I came across this business from a ****** car ad, while I was searching for ****** models online. The car was priced attractively so I decided to visit the dealership which was a hefty distance away from my home on Long Island. When I arrived, a gentleman said the car was no longer up for sale as the transmission was bad. Disappointed, I asked if he had any other car within that price range. Surprisingly they had no similar cars that were nearly close that price range. Although this was 1 of my first cars, and I drove all this way, so I asked about the financing options that they had. They ran my credit and bank approved me for a vehicle. It was the ****** Versa listed below. I was skeptic about the price as it was not within my budget but I needed a car so I left a $300 deposit on 2/4/22 and asked them to hold it for me so they wouldnt give anyone else the car. Last week, I came back to get the deposit refunded to my credit card but I was told that I could not retrieve it without a receipt. The guy asked for a copy of my statement with the deposit paid out their company. But he sent me off saying I apparently went back to get the deposit, too late. He said I would be called about the matter, next day.Today I came back and I was told that my money cannot be refunded to me.My complaint is about my frustrating experience with this whole situation is 1.) I was not informed once about the 30 day refund period even though I interact with with people working there, various time. 2.) I saw another person get scam with an attractively priced car exactly as I did, so I dont trust people there on my second visit. 3.) I dont think I was given a receipt to begin with. 4.) I was told that I was gonna be contacted but never was. I called about that, the day after my second visit, but still no call. I had to drive far, when I came in today, the guy told me that they did call but that was a lie, too. 5.) They stood firm by their decision.

Per company policy a refund can only be issued with proof of the amount that the customer left us. The customer said that he lost his receipt so I explained that if he brought us a transaction history from his bank we will process the refund

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

Upon my second visit to NYC Automart, 2 weeks ago, in attempt to have the refund made to my card, I was able to furnish a bank statement with the purchase listed to the business on February 4th. Please see that very same statement document attached with the complaint. I gave it to a gentleman working there, he said that he had to send it to corporate so they could see if they could make a refund and that they would get back to me the next day. They did not get back to me, so I visited a third time last week. At that last visit, I was told that my payment could not be refunded because the transaction was made more than 30 days ago. My complaint is about the nature of this policy and/or lack of awareness for that policy. I was not made aware of this during my first visit and phone calls to your business and I don't believe I was given any documentation or notification regarding this policy. All and all, I did not receive a good or service from your company, so I feel like I made a payment for nothing.

I did say that I thought my receipt was lost at the time of my second visit but that was only because I didn't get the chance to do a thorough search for it and I assumed that it was giving to me at the time. But when I went home to do thorough search for it, I was not able to find it but I was able to find various other documents that I received during my first visit. (attached)

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

I did show proof of purchase when I got back to the store. When I was there, I emailed the person I spoke to a copy of the statement with the purchase clearly listed. So I do not understand why this is still how you should to respond to the complaint. I feel like the issue at hand is being avoided. Thats not the reason that I was given for non refund.

On April 18th ************************************************************************************* I then Called the business to confirm the availability of the car and if it was still available and at the listed price. We were told that the car is still on the lot and is available for the stated price of $ 4,295.00.I explained that I was coming from far away and it would be expensive for me to come to them, they assured me that the vehicle was available and was ready for a test drive. My wife and I showed up at the specified time and the car was NOT on the lot and the owner said that car was sold many months ago. I explained to him that we had just called and were told the car was available and ready for a test drive. We were then told that when you call this business you don't get them directly your call is forwarded to a call center and not to the lot ? It cost me and my wife over $ ***** in car service to see a car that was not there !When we complained the owner asked why we came ?This business still has over 5 different cars listed at that price and all are NOT there , I asked about the other cars and was told they are not there. This company is still listing this Santa Fe on SEVERAL websites including CarFax and some others , the car is listed as Available !I seek to recoup the transportation fee's and would like to alert everyone about this fraudulent company. These people had absolutely NO remorse about this bait and switch....

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because,

This company has Hundreds of complaints for various infractions.  Their business license  should be immediately revoked !

