      I purchased a 2010 **** *** ******* van from this business on April 21st, 2023 for $7,921.20. I gave them $4,000 cash down payment and they financed the remaining balance at payments of $250 monthly until paid off. The check engine light come on first day I had it. Transmission is leaking fluid and it makes a jumping movement at times when transitioning between gears. The Engine is overheating, Window on passenger door and sliding doors malfunction at their will. The back tire heats up and smokes and stinks horribly. There's a terrible clunking in front area when turning. I have not been able to safely drive this vehicle because I'm scared of all the issues and I'm in a wheelchair. I have tried so many times to get this business to help me and he's refused. I have many text messages with him saying it's basically not his problem, as I'm the new owner. Then around mid June. I received a phone call from a business called *** ********* and they informed me that ******* * had sold my contact to them and that I was now to send them my payments. I gave them my entire savings so I'd have transportation to and from medical appointments and I'm not able to do so. I have in text message from him telling me it's completely safe for in town driving. I didn't pay all this money for limited driving options. Most of my medical appointments are long distance away. The vehicle has been sitting in my driveway and only miles put on it has basically been to and from his garage with my begging for help. I've been physically sick from this situation and then to have him sell my contract to get rid of me was last straw. And now I'm seeking a refund, as he's surely unwilling to help repair. I suggested a switch in vehicles and he basically made fun of me. I think he seen a disabled, older, woman and he took advantage of me. I have sent James many text messages informing him of the problems with this vehicle.

      BBB spoke to the business owner and the following was relayed: The van had around 180,000 miles on it at the time of purchase.  Per NYS, any vehicle with over 100,000 miles on it at the time of purchase has NO warranty.  But I ALWAYS go above and beyond for my customers and provide them a 6 month / 7,500 mile warranty no matter what, because I stand behind my sales.  She has this warranty, it is active.  If there was anything wrong with her van, it would be covered under the warranty I gave her.   The van has been to 3 different places and nobody can find anything wrong with it.  She says there is something wrong with it.  3 different places found nothing wrong with it.  She drive it about 30 minutes from her house out to ***** **** ****** and told *** that it is leaking fluid.  ***** **** ****** could not find any leaking fluid!  She told a different place that the van door wouldn't shut.  The tech there opened and closed the van door without issue five times and told her he couldn't find anything wrong.  There is nothing wrong with the vehicle.  And if there was, it would be covered under the warranty that I provided.  I never have any complaints because I stand by my business and always go above and beyond.  I'd like her to show BBB the auto report that says something is actually wrong with the vehicle because, again, there is nothing wrong.  And, again, if there was- it would be covered. Thank you.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  Picture 1Mr. ****** says there's nothing wrong with vehicle, yet he says he's trying to get in into a shop and at end of text suggests for me to drive it locally. I didn't pay pennies short of 8,500$ for a vehicle to drive just around town. Yet, he reports to you that I'm pretty much delusional and nothing is wrong with the vehicle.  Picture 2At bottom of text Mr. ****** mentions one of the clunking sounds and his opinion on what it might be. YET, he stared I fully understand routine maintenance needs, but an entire list within a week of purchase is ridiculous. Yet again, I'm being delusional and the vehicle is fine.Picture 3 In this text Mr. ****** mentioned the smoking tire and the check engine light that's still on. Yet again, I'm delusional with anything being faulty with this vehicle.  Picture 4 Mr. ****** flatly states that his father feels it's the transmission. I'm not sure if these texts are acceptable to BBB. I know I can take them to court with me. Picture 5 Paperwork tha* ***** ************ gave to me due to the Transmission leaking. Needed repairs that the stellar warranty won't cover. Pictures 6,7,& 8 are of the paperwork done at Mr. ******* friends' shop. *****.  I'm not in agreement with said response.  I've attached text messages. I know they're accepted in the courts. I have attached papers from 2 repair businesses that say there is some type of transmission leakage. The check engine light is still on as well. The gentleman at ***** said it wasn't, but oddly enough it was when it was picked up. The same person he mentioned in his response saying they said there was no leak. He called it sweating, but 2 other mechanics said if there's fluid on outside it's a leak. if there's transmission fluid on hoses there's a leak. He recommended that I replace the Cooler hoses. Why, if no leaking? Same recommendation from the other submitted paperwork I sent from ***** ************. Honestly, the doors are the least of my concerns. The repair shop called ***** was a run down, unprofessional, business. (In my opinion only, of course.) As you can see there's quite a list of repairs recommended on the ***** paperwork that I sent you and none of the recommended repairs are covered under this wonderful warranty he's so generously offering his customers. The recommended repairs on the ***** ************ paperwork are also not covered by said warranty. The vehicle is going into an accredited repair shop at 8am on August 1st, 2023. I'm paying them to fully check the vehicle from top to bottom. An unbiased facility. His said warranty is of no value to his consumers by my experience. But if it makes him feel better offering his customers a delusional warranty, I guess it's his priority. This mentioned ***** and ***** ************ in Elmira are the only 2 facilities in the area that accept his warranty and I'm again not comfortable with the ***** facility . I got the impression they're more than business affiliates. Friends cover for friends. Again, only my personal assumption. These are the only 2 facilities I've taken it to on a business level. If I was able to get this vehicle fixed and not have to head to court I surely would. I'll happily submit my resulted paperwork from the repair shop after it's looked at on August 1st, 2023. I'm also looking into why this vehicle had to be inspected twice as Mr. ****** personally told me in a cellphone text message (attached) that it passed twice with flying colors. Why would it need a second time, if first was fine? I'm also going to pull ***** further into the situation, as they obviously spoke about my vehicle's visit with Mr. ******, as he speaks of information, that I never disclosed to him that only they would know.       I bought a car in may of 2021 from this dealership they claimed the vehicle was in perfect operating condition it is not the rear suspension is very bad the bushings are gone the rear alignment cannot be corrected due to the fact that they cut the cam bolts out and did not replace them they just put them back in and welded them completely illegal also the check engine light has been on since I brought it home and the inspection was done illegally the tires had wires showing I have contacted them on numerous occasions I have text proof of this they still refuse to correct the issues I’ve told them they can buy the vehicle back at full price they don’t respond actually they rarely ever respond there service is horrible

