I purchased a 2009 ****** ****** on February 3, 2024. A week later I heard a clunk in the front end so I took the vehicle to ****** ****** in Oneonta NY as it’s local to me. The technician informed me there was some patch work on the frame done recently, rotten spots on the frame of the vehicle, a leaking wheel cylinder on driver rear side, broken leaf spring held together with exhaust clamps on passenger rear, and torn windshield wiper. All of these conditions add up to a vehicle unfit for the road and the vehicle is unsafe to drive. I had an appointment on February 12 to have the rear bumper replaced by Fred from Broadway Cars, so I took the truck to him and informed him what the ****** dealership had found about the vehicles unsafe conditions, I told Fred I want to return the truck to him and be reimbursed for the vehicle. He informed me that we would have to go to court because he fixed the frame and everything on the truck was safe. I called the inspection station that passed the inspection to meet with the inspector. After I pointed out everything the inspector missed, he called Fred to inform him the vehicle was in fact unsafe for the road. Fred contacted me to drop off the vehicle and he will send the check in the mail but at the expense of me “sitting in the corner of his office quietly all day while he conducts business.” I offered to schedule an appointment with a local shop to inspect the vehicle over for vandalism and to show I haven’t drove it since it was deemed unsafe, but Fred isn’t willing to work with me any further on this issue. He claims all the welds are safe but it was never disclosed that he worked on the frame during the week I made an offer 1/29/24 and the time I picked up the vehicle 2/3/24. Now I have a vehicle that I cannot drive because it is unsafe that I have to make payments on.

Hi Kevin,  When **** picked up her car we agreed she would bring it back for some minor odds and ends she wanted addressed.  Before she brought it back she blew out a tire and needed it towed back to her house which I reimbursed her for $350 because she said  there was no spare tire, then I paid to tow it to the local tire shop and paid for 2 new tires.  She brought it back after that to address concerns but I didn't have enough time to address everything so we agreed to bring it back.  She was supposed to drop it off on Thurs. but didn't bring it until Fri. afternoon which being my technician does not work Sat. we didn't have enough time for her to  pick it up Mon.  I ended up fixing all her complaints agreed upon on delivery and addressed additional concerns that arose after she picked up being a check engine light for a fuel level sensor and blower motor and alignment all I paid for.   She also complained about her radio stopped working which is not covered under warranty but we tried to diagnose by removing and replacing the radio which didn't work so we put hers back in according to her in doing this we made small chips around her radio while removing.  After she texted back complaining about this and now MORE items she's not happy about I told her lets wait until I get a loaner car available for her to use so we don't have to rush it and address everything.  I haven't heard back from her since this.  She bought the car in Aug. I've done everything I could to satisfy her and she has a warranty but of course these new items she is complaining about are not covered and as far as the "damage" on her car I have yet to see it but it is a 13 year old car that we sold cosmetically as-is it did have some scratches and scrapes when she bought it.  Like I said she is welcome to a loaner car when it's available and I'll see what I can do to address her concerns. Fred D***** ** Broadway Cars LLC
