Date of the transaction was around the third week of August in 2022. Approximately $22,000 was paid for a 2012 ********* ********* with an extended warranty. I brought the vehicle in for inspection on the 28th of August of 2023 and it failed due to the undercarriage frame rusted and rotten passenger side rear inboard. I've only owned the vehicle for one year and the vehicle has less than 100,000 miles on it. I have put less than 5000 miles in the one year that I've owned it. The dealer has given me a loaner vehicle until they can find me another vehicle. The confusion that I have is what rights do I have and what can I do about it. Mr ****** purchased his 2012 ********* from Jim Barnard ********* on 8/2/2022 at which time the vehicle passed the New York State Vehicle Safety Inspection. About a year later, on 8/28/2023, he brought the vehicle to our service department for it's annual safety inspection at which time it would not pass due to rust holes in the frame. There were signs the truck had been parked somewhere, possible in damp conditions, and not operated for much of the year which likely contributed to the accelerated rust condition of the frame. It had been only driven 4,957 miles and there was an animal nest found in the engine compartment. We gave Mr. ****** a loaner vehicle that day and our body shop manager inspected the truck to see if the frame could be repaired safely, but due the size of the holes he did not believe it could be patched without compromising the integrity and overall safety of the vehicle. As a goodwill gesture we attempted to find him a suitable replacement vehicle and offered several choices, including a comparable truck with much lower miles for only about $100 more per month than his current payment, but he said that he could not afford to raise his payment. We also offered other vehicles that would fit into his payment, but he declined them. To summarize, the truck passed the NYS Vehicle Safety inspection when Mr ****** purchased it in August of 2022. When it failed safety inspection a year later, as a goodwill gesture we attempted to trade him out of it at an exceptional value to get him into something more serviceable but he did not accept those vehicles and terms offered. We are still willing to assist him in trading to a different vehicle and try to find a replacement that he will accept but there is limited availability in that price range and, combined with the current interest rates which have risen significantly since last year, and Mr. ********* unwillingness to pay a higher monthly payment. he will need to compromise on something.
