Vendor sending invoices with no approved contract for 55 gallon drum degreaser at a cost of $3600 supposedly from a former employee. **** (Vice President) called and he was verbally aggressive when I asked for a copy of the recorded conversation authorizing the purchase. He then hung up on me and said I would hear from his lawyer.

      Dear *****************,

We appreciate your involvement in this matter, but the facts are as follows:

      1) There is no such contract. Each order was placed individually.

           A) The 1st order was placed on June 6th, 2022 and we received payment on August 1st, 2022 in the amount of $194.29

           B) The 2nd order was placed on June 6th, 2022 in the amount of $1,833.52 which was split up over monthly invoices of $458.38 each. We received the 1st payment on October 3rd, 2022, the 2nd payment on October 31st, 2022, the 3rd payment on December 4th, 2022, and the 4th payment of January 17th, 2023.

      2) On December 6th, 2022, *********************** placed a 3rd order for approximately $4,500 to be billed over 6 monthly invoices, for which we have received 3 out of the 6 payments leaving a balance of $1,864.98.

      3) Now, all of a sudden, for whatever reason, *********************** is no longer with the company, ******** ***** is refusing to follow through with their obligation of the remaining outstanding balance.

      4) We have reached out to **************** who assured us that he contacted ******** ***** and informed them that he indeed did make this purchase on behalf of the company.

In closing, this is an attempt of ******** ***** to try and disregard the outstanding remaining balance using the excuse that the employee in question is no longer employed by them, therefore they do not have to pay which we feel is absurd and yes, if this matter is not resolved, it will be turned over to our legal team for collections. Thank you.

Called with very predatory sales tactics. Made it sound like it was a previous order agreed by the previous manager. Sent me and invoice for a bill but did not ship any product.

      Business response

      02/20/2023

Everything stated by the complainant is completely inconsistent with the facts.

      1. Our sales rep contacted ***************** on January 19th, 2023 and discussed the uses of our Green ***** Degreaser. After this discussion, ************** agreed to purchase 20 liters of Green *****. Before we process any orders, our confirmation department called ***************** and spoke to **************, who was notified that we tape record all confirmations. If needed, this confirmation can be supplied. In addition, we have a proof of delivery from *** showing that the product was delivered on February 8th, 2023.

      2. On our invoices, it states that, if items are not received or damaged in any way, to please contact us which was never done. It was never brought to our attention that there was an issue.

      3. As far as their request for a refund, no payment has been made as the invoice is not due until March 4th, 2023. Everything was pre-paid.

In closing, Spectrum Labs expects payment when the invoice comes due but, if ***************** chooses to return the product, a 25% restocking charge must be received before the return will be accepted. Thank you.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

I have attempted to contact them through their email as specified as the only method they will accept on the invoice,  but have only received messages stating that email address is blocking my emails.

In order for the BBB to appropriately process your response, you MUST answer the question above.

      Sincerely,

      ***********************

I am not sure why the emails are coming up as blocked, but that is not our only form of contact. Our telephone number *************) is also listed on the invoice. I can be reached at this number Monday thru Thursday from 6:00am-1:00pm EST. Thank you.

      Best Regards,
