      To whom it may concern I ***************** am writing regarding a charge back to Gem due to a mistake with my Bank Credit One. May 26th they returned the payment to my account there after I informed them by email the transaction was not fraudulent and I approved it. They said that I would have to wait for their investigation results. On July 26th of 2024 they reversed my account of $290.60 and charged my account and cancelled the investigation. Due to the charge back Gem locked my account so I went to the *************** location and paid **** the manager the amount of $290.60 in cash on July 12, 2024 to get my account unlocked. I'm writing today because I paid twice of $290.60 and am asking for a refund. I have contacted the manager and he said he was assisting me contacting the best person but my bank is in the negative because this and I've been waiting almost two weeks for a response. ***** you for your time and hard work.       I was offered an app to pay off my loan but the app only took my money ****** and nothing towards the loan. I didn't need more time only to pay off my loan. It doesn't give option to paying off loan. It was a big trick to get me to default so they could charge me more. I didn't get the extra 4 months nor the interest paid. No receipt was given. No proof they are stealing. When I came to see about the fraud **** ***** offered me the door without resolution and opt to keep money and jewelry. I want my sentiments and my money applied to my loan and not towards interest.

      On 12/16/23 I purchased a used guitar from gem pawnbrokers located at *********************************************************************. The cost for this used guitar, wooden acoustic electric guitar, was $230. I am not a luthier, but I have been playing the guitar for 30 years. I knew something was not right. You could play some notes only in one section of the guitar. I thought I needed to take to a professional to have it tuned up. He told me It was damaged beyond repair. 12/23/23 I went to where I purchased the guitar and showed them the proof from this professional luthier about the condition of this guitar, ************ the store manager refused to give me a cash refund for a broken defective instrument that should not have been sold.

      Pawned a gold chain w/ pendant to hold until due date. Paid $165.60 to get it back out and realized its a different chain and pendant. Not the same jewelry. They swapped my chain and pendant for a totally different one. Staff were giving me the runaround denying the situation. I have pictures of my jewelry to prove it. Jewelry was held for four months.

GEMS PAWNBROKERS violations of TILA and Regulation Z, alleged in Count One, constitute violations of the ***** 12 U.S.C. 5536(a)(1)(A).Payment accepted without prejudice UCC *****