      ***** ****** purchased a 2004 ***** ******* with 150,299 miles on it from Initial D Motorsports on May 21st, 2021 with VIN: *****************. This vehicle was sold with over 100,000 miles and has no NYS limited warranty applied to it because in the state of NY The Limited Warranty and NYS Lemon law only applies to vehicles sold with under 100,000 miles on them. As a courtesy, Initial D Motorsports offers a 3 month/ 5,000 miles 4 Star service contract we provide at no additional cost through *** Warranty Company. 
       
      This vehicle passed NYS Inspection as shown in the attached documents as required by NYS Law. It is impossible to obtain a NYS Inspection with a check engine light on since the inspection station machine connects to the vehicle with an OBDII Port and confirms the monitors have set. The tires were in a passable condition as confirmed by the inspection station which is a third party repair shop in NYS that we have no affiliation with. Two of the tires on this vehicle were brand new at the time of sale. Cam bolts are not part of NYS Inspection and there are no bolts welded shut on this vehicle to our knowledge. ***** ****** signed a document understanding that the lemon law does not apply to this vehicle sale and there is no warranty provided by Initial D Motorsports aside from the after-market warranty provided through *** Warranty. ***** ******'s claims have no merit. In closing, less than 3 months after purchasing the vehicle we happily repaired the power steering rack at our cost and 2 additional tires were replaced on the vehicle; we were not required to perform any of these repairs and did so out of the goodness of our heart. We had offered to purchased the cam bolts that need to be replaced and shortly after that ***** ****** com plained to the BBB. Due to the slander of our name and time needed to respond to this complaint we are now rescinding our offer.
