I hired Tully Rinckey PLLC, paying $6,000 retainer + $720 in consultation fees, but faced delays, excessive billing, and no clear legal strategy. Issues Encountered: Lack of Action & Delays: My case stalled despite full payment, and I had to restate information multiple times during billed calls. Unjustified Billing: I was charged $30 for a 5-minute confirmation call and $720 for document review despite submitting documents earlier. Abrupt Case Termination: When I raised concerns, they dropped me without warning, harming my legal position. Bar Complaint Filed: Due to mishandling, I filed a complaint with the NY Attorney Grievance Committee, after which they rushed partial refunds. Requested Resolution: A FULL refund of my $6,000 retainer, as promised. A referral to a competent firm OR accountability for any losses I incur from handling my case alone due to their negligence. A review of their billing practices to prevent future harm to clients. Their delays and billing practices harmed my case, and I urge BBB to investigate.Business Response

Attachment Summary & Supporting Analysis Re: Complaint Against Tully Rinckey PLLC Submitted to: Better Business Bureau Client: ******** ***** This document outlines how each attachment substantiates my complaint, rebuts the claims made in Tully Rinckey PLLC’s BBB response, and reflects a documented pattern of delay, ethical concerns, and lack of due diligence by the firm. 1. “Follow-Up on Retainer Agreement and Request for Clarifications.pdf” Purpose: Demonstrates my proactive efforts to move forward. Rebuttal to Firm’s Claim: The firm claims there were “no delays” and that they represented me for only “two weeks.” This document clearly shows I was seeking clarity and attempting to confirm the terms of engagement weeks prior to finalizing the retainer. It illustrates that I was not only cooperative but repeatedly initiating necessary conversations to ensure timely action. 2. “Tully Rinckey Retainer Agreement.pdf” Purpose: Defines the scope of work agreed upon. Rebuttal to Firm’s Claim: The retainer does not limit the agreement to a single track of legal action (e.g., OCR vs. DHR), and does not justify charging me for a second consultation just for clarifying scope. The firm’s representation of events — that I “changed matters” and caused a breakdown — is not supported in the language of this agreement. 3. “Clarification on Scope of Services and Timeline ($6000 fee).pdf” Purpose: Shows my effort to ensure alignment on deliverables. Rebuttal to Firm’s Claim: I sought clarity on what the $6,000 covered — including demand letter drafting — and this was not clearly responded to. The firm now claims I “retracked” the retainer, when this document shows I was confirming, not altering, the original agreement. It reinforces my point that I was met with ambiguity and charged for simply seeking clarification. 4. “Tully1Descr.pdf” Purpose: Provides background context and my original scope of concerns. Rebuttal to Firm’s Claim: This document shows I gave comprehensive background and acted in good faith. The firm’s response implies disorganization or lack of clarity on my end, which this document disproves. I was prepared and transparent, but they failed to act accordingly. 5. “Reminder to Sign Document – AMS Proposed Retainer Agreement.pdf” Purpose: Establishes a timeline of delays on their part. Rebuttal to Firm’s Claim: The document was not sent until January 26, 2025 — despite my engagement beginning in November 2024. The firm's statement that they "represented me for two weeks" is misleading. This delay occurred before any work had begun. I responded promptly but noted errors in the agreement. There was no refusal, only a request for clarification and accuracy. 6. “Today is the Day – Legal Consultation Confirmation.pdf” Purpose: Verifies consultation dates. Rebuttal to Firm’s Claim: Confirms that my engagement began on November 25, 2024 — contradicting the firm’s implication that the matter began late or was brief. Supports my assertion that there were weeks of communication before I was even able to sign a corrected retainer. Summary of Rebuttal Points: Pattern of Delays: The documents prove delays were on the firm’s end, not mine. I made consistent efforts to advance the matter. Unjustified Consultation Fees: I was charged twice despite the second meeting being an extension of the first — not a new issue. Breach of Trust: The retainer was not honored in full; the demand letter was never sent despite being within scope. Misrepresentation: The firm's public response omits critical information, misstates the timeline, and fails to acknowledge my documented outreach. Refund Issued Post-Complaint: The refund was only issued after I filed complaints with multiple agencies. This does not suggest a good-faith resolution, but rather a reactionary step to avoid further accountability.Initial Complaint

