5/27/2022: received estimate and made downpayment of $1900 (50% of total installation $3800) 7/16/2022: without prior communication showed up at the property to install. I was out of town. 7/22/2022: paid balance of $1900. 10/11/2022: called concerned because the gate had broken from the hinges. (NORMAL WEATHER CONDITIONS) Without coming out to review damage was advised that it was wind damage and owner negligence. I requested for owner to still come review. 10/12/2022: without communcation or annoucement owner sent employee to come out to my property to take pictures to "prove his case" entered onto property without permission while family dog was outside. Received text that it was 100% my fault. Was advised he could repurchase the gate at $800 and he could install it for $200 at my expense. I am disputing that this is 100% owner negligence. For the following reasons: there was only one drop rod installed on one side of the gate and subsequent hole drilled into concrete driveway to secure. After reviewing the damage with another fence installer they pointed out that due to the weight of the gates drop rods are normally installed on both gates as a precautionary measure to prevent this type of damage. Drilled holes are placed where the gate sits at rest completely closed and also in the driveway where the gate would rest at open so that the gate can be secured in open position - which was not done. It was also brought to my attention that the hinges were secured with screws instead of a bolt which gives this type of vinyl fencing additional stability. These small additional measures that a licensed experienced professional would have known would have prevented a costly repair less than 3 months after installation.Business response

Response taken by phone: I went out to inspect the gate. She left the gate open and it was damaged by the wind wind. I have pictures that prove that the force of the wind caused the damage. Even if there was another rod (which in this case is not needed) it would not have caused the gate to crack the way it did. A refund is not warranted as this was caused by an act of nature.
