On Tuesday February 7, 2023, my daughter and I went to TT NY to look for a dress for her Senior Prom. We found one that we liked. we were told by the "owner" that we should get a bigger size, for a better fit and buy alterations. I was not told when the dress would be in. They had just received that dress today. They then proceeded to ring me up for the smaller size dress, fill out the pink form for phone number and name and to sign the bottom. I was not given the dress to take home, which I did not question. So we went into ***** and my daughter told me she felt pressured to like the dress and she was hoping for a different color. So I went back into the store LESS THEN 20 minutes later, to tell them that we are going to cancel the dress and my daughter is extremely shy and doesn’t want that dress. Keep in mind, I DO NOT HAVE THE DRESS, that I paid for. The lady working with Steven goes back to get Steven and says he’s on break it will be 20 minutes. So I waited. She then receives a phone call and is trying to talk about me to someone on the phone about what’s happening. Gets off the phone and inappropriately laughs trying to cover up her conversation. Finally after a 3rd time of her going into the back room Steven comes out. I am told that I cannot get my money back, that all sales are final. (THAT I DO NOT EVEN HAVE IN MY POSSESSION) . I was charged for alterations, a dress not in my possession, special order and a charge for both of them helping us. I was told by the owner that he placed the order already and it was in production already. I was just in the store 20 MINUTES before. How could it be in production already?? I don’t understand a dress I don’t have, why I can’t cancel the dress. I mentioned to him, even if the dress comes in I’m sure he will not have a problem selling it. He said he has enough dresses. I do not want a store credit. It’s not like I waited a day or a week to cancel the dress. It was 20 MINUTES. How is this acceptable?Initial Complaint

On Tuesday February 22, 2022, my daughter and I went to TT NY to look for a dress for her Jr. Prom. We found one that we liked. My daughter was not sure if she wanted it in a size up, so we were told by the "owner" that they could get us a bigger size, and then she could compare the two. I was told the other size would be in on Monday February 28th. They then proceeded to ring me up for the smaller size dress, however, they kept the dress. I was not given the dress to take home, which I did not question. So we go home, and my daughter shows her boyfriend a picture she took of herself in the dress from the store. He does not like the dress. So I call the store LESS THAN 24 hours later, to tell them that we are not going to take the dress. Keep in mind, I DO NOT HAVE THE DRESS, that I paid for. I am told that I cannot get my money back, that all sales are final. THERE are no signs in the store that say this. I worked with two people in the store, not one person mentioned it to me. The only reason I now know that I cannot return the item, (THAT I DO NOT EVEN HAVE IN MY POSSESSION) is because it is printed on the receipt. I never would have bought the dress if I knew this was their policy. The dress is NOT getting altered. The dress is NOT special order. I was told by the owner that he is fine with getting the other size in, because " I can sell this dress 10X over"....well then why can't I return the dress. I do not want a store credit. I do not want to be handcuffed to shopping at a store that is deceitful. Unethical business practices!! I called the store manager to see if they could work with me and they are not willing to bend. I tried, explaining to them that there should be some exception here, as I do not even have the dress, never had the dress, and left paying for something I do not have!!