I had an extremely disappointing experience with Tully Rinckey. They demonstrated a lack of competence with an EEOC matter. Failed to listen to my concerns and provided POOR legal guidance. My mediation took place on 01/17/2025. Leading up to this mediation on multiple occasions via phone and email I advised my attorney the managers who were assigned to the mediation had absolutely no negotiating authority. Despite repeated attempts to communicate this, a 10 minute mediation was held and absolutely nothing was settled - except for my invoice to Tully Rinckey. The attorney assigned to my case clearly had no experience with a federal government employee and EEOC matters. What's even more frustrating is that they had no issue in taking my money while delivering subpar service. I certainly did not feel I received the level of expertise or dedication that should be expected from a lawyer who advertises their expertise in federal EEOC matters.Business Response

On 10/28/2024 I was Billed $837.00 for an email argument that was completely started by Attorney Carroll C*******/Tully-Rinckey PPLC. I was accused of sexist comments and not possessing a document. In both cases I proved to Miss C****** that her accusations were incorrect. She then charged me the argument that she had started. This is completely unethical!Customer Answer

When I called Tully Rinckey, PLLC on 13 JAN 2025 to inquire about legal assistance, I was told not to contact my ******* Union, ****, without first consulting with one of their lawyers because my union would not be able to help me with this request (Reasonable Accommodation), do I agreed to hire their firm’s services and pay the initial fee of $150 and a $3,500 retainer fee (I found out later by one their other attorneys as well as my **** union that this was a lie). I then spoke to Heather T*****, the lawyer that was originally assigned to me, who told me I wouldn’t have to worry because Tully Rinckey, PLLC would be my “mouthpiece in all representation matters.” Fast forward to my next appointment, and now, with a different lawyer, Elizabeth B*****, who informed me that she “would not be reaching out to anyone in my agency and that Tully Rinckey, PLLC would be in the background cheering me on.” I truly believe I was misled and deceived into hiring the services of Tilley Rinckey, PLLC, and I demand a full refund of my $150 initial fee and $3,500 retainer fee for a total REFUND amount of $3,650. I am a ******* employee and a disabled Army Veteran. I am filing a complaint with the assistance of BBB now, but will escalate and get my ******* **** Union involved soon is this matter is not resolved immediately!! I received a follow up email from Tully Rinckey’s Director of Client Relations, Shannon *. E***** on 17 JAN 2025, but I refuse to answer her email and give this crooked firm more reason to steal from me. On 22 JAN 2025, I received a bill from Tully Rinckey, PLLC in the amount of $835. Please help me to resolve this issue. Thank you very much in advance for your help! I very much appreciate it! V/R ******** ****Business Response

I was needing legal assistance and attempting to locate the appropriate law firm in the area of government issues. I contacted Tully Rinckey via internet and phone and paid for a consultation and set the date for same (I have the print outs regarding same) they demand that you pay an exorbitant fee of $169.00 immediately via card... to even be allowed to talk to anyone and book the appointment - I did and was given an appt time and have the print out to prove it. They totally stood me up! After... I called their office & the gal took all of my information and said she did not know what happened to the scheduled appointment (I had the printout) but that she would reschedule since I had already pre-paid - she assigned me to an attorney named Heather. And set the appointment for the next day. An hour before the telephonic appt time I receive a phone call stating Heather does not want to handle my case which still, after days of waiting, had not even been discussed with Heather or any other attorney in their firm She Stated that Heather decided she did not want to keep the appointment with me with no reason and hung up!!! OMG While sitting and floating on my already paid fee to them that they had for days now! One lie after another... abusive treatment... theft of my money. For starters. They are out and out conniving Crooks! ABUSIVE - I could lose my home and pension and it is of dire importance - and they just slowed the process - I called and was told Heather did not want to do it... and was told they would refund my monies to my card BUT it would take them a week to return it... THAT IS OUT AND OUT THEFT AND FLOATING ON MY MONEY ! SAME AS THEFT.Business Response

