      On 2/26/2024, we signed a contract with Tony's Trees and Landscaping tp remove 5 large trees from our property, haul away the wood and grind the stumps. The total value of the contract was $12,940. We paid a 50% deposit on 2/26. The initial removal of of the trees began a few days later, at which point, we paid another 45% of the total job. At this point in time, everything was according to the contract. Per the contract, the wood removal would begin 10-15 days after the tree crew work is complete, and at this point, we would pay another 2.5%. In our case, this work did not happen until early May, nearly 8 weeks later. We paid the 2.5% on the day this step was completed. Also, per the contract, the stumps would be ground as soon as 811 was done marking. 811 was done marking in March, and the wood was removed in early May, but it is now 6/11/2024 and the stumps are still in our yard, not ground. This is not in alignment with the contract. My husband has called and left multiple messages, but Tony has not returned them. All we want is for the work to be complete, as it is holding up other work that needs to be done in our yard.

      I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. 

      As a note, the business did not fulfill their contract until I submitted both a BBB complaint and a 1 star review on the BBB website.  Once I took those steps, they completed the work.

         Tony's Landscaping cut down trees on 07/07/2023. The truck backed onto the property and cracked the concrete driveway and sidewalk. Numerous phone calls were made and appointments and calls were not returned and appointments to view damage were not kept. The down payment of $4613.00 was posted on 07/07/2023. the balance was posted on 07/09/2023. The work was never completed. Tony's crew came on 08/07/2023 to stump. I advised them that nothing was being done until Tony came and viewed the damage and changed the balance due to the cc I wanted it placed on.

      The sales representative going over the scope of the job with Mr. ********* of ** ***** ** ********* ** on June 26, 2023 at 2:44PM he advised the customer the process of tree removal would consist of driving our robotic remote control tree cutter truck down the drive way across the lawn around the right side of the garage into the back yard, that was the only way we could remove these trees safely, due to the rotten spots and stress cracks in the trunks of the trees.  This is why we had to remove half a row of brushes, in order to get truck in yard around the right side of the garage.  On the contract it clearly states, do to where the trees where located and unsafe condition of the trees, that we needed to use the specialized truck and equipment, sales representative made it clear verbally and its in writing,  that we would not be responsible for property damage this is stated in his contract in which Mr. ********* signed.  We have signed authorization for each charge which Mr. ********* agreed to the payment arrangements on his contract. The salesmen spoke to Mr. ********* twice regarding the job. Our staff has returned many of Mr. *********'s phone call, August 1, his call was returned and spoke for 47 minutes.  We also returned a call on  10/10/23 at 9:24am where he stated "damage was done to drive way and sidewalk August 7, 2023, but the work performed on July 7 2023, which clear contradicts customers claim of the damage.  Mr. ********* also requested a refund in mid October when 97.5% of the job was completed three months earlier.  When he disputed his credit card in the amount of  $4152.00, the customers credit company after we provided all the facts figures numbers dates and times, they sided with Tony's Tree and Landscaping.   Another staff member returned his call and also had a 45 minutes conversation.  On July 22, 2023 Mr. ********* called requesting a date to have the stumps ground.  His call was returned advised him when the crew would be there to grind the stumps out.  When we sent a crew out to finish grinding the stumps, Mr. ********* told the crew they were not allowed on the property and he refused to allow us to finish the job.  Mr. ********* in way shape or form did he notify us not to come out and grind the stumps out as agreed upon in our contract.  Then our office received a letter stating " This letter will serve as notice that effective this date we expressly forbid Tony's Landscaping Inc any of their employees, relatives, friends or any other company that does tree removal, tree trimming tree stumping or any type of landscaping, permission to trespass on the property located at ** ***** ******* ********** ** ******  In closing, in Good Faith we are willing to refund the customer $1000.00 paid in full for any and all damages, even though we are not responsible according to his contract verbal and in writing to bring this case to a close.  

      If needed we will provide additional documentation and evidence to support our case.

