      10/4 They have been calling me non stop on blocked numbers so I can’t block it. Calling my employer as well. Leaving threatening voicemails. Have threatened to garnish my wages as well as say I could go to jail and scare me into paying. I do not want to give them a dime of my hard earned money. Very unprofessional. Won’t stop calling, now I stopped answering they are saying they are sending me to their fraud department. For what? I have no idea. Another scare tactic.

      Bayside Capital is harassing me about a debt I don't have. When I informed them I don't have a job Mr. Kenneth D**** said that he sees that I do and proceeded to ask personal questions regarding how my bills are paid. When I informed him I am a stay at home mom he told me Mr. ****** should pay these debts. I am not married and how my bills are paid is none of his business. I hung up on him and then he proceeded to contact family members in other parts of the country to whom I never gave permission or their info out. Mr. D**** also proceeded to tell these family members why he was calling and about said debt which is illegal. Mr. D**** also threatened me with legal action at my home not once but twice and I have the voice mails. Contact to me and my family needs to stop or a cease and desist letter will personally be sent to Mr. D****. Threatening me and assuming certain things about me is extremely unprofessional as is asking personal questions. DO NOT CONTACT ME OR MY FAMILY.

On 10/25/2021, one of our associates spoke with the consumer and she stated that she was not working and that she could not take care of this issue at the present time. We do agree that our associate could have been more empathetic to Ms. ******, and for this, Bayside Capital Services wishes to apologize. The associate has been disciplined according to our policies and procedures.We do see where Ms. ****** has called in and taken care of her business matter in our office since she filed this complaint.       Employees from this company have been contacting me on several occasions. Today I called them back and they noted they were trying to contact my father and my number was listed as his primary. When asked who he was he said Bayside Capital. I asked who that was and he said a company who does background checks for third parties who my dad had supposedly applied. However, he would seem that was a false pretense and they are really looking to collect some type of debt. This practice of lying to obtain information is not a good business model.

      The consumer’s account was placed in our office by our client for collection on 9/30/2021.

       

      On 10/8/2021, one of our associates began making communication attempts using the numbers provided to us on the account. During these attempts, we may contact persons other than the consumer in attempts to gain location information. This is exactly what occurred when we reached out to Mr. *****. All arrangements and or agreements have been rescinded and or cancelled.

       

      Upon receipt of this complaint, the account was placed in a Cease and Desist status and has been returned to our client. It will be up to them to determine what direction to take regarding this account.

       

      Additionally, there have not been, nor will there be any further communications with the consumer by our company.

       

      We would like to apologize to Mr. ***** for any inconvenience that he may have experienced while dealing with any of our representative’s attempts to communicate with him.

      Bayside Capital Services continuously harasses me and threatens legal action that is false, as I have already resolved the debt that is owed. They call me all day every day during work. When they leave voicemails they don’t even state what company they are calling from, I only know from the caller ID. They just state that they will take legal action against me. This has to stop. Every time I block them they just call me from a different number.

      On 9/13/2021, our associates began to make calls to active numbers provided to us on the consumer’s account. We
      contact all numbers that are provided to us for the purpose of gathering location information. Once we have this
      information, we use it to communicate with the consumer. Please be advised that there were only a total of 4 calls
      between 9/13/2021 and 10/13/2021. It is entirely possible that if the consumer is getting continuous calls, it could possibly
      be another agency trying to communicate with her. Finally, during our reviews of all 4 of the communication attempts
      made to the numbers on the account, we do not see where any of our associates ever stated that we were going to take
      legal action against anyone.
      Additionally, there have not been, nor will there be any further communications with the consumer by our company. The
      consumer’s account has been returned to our client.

      The consumer’s account was placed in our office by our client for collection on 8/4/2021. 
       

      On 8/6/2021/2021, our associates began to make calls to active numbers provided to us on the consumer’s account. A
      total of 26 attempts to 4 different numbers were made over a period of 65 days. There was only one instance of live
      communication and that was with a relative of the consumer. This person agreed to pass on a message to the consumer
      and requested that we not call her again. This relative’s number was made inactive, and no further attempts were made to
      communicate with her. 

      We also do not see where any communication that was attempted between BCS and the consumer can be construed as

      threatening. 

      Additionally, there have not been, nor will there be any further communications with the consumer by our company. The
      consumer’s account has been returned to our client.

      We would like to apologize to Ms. ****** for any inconvenience that she may have experienced while dealing with any of
      our representatives attempts to communicate with her.

      This company has started calling my number repeatedly and all times(to the point I quit answering them), they take forever to say who they are or don't leave a message. They only left one message: Good morning this message is for ***** ***** goes. My name is Tiffany J I'm calling from the offices of Bayside Capital. I'm contacting you on behalf of my client in regards to insufficient funds transactions. It is very important that I speak with you right away in regards to this pending matter. You can reach me directly at **************. I'll be in my office until 5:30 PM tonight Eastern Standard Time. When calling back please refer to your filing number #######. Thank you Considering I have not talked to them,how can they say insufficient funds? Plus now they are harassing my family, telling them I gave their numbers as point of contact, which I haven't since I don't give my family's #'s out. They even told them that they have a refusal letter on me and that I need to pay my bills.

      On August 9th I received my first voicemail from bayside capital stating that I needed to call them back within 24-48 hours or they would pursue legal action against me regarding a financial matter. I called them immediately the next morning & was informed they had purchased a debt of mine. In an attempt to resolve this matter I set up a payment plan with bayside capital on August 10th & paid them $126. My next payment was scheduled for September 14th. On August 27th I realized they had illegally taken money out of my account in the amount of $96. I DID NOT AUTHORIZE THIS PAYMENT. I had to call them repeatedly on August 27th just to get someone on the line, they verbally communicated to me this was an error on their part and they would refund my money the same day. The guy I spoke with told me at most it would take 6 hours. I never got refunded. This is illegal and unacceptable, now I have to risk them stealing money out of my account at random or being at risk of legal action, CRAZY.

Upon receiving notification of Ms. ******’s complaint, BCS conducted an internal investigation. After doing a complete investigation into this issue, we found a few things. First of all, we do see where the consumer’s card was run a second time on a date that was not authorized. The associate that was working with the consumer is brand new with our organization and he made a scheduling mistake. After speaking with him, we see where he panicked while talking with the consumer. The call where he told the consumer that the money would be returned in 3 to 6 hours was definitely a mistake as it takes 3 to 5 business days to return transactions.We wish to inform the consumer that the request for the refund of her transactions were processed on September 8th, 2021 and she can expect to see the money back in her account in 3 to 5 business days from that date.Additionally, there have not been, nor will there be any further communications with the consumer. The consumer’s account has been returned to our client.We would like to apologize to Ms. ****** for any inconvenience that she may have experienced while dealing with any of our representatives.BCS takes its legal compliance and customer services very seriously and recognizes this complaint as such.