I hired Tully Rinckey Law January 2024 paying a retainer of $5000 on the premise that they would provide me representation from an experienced attorney. I was told Ryan G***** would represent me, instead they provided me with an associate attorney (bait and switch). I received a first bill for $1372.50 deducted from the $5000 retainer. Then I received an email confirming submission of my OSC complaint. Then I received an email from Ryan G*****'s secretary demanding an online payment of $3512.30 plus $2000 on top of that for the OSC complaint. The OSC complaint contract was for $5000 retainer. The $5000 retainer is enough to cover both statements. I also requested a itemized bill which I never received, Then Ryan G***** sent me an email stating that my account is in arrears. Then after reviewing the complaint they filed with the OSC I found it had multiple grammatical errors, (I was charged for grammar and spelling) the spacing and verbiage was something a 7th grader would create. They even referred to my by someone else's name?? Then I started receiving emails from a Peter C***** from billing claiming I owe them $5000 dollars. We completed a chargeback on the credit card they had on file to stop them from taking anymore money and I told Peter C***** on the phone that we will be sending checks instead, we sent a check for the final amount of $1512.50 clearly stating final payment. Peter C***** emailed me saying they received the check and then he claimed I owe Tully Rinckey $5000 dollars???? Why isn't $1512.50 deducted off that? I received 2 different final balances due? I have tried multiple times to negotiate/ contact Ryan G*****, Peter C*****, billing dept. to no avail. They keep sending me a bill for $5,000 plus interest and late fees! I have the email from Peter C***** stating I owed $1,512.50, I sent a check for $1,512.50 that they cashed. Now they are claiming I owe with interest and late fees $5,709.55Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. The business is only allowing me times that are during my workday, Yes I am employed and can't make or take phone calls during the day most of the week. Yes they have reached out to me and I've only turned down the dates offered in one email. I cannot accept phone calls while driving my work vehicle. I specifically told Ms. Y**** that I'm in Mountain Standard Time. They just ignore that. Anyways, They are trying to muddy this by claiming to reach out to me but only offering times dates that don't work. Not my fault I have to work and can't take phone calls during the offered times. So we had agreed on this coming Friday Feb. 7th at 8AM Mountain Standard Time. Yet they feel the need to send this message to try to make it seem like they are trying but I'm not agreeable. That is not the case. I will speak with Mr. Derek H**** this coming Friday and we will see if this gets resolved. I mean they did accept my final payment in the form of a check with 'final payment' written clearly on the front. Regards, **** *******Customer Answer

Hello, I'm sending this email because I'm unsure of how to do a follow up message on the BBB website after I took a phone call to try to resolve this issue with the business. Complaint ********. I received the scheduled call from Mr. Derek H**** Friday morning Feb. 7th at 8 am MST. Mr. H**** was belligerent, unprofessional, unethical, abusive and threatened to send this to collections if I didn't pay. This is an absolute violation of the law. Mr. H**** and the firm have inflated my final bill, (I have the original bill) by $5,000 to justify why I'm still being billed after sending them a check for the final payment of $1,512.30. Mr. H**** claims that I owe $6,512.30, an absolute fabricated amount. They will probably provide some made up itemized bill to match this amount. The same thing they did when Mr. Ryan G***** demanded another $2,000 dollars without justification, when I requested an itemized statement I received a vague and non specific statement with a number of fabricated charges. I should also mention that Mr. Ryan G***** sent me an email stating that my account was in arrears when in fact there was still more than $3,000 dollars available from the $5,000 retainer. Mr. Ryan G***** also contacted the OSC concerning my complaint AFTER I had dismissed Tully Rincke representation which more than likely tainted my OSC Complaint against me. So back to the phone call on Friday, Mr. Derek H**** would not listen to me and just kept repeating the same thing over and over. I said we are obviously not going to resolve this complaint this way. Mr. H**** hung up on me stating "Have fun with your credit" a threat no matter how you spin it. Mr. Derek H****'s firm of Tully Rincke needs to send me confirmation that any/all negative reports to my credit were removed and that my balance due is $0.00 as they have accepted and cashed the check clearly stating "Final Payment" for $1,512.30. Sincerely, Mr. **** *******Business Response