      I contracted and paid in full, Tony's Tree and Landscaping service on June 20,2022. They came the next day and cut down 5 of the six trees in my back yard. on June 21, 2022. I personally have test Tony on his two cell phone numbers to see when they are going to come back and finish the cutting down of the one tree left, all the stump grinding, and trimming on three trees. I have also called the office seeking some kind of action. I have huge logs left sitting in my front yard on top of the sewer drain. Most of the time I am getting ignored or I hear excuses as to why they are not finishing the work. It's been 5 weeks and my back yard is a mess (with orange spray paint on stumps and tree) and the front yard still has these huge logs laying there. I either would like the job finished or I would like reimbursed so I can find another tree service to complete the job. I am a 70 year old widow living on Social Security as my only income. This is not right.

      appointment made with service waited all day, came and looked at job quoted 1800.00 for weed removal and trim bushes i said to high and started to walk away from a much high quote i reluctingly went for 1800.00 because this very fast taker tony said he would give me discounts he's filling out covered contract asks me to sign leaves quickly when i get in house my copy which hardly readable has all kinds of extra charges on it coming to more than 2400.00 and showing all that i wanted him to do, i also requested a start and finish date he said he would include on contract was not written at all, everything i requested if written at all i would have to re-do to my liking, my copies of contract only show a total of more than 700.00 than quoted. i have never met a bigger cheat in my life, thinking contacting police and DOT also because i will bet all his trucks are in dis-repair then to top it all i look on your site and see all the different complaints about his company also everything i wanted done was not mentioned on the contract. I called ********** and froze the account due to his misrepresentation. also mentioned him to my neighbor and i didn't know she once worked for him and she said he is nothing but a crook with everyone, people like him should not have a business license.

      Hello there BBB, the copies that were given to me by tony's tree service are hardly readable and will not copy because he did not press hard enough i had to read them with the help and only with a magnify glass i have tried to copy these before, now on the back of his contract there is a cancel clause of three days in writing i went to the post office after going to his place or office with a letter of termination certified registered mail on saturday the day after i met with him but then there is saturday closed, sunday closed, holiday closed, he should be getting the cancelation today Tuesday the 31st i can't help this fell on a weekend and a holiday weekend, if i put it in the mail box he would say he never received it and it could not be signed for,  just wanted to let you know please give me a phone number to call you. Thank you  ******* *****

      Dear *******, The initial price quoted on the estimate was price before sales tax and dumping fees that we can not absorb the cost for because we are charged for it. That is the additional cost accrued that is out of our control. There were many overgrown trees, weeds, and shrubs that you wanted removed that were entangled through your fence along the entire property. Due to the degree of difficulty of the specified work it was a very labor intensive job. Tony was very clear on the cost of the job, dumping and trucking fees (because we have to pay for them), and sales tax cost. You asked on the cost and Tony reiterated it and broke it down thoroughly. So, we just wanted to clarify the approximate $700 difference. We never give an exact start date at the time of estimate. The estimator may have an idea of work scheduled in the area, or may be aware of jobs in the area that he can tag your work order on. We never give an exact date because our line of work is all weather permitting, and there are many different variables that come into play when scheduling a work order. Regarding your concerns to our trucks and equipment our fleet manager is a retired department of transportation employee. Our operational vehicles are all NYS DOT certified and inspected.

      Not sure what you want me to say about the three day cancelation.  he canceled within the timeframe so the contract was Null & void. We received his letter in the mail and canceled the contract. No $ was exchanged so There was no need for anything further. At the time of signing no deposit was made so we didn’t have to return any funds.

      I'm filing a complaint regarding 3 contracts with Tony's Tree Service. Two of the contracts were signed on 3/16/21 and one was signed on 3/17/21, the day they came to do the work. One of the contracts signed on the 16th was not completed at all and the other was started but not finished. The contract signed on the day all the work was being done was not even necessary. The total for all the work was $17,647. The details of the complaint are included in an uploaded PDF along with supporting documents and pictures.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  BBB spoke to the customer and the following was relayed: Both my husband and I contacted Tony after the job was done about finishing the job. They left two tree trunks, big pieces left on ground that were supposed to be hauled away. He charged trucking/hauling fee on each contract but only took away the one tree he said was sick. On one contract he charged $899 plus tax and he left all the wood. Tony never returned to see the job to notice it wasn't finished and we never approved a final payment, they had our card on file and just charged it and took the money after I had asked him not to charge anymore until we could discuss. We had to have the card number changed after that. After Tony was not willing to finish per contracts we disputed with the credit card company and had to go through that process and waited on any assistance legal services could provide. We did not wait a year to try and contact Tony and dispute the work and charges, we have been trying for the last year.   Regards,  ****** *********
