      In July of 2023 my wife and I entered into contract with ******************************* of Super Job Inc. to have a dormer installed onto our house. The contract we signed with ****** was "open contract" as described by him. All material and labor included in the price. We could make changes a we went along. Things we didn't need/want we would get money off/credit for. If we paid cash we would get a significant discount. We were leery but the platinum recommendation from our friend sold us. We were told the downstairs of the house would be minimally impacted. Demo started on 8/22/23 and instantly there were issues. I came after work around 2pm, ****** was not there. To my surprise workers were walking through the finished portion of my house and they had demo'd the 2nd floor without closing off the first floor. One of them had defecated in my bathroom and left it because the water was turned off. No Porta Potty on site. The second day I discovered items were stolen from my house. The house was constantly being left open and unattended, poor workmanship was everywhere. We eventually took part of the project over ourselves. Throughout the process we had asked for updated receipts, invoices and "credits" for items we knew we were not going to want. We requested multiple times for invoices spent on electrical material, plumbing material and siding material but never recieved any info. ****** sent us multiple contracts but never actually "credited" us for anything. He just rewrote the contracts changing numbers around. Honestly it was impossible to follow. Now ****** wants to terminate the contract but I have given him money for services not rendered. He refuses to give back the money and I do not know where to turn. We are looking to recoup money we paid to him that he allocated to himself as "contractor interest" and also additional monies that was supposed to be allocated to trades however he pocketed the money. We have more info and hope you can help.

      Termination of contract was at fault of the customer *********************** caused by following:
      FRUSTRATION and REPUDITION
      alteration of the contract to the extent and over 30% of work from original agreement were suddenly requested to be removed from signed agreement (tile work in bathrooms, painting, flooring, doors and trim work)
      (Customer tried to use me and my vendor discounts without my knowledge to purchase the materials for:
      flooring ( bigger size oak planks and twice expensive wood than described in the contract 
      doors (totally different from proposed and described in the contract and 3 times more expensive)
      front and back porch decking (customer requested to do a quote for different and 3x more expensive materials proposed by contractor and presented in a quote to the customer (customer asked contractor to use his vendor to purchase more expensive materials with my contractor discounted price and at the same time asked if contractor wouldnt mind to let him work on the front and back porch by himself and his brother so he can save some good amount of money and gain with high quality materials installed on the house - contractor agreed to it and altered the contract which is here attached to the files 
      roof over the porch Contractor Super Job Inc tried to propose new metal roof solutions but customer insisted to use his friend company to perform front porch metal roof and contractor agreed to it giving a discount based on square footage to the customer and its described in the alterations to the contract
      Customer requested to reimburse for bathroom plumbing fixtures because they wanted to purchase on their own taste so contractor reimbursed them $2,200.00 for proposed materials from original contract and sent them alteration to the contract 
      Tile work was unexpectedly requested to be removed from contract - customer was shopping around with different tile contractor to get better price. When once met him with one of tile company representative he was telling me that it is a friend of him and hes showing him around the house. I have delivered the tiles which customer has bought to the house. I have prepared all tools and adhesives to perform the work. Then I had to bring down everything when got informed Im not gonna do tile work. 
      Customer was planning to take over most of the project without my knowledge. Customer was waiting to exploit my discounts on materials necessary to finish the job. 
      Super Job Inc signed the contract with *********************** - The Customer - on terms described in original agreement. 
      Super Job Inc have made a decision to terminate the contract upon disagreement with The Customer who tried to FORCE his latest alterations the contract. It was impossible to find the common ground and keep the agreements made between bout parties on original contract. 


      The work was interrupted by customer with various requests to alter the original contract. 
      All the information is attached with description of proposed changes to the agreement. All work was completed in full or partial described on the termination of the contract/agreement. 
      Inspection were completed up to date without any issues or complications. 


      The project started with demolition of existing second floor of the dwelling.
      Followed with footing work and framing, roofing and windows installation. 
      2 chimneys were extended and waterproofed copping was completed.( one chimney was not included in the contract so customer was billed only 50% of cost to extend it - described in termination of contract.
      2 new chimney caps installed.
      During that time one of the framing crew members had no idea that the rest of the house is going to remain so he had taken with him 3 low value small items - old flash light, small cap to the metal container and old drill bit. Value of approximately $50. 
      When customer requested to change the layout of 2 bathrooms upstairs we did not charge him for that alteration.
      They had no intention to steal anything from the house and items were returned after explanation and apology. Unfortunately it should never happened. We did put behind this story and continued to work over the siding and spray foam insulation. 
      Just after ************ started rough plumbing work and electrician rough electrical wiring. 
      Town inspections were performed and passed for all rough work.
      Meantime customer have decided to alter his hvac heating system. Instead of one cooling/heating system for 2 floors he decided to do 2 AC system for each floor and separate 2 baseboard heating zones for upstairs and on top of that 2 hydronic radiant heat floors in bathrooms. Customer agreed to the proposed price and additional cost of changes. 
      New manual JSD expenses were covered by the customer individually.
      On top of it ********************** covered customer request for 2 new windows order to be installed by the homeowner personally.
      For one window customer was not charged because we received from manufacturer one extra(they gave us one more with no charge by mistake). Will deliver window this week. it came in to warehouse on Monday this week. Most of the punch list was taken care of. Will upload the documents followed by this response.


      All the calculations are done on alterations to the contract and on final termination of the agreement as well.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

       

       

      My complaint with ******************************* and Super Job Inc. remains unresolved, as ********************** wrongfully took money from my family under false pretenses. *********************************** conduct has been deceitful, fraudulent, and entirely unprofessional, posing as a general contractor while concealing crucial information.
      From the outset, ********************** failed to disclose his employment with ******, a construction company in *********, and misrepresented his availability as a full-time independent contractor. His failure to disclose this vital information significantly impacted my decision to engage his services, as I would have declined had I known his employment status.
      Throughout the project, mismanagement and negligence were rampant. Items were stolen from my property, and despite ************************** dismissive attitude towards their value, the invasion of privacy and security breach is unacceptable. His claim that workers were unaware of the project scope is ludicrous, given the clear plans indicating minimal impact on the downstairs area.
      Financial mismanagement compounded the issues, as I was charged for work such as a second chimney extension. ************************** attempt to justify this oversight as a mistake is unfounded, given his access to approved plans and prior knowledge of the project's details. Furthermore, discrepancies in the contract, including removal of essential items without disclosure, highlight ************************** unethical practices.
      ************************** claim of covering customer requests for window installation is false, as I was charged for additional windows without justification. His failure to fulfill orders and provide adequate documentation further underscores his lack of accountability.
      The financial exploitation extended to materials, with charges for plumbing and electrical materials not purchased or used for the project. ************************** termination of the contract without notification to subcontractors further demonstrates his disregard for professional conduct.
      In addition to financial losses, ************************** failure to provide necessary documentation, including invoices and inspection reports, raises concerns about compliance and transparency.
      In response to these egregious actions, I was forced to reduce the scope of work with ********************** to protect my home and investment.
      I seek restitution for the funds wrongfully taken, including unauthorized charges and expenses incurred due to ************************** negligence and misconduct.