I paid $4000 for a divorce. I was assigned to a lawyer to start the process. I was told the non contested divorce takes alteast 6 weeks to complete. About a month after the lawyer left the practice. I was assigned to another lawyer who left the practice after a month. I was finally n my 3rd lawyer. What the did, the wrote up a separate agreement. After 6 months I my soon to be ex finally received a document. He quickly went and see a lawyer and file for contested divorce through the Supreme Court because I apparently I didn't filed for a divorce. Finally all my money($4000) was used up plus $583. Nothing was really done for me except a separation agreement letter was served to my soon to be ex. I was told I have to sign another retainer for $5000 for the lawyer to represent me in court since my ex is a 100 steps ahead of me. The service I hire them to do for me was not done. I need a refund because they did not provide the service wanted. I wanted a divorce and that was not done. I have never been divorced before I don't know what terms the use. I kept using the word divorce. They kept saying separation agreement.Business Response

In March, I needed two LLCs to be filed for my businesses. I was told: "It generally takes 2-3 weeks for the firm to close out a case." Expecting that it would be handled within a month, I scheduled all vital next step meetings for my business for July - ie. setting up bank accounts, hiring a CPA, handling taxes, hiring a separate lawyer, pitching to investors, starting production, etc. April 25th was the last email response I received from lawyer, Ryan McCall, and it was assumed that he had completed my services, but I did not get any documents confirming this. I responded through email and his phone multiple times without a response. With no response from my lawyer, I emailed and called the firm to ask about my documents. They told me on that phone call that he left the firm. I expressed my concern that I was not told of this sooner and that I've been waiting for my documents (the Original Agreement for my LLCs were needed at all July appointments). I was told I would be put on priority to send my documents, then did not receive help for another full week. After that week I called daily, being put on hold for up to an hour every time I called. My calls were dropped, sent to voicemail, or told someone would call me back. It is now August 5th and I have not received any help in getting my documents. No one is calling me back or answering my emails. I have needed to cancel all the appointments because I couldn't get my documents, I've lost an investor, and my production of products have been put on pause. I'm losing money, not able to make money, not able to move forward with my business at all because this firm simply WILL NOT update me on what is happening. In addition, I was suppose to receive ~$400 credited back to me - they wrote in my address incorrectly and I did not receive it on time. I have proof that when I provided my address, it was done correctly, and this is not due to me giving them the wrong one.Business Response

I contacted Tully Rinckney law firm for a consultation and was charged $150.00 for the consultation for an employment matter, and the consultation took place on May 13th. I was requested to send copies of the employment paperwork before my consultation in PDF form, which I did. During the consultation, the legal person who was conducting the consultation kept starting the wrong date of my paperwork, and admitted to not reading the paperwork before the consultation. Therefore, without anyone at Tully reading the paperwork, I don't know if I actually have a case or not. I contacted Tully offices after the consultation, and at first I was told by the customer service person who answered the phone that no one read my paperwork because I had not sent it (I did via email), that I had not sent it in the correct format (it was sent PDF as requested), and finally the customer service person stated that they don't typically read paperwork before or during a consultation. When I asked how does the consulting attorney or legal person know if someone actually has a case without examining the paperwork? The customer service person said that if I was not satisfied with the consultation that the firm would refund my money, which is what I stated that I wanted. The call was ended, and I have not received a refund or any other calls or correspondence. I am out the consultation fee and have nothing to show for it. I am requesting the consultation fee be refunded.Customer Answer

I filed a complaint against Tully Rinckney PLCC on 6/2/2024, requesting a refund of a legal consultation fee $150.00 due to a consultation that was incomplete and poorly handled. Today, instead of receiving a refund, I have received the following email telling me that I will not receive a refund unless I delete my review (I think they mean complaint): Hello Ms. *****, My name is Angela Y****, I am apart of our Client Assurance Committee. I received your review you submitted about your consultation you received. My apologies that this occurred and this was the experience you endured with our firm, I understand your concerns and frustration, I did speak to the attorney and the rest of the Committee and we would be happy to refund your consultation fee if you would be able to remove the review. I will escalate your concerns to the rest of the committee and make them aware of what you experienced during your consultation. Once the review is removed I will make sure you get refunded the $150 consultation fee you provided. If you have any questions or concerns feel free to contact me at your earliest convenience, my direct line is ###-###-#### or you may send me an email. Again, I apologize that this happened. Thank You have a nice day, Angela So instead of doing the right thing, the business is withholding the refund until I remove my review (complaint).
