be replaced, and on December, 14th 2022 we asked him to come over and pay the invoice and pick up the car, because we are going to charge him $100 per day. The car is parked on our property since November 25th 2022, it's about 2 months, we are sending to him every week reminded statements to pay and pick up the car. 
      Our operation is in perfect condition and we registred with the *************** DMV, please see attached the license.

      I am rejecting this response because:     The diagnoses was done on Nov.22 and took about ***** minutes and my husband was present and was told at that time that it was the heater hose that needed to be replaced. We did not request to have water pump replaced why would we do that the reason we took it there is to have a mechanic diagnose the is*** so it makes no sense that they are claiming we asked them to replace water pump as we are not mechanics. They are also admitting that the work they claimed to have done was not needed they misdiagnosed it if that were the case which would mean they were negligent and misdiagnosed our vehicle then did work to it without our approval. They were required to send us an estimate after our vehicle was diagnosed which they did not do. Please see below is ****** statute requiring this. We NEVER received an estimate or approved any work to be done so they are illegally holding our vehicle. It is also against the law to charge storage fees without it being stated on the estimate this is included in statute below. Also please refer to ****** statute  NRS ******** which states they are not entited to detain a vehicle if they have not complied with  NRS ******** which I have also included below. As for them providing proof of registration with the *** this was done after we stated that they not registered so they may be registered now but they were NOT registered at the time they diagnosed and claim to have done work. Pursuant to ****** statute NRS ******** which requires a garage to be registered. I could go on with more laws they have broken but I think this is a great start.

       NRS ******** Estimate of costs required for certain repairs.
            1. Except as otherwise provided in NRS ********, a person requesting or authorizing the repair of a motor vehicle that is more than $50 must be furnished a written estimate or statement signed by the person making the estimate or statement on behalf of the body shop or garage operator indicating the total charge for the performance of the work necessary to accomplish the repair, including the charge for labor and all parts and accessories necessary to perform the work.
            2. If the estimate is for the purpose of diagnosing a malfunction, the estimate must include the cost of:
            (a) Diagnosis and disassembly; and
            (b) Reassembly, if the person does not authorize the repair.
            3. In an estimate furnished pursuant to subsection 1, a body shop shall include, if any, the rate of and circumstances under which the person requesting or authorizing the repair would incur a charge for storage that exceeds $50.
            4. The provisions of this section do not require a body shop or garage operator to reassemble a motor vehicle if the body shop or garage operator determines that the reassembly of the motor vehicle would render the vehicle unsafe to operate.

       NRS ******** Garage operator to comply with NRS ******** to 487.6893, inclusive; enforcement of liens and contracts. In every instance where charges are made for the repair of a motor vehicle by a garage operator, the garage operator making the repairs shall comply with the provisions of NRS ******** to 487.6893, inclusive. A garage operator is not entitled to detain a motor vehicle by virtue of any common law or statutory lien, or otherwise enforce such a lien, or to *** on any contract for repairs made by the garage operator unless he or she has complied with the requirements of NRS ******** to 487.6893, inclusive.

      We explain all the situation in the previous letter. The customer brought the car for the ********************** and ask us to fix it no mater what. He needs to pay the invoice and pick up his car.
