              The contractor came to our house months ago. He gave us the estimate. We signed a contract for him to build us a new front porch. His name is David Tuma. He said he needed the money up front, which we were hesitant about but we had a contract and were desperate for the porch. He said he was finishing up a couple projects and then would come to do ours. After we didn’t hear from him for a couple weeks, we reached out and he said he was trying to find people to help him. Said he would get back to us. When we didn’t hear from him again, we reached out and he said he just had his appendix out and he was sorry. He would get people together to get it done. We were understanding about that. So then he said he wanted to come out to look at it again. He set up a time and then never showed. So we reached out and he set up another time. Came out and looked at it. Said he would be out in a week to do it. Hasn’t been. Said he would contact us for a date. No response.

              I hired David in December 2020. It was a big job with some other small items inside our cottage. The whole job was going to be around $12,500. He asked for $5,600 up front. Due to the year of covid and figuring that this was a tough year, I gave him the funds. He did a few things over the winter inside but not everything. Then he was getting ready to do the retaining wall & asked for an additional $5,000. What was supposed to be done in February, then March, then April never got done. Excuses ranged from guys called in sick, flat tire, grandma died, truck broke down & just being ignored completely. Eventually, he brought in some guys, destroyed the property and walked away. I was devastated as my rental season was starting and now my entire lawn, sidewalk and driveway was destroyed. It took multiple phone calls to attorneys, judges, police but I got a portion of my money back. Thank you Yates County Police Department /Deputy ****** for forcing his hand & threatening to look into his business deeper - that he's licensed and that all the funds were put into an escrow account (NY law). I learned this is pretty standard up there in that area. I am blessed we found another contractor who could squeeze me in & did a beautiful job but what a mess!! *****