This is not a inflated request , but a necessity for the general public. The people who run this company have Absolutely NO regards for the customer and shoppers

that they deal with on a daily bases.  I maintain that I had called ahead and specifically asked if the vehicles displayed were still available and that I needed to know this as

I was coming from far away by livery cab and the cost for this is very High  ,  They assured me that the vehicle advertised was STILL available so I brought my wife with me

and when we arrived , they said , they knew nothing about what I was talking about !  The cost to me because of their lack of concern and professionalism was $ 75.00 for cab

fair.   This might not sound like a big deal , but I assure you it is !   JUST ON THE PRINCIPLE OF THIS AUTOMART SHOULD BE HELD ACCOUNTABLE AT ALL COSTS .......  They

should be immediately directed to pay this cost without any recourse !

date: this matter happened Feb 1-5th. I initially phoned the dealership about a vehicle they listed for sale, a 2014 BWW 4 Series Convertible listed at ******. The vehicle is listed on their site and many other vehicle sales sites like **********, ********* *******, etc. The dealership told me the vehicle was available and I could come to view the vehicle. I few to the dealership and offered to buy the car cash. They would not allow me to buy the car cash, and was telling me I had to finance the car. Strange situation. The dealership refused to sell me a car they had listed for sale. I was not sure why they lied about wanting to sell the car but they refused to sell the car they listed for sale to a customer. I am a **** Citizen with a valid driver's license, etc. The dealership is supposed to sell cars to anyone willing to pay for the car. I want this dealership to sell me the car they have listed for sale on their website and other online car sells sites. This is fraud. The dealership advertises cars for sale at a price they listed; the dealership should be obligated to sell these cars to customers who want these cars. They try to old bait and switch technique to get customers to their lot in an attempt to sell them a higher priced car. Fraud and scam techniques.

I called to see a vehicle that was advertised. I was told they had it and to make an appointment to come in. When I got to the dealership I was told the car was bad and only sold to mechanics. Then i was shown another vehicle I liked. A credit check was done and I was approved. However, the vehicle was sold to me higher than it should. The milage was ******* and I was charged *********. I seen the same vehicle with lesser mileage at a lower price. I was told they do price match but they refused to do the adjustment. I brought the car back on the 6th day and they refused to take it back, but my contract says I have 2 weeks to return. The general manager was very rude and told me he doesn't care how I view the company and I can give 5 bad views. The general manager advised me that if I received a call from the creditor to tell them I put a down payment of ******* so I can be approved; however I only put a down payment *******. When I asked the manager why he charged me so much for the vehicle with a high mileage, he told me to refinance the payment with another creditor to get a lower payment, because he can't and wont help me. He was beyond rude and pointed towards the door for me to get out. The general manager was combative and defensive when I tried to find other options to resolve this matter.

attached you will find supporting docs showing a selling price of $26,999 not $29,999. You will also find documentation showing a signature from ************* in reference to the down payment of $5000.00. i believe she is experiencing buyers remorse and loolking for a way out. There is no provision in the contract for the return of the vehicle, how ever she can try to refinance with her own lending institution

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

This contract should be nulled as the following information below was presented to me during the interaction with the salesman ( manager) of NYC Automart.

      • I did not pay a $5000.00 cash payment as stated in the contract.  ( I paid with my bank card which show I paid the downpayment of ONLY $3500. 00. I also cashapp an employee there because I was told i had to pay a $350.00 application fee which was only paid by cash, but I did not have any cash on me and the employee agreed to accept my payment with his cashapp.)
      • Attached are documents with my bank receipt for both payments.)As a value consumer who only wished  to purchase a vehicle feel like I been scammed by Automart.
      • The value of the vehicle with the milage of ******* is too high for what I paid for. I told the manager that I saw the same year, model and around the same mileage as the vehicle I was sold for lesser and the manager said, "do you believe that price?" Instead of looking into the price changed. I was told they do price matches; however,The manager refused to match the price. The manager was extremely rude to me when I came back on Dec. 4th and I called the police. The officers told me what I had to do next and explained to me about the ***** law which I was not awared of.

I Purchase a 2015 BMW 528 on May 28th 2021, Within the first month I started having many issues mechanically with this vehicle, I have had to come out of pocket to pay for this vehicle to be towed back to the dealership, It seems every other week I am having something break down in my car, that is supposed to have a warranty on it. Unethical business, they lure you in telling you a car is good and no problems. When you arrive you find out the car doesn’t even drive. This business has no transparency, I drove an hour to arrive here. I even triple asked them about the car if it was good and had no problems. Nothing was brought up. This business clearly uses tactics to lure you in so once your here you end up looking at their other cars. They told me I can schedule a test drive…. a test drive for what exactly??? The air? They made me go looking for a car that doesn’t even move when nothing was mentioned about the car having issues. Then they asked if I wanted to look at other vehicles
