      Purchased a side by side from the business with a trade in. Deal that was made with the salesman was supposed to include trade/payoff and roll over into the purchase amount of the side by side. I got the invoice in my email of what the loan was going to be through ********* with the trade in and money rolled over, I verified through the email that everything is correct with numbers and that I won’t have anymore extra money that needs to be paid into any of this deal, salesman verified that everything was correct and I wouldn’t be paying any extra. I went and signed all the paperwork, got the side by side. I’ve had the machine for about a week or 2 and noticed the loan for the wheeler I traded in for the side by side hasn’t cleared off my app stating it’s been paid off, I called the dealer I purchased from to figure out what the deal was. They said they would look into it and call back. They called me back stating that I still owed $4618 to pay off the wheeler that was supposed to be paid off/rolled over by the dealer and they stated they messed up and put numbers in wrong and wanted to annul the contract and take machine back. I told them I wasn’t doing that, this was a fault on their end that I shouldn’t be responsible for. They insisted I have 2 options-annul contract and return side by side or pay off the $4618 that’s left for the wheeler that they were supposed to be taking care of based off the paperwork, the emails and the verbal agreement I had with salesman. When I spoke to them the second time on phone they told me I am responsible for this $4618 even though they had messed up and disrespected me making comments that it’s not their fault “I can’t afford to pay my bills and have issues with paying that extra money”

      To summarize the event,  Mr. ******* purchased a new ****** *** and traded his used ****** ATV.  In doing so Mr. ******* would have to roll over around $4,600 from is ATV loan into the new loan for the new machine.  In doing the paperwork a clerical error was made and Mr. ******* only rolled over about $300 instead of the $4,600 needed to release the lien on the ATV.  I called and notified **** of this situation, he was less than receptive to the fact he didn’t finance enough to pay off the lien on his ATV.  **** basically told me it wasn’t his problem, he knew the contract wasn’t correct when he signed it but CJs made a mistake on the paperwork so that was CJs problem.  I tried to explain multiple times to **** that a clerical error did not absolve him of his debt on the traded ATV and that CJs was not going to pay off the lien on his ATV for him.  **** said he was going to get an attorney, so in turn CJs retained council as well.  CJs has not tried to collect any funds from **** other that the remainder of his ATV payoff as originally agreed upon.  CJs has offered multiple ways for **** to complete his obligations; CJs and **** have come to a solution verbally and are waiting for a release from the lawyers.  We hope to have this situation resolved this week.
