On 4/26/2023 I signed a contract with ***** ****, *** to install a new pool liner. I paid a 50% down payment totaling $3,250 on my credit card. I was told by *****, one of the owners, who issued the contract and took payment, that the work should be completed in mid June. On August 10th 2023, I reached out to the ***** ****, *** get an update as to when the work would be performed. I then received a call stating that they were having financial issues after a dispute with one of the owners, *****, whom they say embezzled money. They told me that they would do the work and it would be in early September. On Friday, September 29th 2023, I sent a text message to ***** ****, ***, that I wanted a full refund. The exact text of the message I them on 9/29/2023 is: “ I feel that I have been extremely patient up this point in waiting for the installation of a new liner. Unfortunately, my patience is gone and I would like a full refund for the $3,250 down payment that I made on April 26th 2023. I am hopeful that you will honor my full refund request without any further action on my part to resolve this matter.“ On October 5th 2023, I tried calling ***** ****, *** and there was no answer and the voicemail box said it was full. As of October 10th 2022, no work has been performed and I have had no response from ***** ****, *** regarding my refund request.
