I was looking to rent an apartment and was informed that I had to sign a Rental options agreement and pay the fee of $535. The contingency was that i would get a refund of all my money paid if the landlord did not want to rent the apartment to me. I was informed March 8th that the landlord rejected my application. I have reached out to the realtor and the company multiple times and they claim technical difficulties. They issued a receipt but no actual refund.Customer response

I applied to a MySpace property through an agent named *****************************. I paid the Good ************** of $535, and wasnt approved after the fact. Was told the refund would take 1-2 days. Its been 5 days since then and have yet to receive a refund . Ive tried calling there office during business hours multiple times and even left messages but no one is every available, and the contact us section will not allow you to send emails. So i would just like a refund back for the deposit I made.Initial Complaint

I contacted the business as any regular potential applicant would. they sent me a text very late at night right away, which I found a bit suspicious. The text also came from an android phone, which I find odd because most businesses use iPhones as a work phone. I didnt reply, and then less than 48 hours later, they sent me a follow-up text very late in the night, which seemed it was outside of business hours. This caused me to be suspicious so I did the research and read reviews on the company's website. I told them that I was no longer interested in dialogue with them because of the reviews, instead of expressing empathy and understanding, they mocked me and try to make me seem as if I cannot find another rental company. They also sent me inappropriate text messages that displayed other people's personal identifiable information and continue to mark me when I asked them to stop texting me this company seems tremendously non-trustworthy and their business practices should be thoroughly investigated.Initial Complaint

*********************** told my partner that we'd have to put down $1000 to save our place as first in line on a unit at ************* ***. He promised that this was a 100% refundable deposit-- no worries if we changed our mind, the deposit was merely a hold on the unit. Hours later, we decided we weren't interested and asked for the deposit back.He proceeded to gaslight her, telling her that we should have read the fine print and that Myspace NYC would be keeping the deposit.I read more Yelp reviews. I found a pattern of fraud and misrepresentation.****** *. "I wish I had read these reviews before they took $1,000 dollars from us, claiming we had signed the deposit papers BEFORE we actually had."**** ** "They swindled me out of $1,000... They misstated the price of the apartment and the "refund policy" on the deposit, taking the deposit before they showed me the fine print."**************** "I just wish we would have taken the time to get to yelp and read these reviews before shelling out over $2,000."These are just a few of the many Yelp reviews that apply to my specific situation. Their Yelp page is filled with other reviews outlining other instances of misrepresentation and poor business practices. I strongly urge you to read the reviews listed on Yelp in order to form a complete picture of the business and their practices. There is a clear pattern of misleading clients based on false pretenses and fraudulent misrepresentation in their contracts and dealings. Thank you for your time.Customer response

I reached out to ***** on My Space realty for a studio apartment. I was asked to pay an application fee ($20) and a good faith deposit ($1375). I ended up paying $1457.45. A few days later, I was told that I didnt get approved for the apartment. I asked ***** for a full refund and he said that I was charged an extra 3% credit card fee even though he never advised. I asked for my money to be refunded just as fast as his company took it. He refused to provide a full refund, instead he only wants to refund $1375.Business response
