During a grade and seed at my property on **** ***** ***** ******** ** *****, Mulch Mogul LLC employees loaded and unloaded a rented skidsteer on my driveway, without permission, on Thursday, September 28, 2023. As a result, several deep gouges and scratches, up to 1/2" in depth, were left created, extending beyond the driveway's sealant and into the course. The skidsteer was used to turn and pivot several times on the asphalt surface, leaving tread marks which lasted several weeks. Part of the side of the driveway is caved in where the skidsteer transitioned from the asphalt to the lawn. New water pooling indicated permanent shifting of the grade, which initially pitched outward. The pitch, now inward, is demonstrated using both a bubble level, as well as pooling and drying patterns recorded on a 24/7 security camera. A 2 minute, 31 second video, high-definition video from a ****** **** floodlight and security camera directly facing the driveway and approximately 15 feet away, recorded the entire loading and unloading process and is reproducible in full, including the edge of the driveway caving in. Additional video footage of when the driveway was newly sealed on June 2, 2023 is also available, as well as numerous photos of the driveway prior to the skidsteer incident. The driveway is comprised of 3" of 3TS3 asphalt and was installed exactly one year earlier, invoiced on October 6, 2022 for $8,900. I have contacted the original installation contractor, ******* **** ** **** ******** * ********, who has assessed the damage and is able to act as an expert witness in Buffalo City Court small claims. Repairing the grade will require a new topcoat. An independent company, ****** ******, estimates repair costs totaling $6,437. Additional bids are being investigated. The owner of Mulch Mogul Landscaping was contacted via text, email, and phone to arrange repairs, but failed to respond whatsoever.
