BBB promotes truth in advertising by contacting advertisers whose claims conflict with the BBB Code of Advertising. These claims may come to our attention from our internal review of advertising, consumer complaints and competitor challenges. BBB asks advertisers to prove their claims, change ads to make offers more clear to consumers, and remove misleading or deceptive statements.
On September 14th, 2021, the Better Business Bureau challenged the following advertising claims found on their website, such as:
(1) Pricing Ad Review Violations "...the nationwide market to deliver the best pricing available.", "... we are able to beat any price presented by a competitor...", ETC... Many other Pricing statements have been found throughout your website.
12. Lowest prices, underselling claims: Despite an advertiser's best efforts to ascertain competitive prices, the rapidity with which prices fluctuate and the difficulty of determining prices of all sellers at all times preclude an absolute knowledge of the truth of unqualified underselling/lowest price claims.
(2) Leader Ad Review Violations "...we release the industry-leading solution:CURoxide.", "...by medical grade "SMART" dry fog treatment: BioShield75. This solution is the only of its kind and leading the industry", ETC... Many other Superiority Claims have been found throughout your website.
27. Superiority Claims-Comparatives-Disparagement: Advertisers must not deceptively or falsely disparage a competitor or competing products or services in their advertising. Truthful comparisons using factual information may help consumers make informed buying decisions, provided:
- All comparisons that claim or imply, unqualifiedly, superiority to competitive products or services are not based on a selected or limited list of characteristics in which the advertiser excels while ignoring those in which the competitor excels;
- The advertisement clearly and conspicuously discloses any material or significant limitations of the comparison; and
- The advertiser can substantiate all claims made.
(3) Basic Principles of the Code of Advertising
1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast.
2 Advertisements which are untrue, misleading, deceptive, fraudulent, falsely disparaging of
competitors, or insincere offers to sell, shall not be used.
3 An advertisement as a whole may be misleading by implication, although every sentence separately considered may be literally true.
4 Misrepresentation may result not only from direct statements, but by omitting or obscuring a material fact.
