Purchased 2013 ******* ****** from Garrison P**** at Conklin Cycles and Auto Sales on 1/18/22 for $1015. The check engine light came on shortly after purchase, code reader shows a faulty catalytic converter code. Seller has delayed fixing car multiple times by advising to add high test fuel and turning off code to avoid having to fix it. Seller has had the car to 2 different shops he uses, claiming he planned to fix it but refuses to replace catalytic converter. Car broke down on 3/8/22 so I limped it to another shop for repair. Seller refuses to cover cost of catalytic converter,$1000, states he is not responsible for repair even though same code has come up since shortly after purchase. I paid for repairs out of pocket as I could not use the car. Seller also advertised the car as a one owner vehicle, I paid for ****** report after purchase and found I am the third owner. Seller is very hostile when approached about issues with vehicle since purchase.Business response

False information. Car was throwing a p0420 code and had a exhaust leak. He had the exhaust leaked fixed which mr **** came down and threw a receipt on my desk and demanded to be paid on the spot. He says he text me about the leak which he did at 9:32 pm on a Friday. We run business hours 9-5 Monday- Friday Saturday 10-3. Also we do not run our business via text, especially after hours. We did pay the bill for the exhaust to prevent future headache. They we received another text staying the oil was jelly and the motor was bad and car was at ** ********. I called down the next morning and spoke with the gentleman at ** ******** he stayed that the oil was fine, the car ran fine. When mr **** stayed there was a oil problem which was false. “I just got home from dropping the car off at *, it broke down in town today and I got it started and limped it over there. They tested it and it had no back pressure, engine was sputtering. The oil is dark with debris in it again after only 1200 miles. They’re hoping there’s no engine damage due to driving it this long with a bad cat. The estimate was around $1,000. You can call them tmrw if you want to see if they can work out something with the price for you but it has to be fixed immediately.” Text from mr ****. Again he text me after hours on Tuesday at 7:32 pm. I believe ny lemon law is 30 day 1000 mile warranty which does not cover exhaust.Customer response

Seller sold me a car with a bad catalytic converter. Put a cheater on the oxygen sensor to pass New York State inspection refusing to fix it, and I had to pay out of pocket to fix the car.Business response

BBB spoke to Garrison at business and the following was relayed:
We tried to work with and settle with the customer. We paid for the exhaust and an oil change and offered to split the cost of the catalytic convertor to resolve the issue in good faith. The catalytic convertor code was thrown after the warranty, we are still willing to split the cost with the customer.

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I reject the offer of splitting the bill of the catalytic converter. The check engine light came on within 250 miles of purchase the car for the catalytic converter. Garrison ignored it week after week on fixing the car till the warranty ran out. The only alternative is to take him to court for the full amount thank you

I purchased a 2010 Honda Accord from this kid, and the very next day the check engine light came on for catalytic converter, and I also noticed the a/c didn't work. I contacted him the very next day and told him about it, And he said drop it off and we will fix it. I dropped the car off, and he decided to try to cheat nys emmisions, but the check engine lights is still on. Few weeks later he tells me it's because the motor is bad. He has had car for over a month and a half now and I'm making payments on a car that I can't drive. He is taking motor out of another car on his lot to put in my car, and putting the bad motor from my car into the other one, and selling it at auction. He told me this himself. I have a family to take places, grocery shop, and I'm the only one who works. I've been paying for delivery in groceries because I don't have a car! I'm worried about getting the car back and it be a thrown together pile of crap with no warranty because he has had it for so long.Customer response

I do not have a copy of the contract readily available. Yes it is a business that a younger guy runs and owns. I have made 3 payments on the vehicle and he has had my car for 2 months all together. ******* **** ****** Conklin NY,Business response
