      On or around 12 July 2021 Francis Ashby met with me concerning my roof repair project fixing 2 areas that were punctured by tree branches. In talking about the repair Mr. Ashby stated he would rather not do a patch type repair but rather a section of the roof from the ridge vent to the eve where the gutters are encompassing the 2 punctured areas. This repair was confirmed by me in an email dated 3 AUG. In an email dated 4 AUG Mr. Ashby again confirmed the repair would extend from the ridge vent to the eve/ gutters. This distance is approximately 17 feet. An email dated 15 JUL Mr. Ashby stated the job would cost $800 + materials. Mr. Ashby came to my house on 17 AUG not to work, as stated in an email on 16 AUG, but to pick up the $800 deposit. On 18 AUG he emailed me a contract that I refused to sign because it is a template for a subcontractor where the majority of information is incorrect and/or N/A to me the customer. 23 AUG at 2359 I received an email from Ashby Construction stating they would be at my house the following day, 24 AUG, between 1000-1100 to complete the job. No show and No Communication! I emailed on 25 AUG questioning the status of the job. Later that day I received an email stating the shingles were ordered on 24 AUG and would arrive in 2 weeks. Because of the lack of clarity with this company to date I questioned if I was going to get the job completed per the original discussion with Mr. Ashby. In the evening of 25 AUG I emailed and asked how many shingle bundles were ordered. Reply was 4! 3 bundles is only 98.4 Sq Ft. The repair is supposed to be 17' x 10' which is 270 Sq Ft. which 4 bundles doesn't cover. I asked for a refund and was denied and told the job was for only a 10' x 10' area. I requested a refund again and was told "because materials were bought and labor was completed that covered the $800.00 you paid out. There will be no refund issued as the work was completed by our company." No work was completed on our house by Ashby Const.

      We have spoken to the client and we performed services that he requested . He provided a payment of $800.00 out of $1600.00 which covered the cost of all materials and $200 for labor charge. We had related to continue the work as there were issues that arises on both parties with scheduling and he refused and said he was hiring another control to finish even when we had a contract with him. We did not proceed with collecting anymore money of what was owed and finalized as paid to standard of job completed on . He was fine with that and both parties walked away. We have pictures of the work completed and have full died the services as requested by the client .

      I have reviewed the response made by the business in reference to complaint ID 16088730, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

      After August 17th I never spoke with Mr. Ashby again. 

      I repeat and repeat and repeat again that Ashby Construction NEVER set one foot on my roof to do anything so no services were completed by Ashby Construction on my roof.

      Email dated 05 August 2021 from Ashby Construction clearly states $800 for labor and $400 for materials. Don't know where they are getting the $1600 figure from.

      I never had an issue with scheduling except that Ashby Construction never showed up when they said they would.

      Ashby Construction states they had a contract with me but they cannot provide a hard copy because as I stated in my original complaint, I never signed it because it was a template for a subcontractor, not me the customer. As such there is no signed contract between Ashby Construction and myself. Also as per the email dated 26 August 2021 I clearly stated "we have decided to cancel the project as we are going to go in a different direction with what we want done with the roof." Never mentioned anything about another contractor!

      I never stated I was accepting of anything except a refund of $800. 

      I would love to see these fabricated pictures of my roof repair because once again Ashby Construction never set one foot on my roof. These pictures are probably taken from my neighbors roof when they supposedly "fixed his roof".
