      WD Paving completed my driveway on 9/8/22 for $15,000. On 10/19 I contacted Billy to inform him of possible plow damage in the future because the driveway was 1" higher than the road & didn’t follow the pitch of the road. The pitch is important as it only amplifies the depth in which the plow will access the driveway. He stated, "yes it was slightly higher but not much". However, he never stopped by to understand the concern even after the damage occurred. He just gave excuses why it wasn't his fault. So, I decided to discuss this with NYS DOT and several reputable paving companies. A DOT engineer did an inspection & stated that the driveway doesn’t follow the pitch of the road and was higher than the road. I provided Billy a diagram available on DOT’s website that illustrated a proper implementation. DOT also stated that an insurance claim against them would be declined so your only recourse is to sue. I asked several paving companies to inspect the driveway and provide testimonials regarding the cause of damage and the cost to fix it. They all stated, water needs to shed from the road to the driveway & drain to the sides. This ensures a proper height and pitch and avoids plow damage. I will continue to contact more companies to ensure there is a consistent opinion of where the fault lies in the event the BBB outcome is not favorable. A frustrating fact is that Billy blamed me, his own excavator "you know I subcontract", and of course the plow drivers who only knows how to damaged my driveway NOT my neighbors. My original 18 yrs driveway had no plow damage. Plow damage is almost nonexistent except mine, Brian M...d's who Billy paved last year, and Billy's own driveway, which he sent pictures of. I also asked Billy to set my driveway level with the ground, he didn’t! My driveway is 3-5” higher than the ground. In addition, there are several long cracks forming.

      BBB spoke to William at business and the following was relayed:

      We are willing to return and lower the asphalt. We would mill 2 feet in from the shoulder and remove the 3" and add a piece that is lower. We would not be responsible or guarantee from puddling or scraping. The cost for material and labor would be $500 and we would return and do this.

      We contracted with WD Paving for a chip and seal driveway because of a serious weed infestation in our driveway. We were assured that even though there was no guarantee that the weeds would not some day return we could expect several years of weed free driveway before they returned. This spring the weeds were back as bad if not worse than before. We asked that the money paid for the chip and seal driveway be applied toward the price of an asphalt driveway but Mr Donovan refused.

      In response to complaint # ******** ****** *******:  The customer received an estimate from our company on 8/20/21 for a chip/seal driveway installation after receiving the quote the customer then decided to move forward with the project. I’ve attached a copy with this response. We do not offer a warranty or guarantee with this type of service because this is not a hard surface product like asphalt. We installed Mr. ******* driveway late September of 2021. Before installation we began the preparation of the driveway by digging out the entire driveway we did not work over the weeds we removed them and started with a clean area before applying a two coarse layer consisting of liquid asphalt and stone. In early July we received a letter from Mr. ******* expressing his concern with his driveway we then contacted him via email asking for some photos and confirmation of a day and time we could come and take a look at the driveway all of which would be on our good faith to try and resolve the weed issue as it is not warrantied . Mr. ******* stated at that time he would not be home for 2weeks due to an emergency. With that being said I explained that I did not believe it was a “product issue “ but in fact a surface weed issue that the sooner they were addressed the less invasive it would get . We then asked for Mr. ******* to contact us when he would be available after no call or response for over 3 weeks we reached out again via email on 7/27/22 and 7/28/22 trying to confirm a day and time. With no response our office manager called Mr. ******* attempting to send our employees over to remedy this situation. Mrs. ******* answered the phone and explained they were away again and would not be available. On August 5th we were able to contact Mr.******* and make a tentative plan for the next morning to have two company representatives/employees come to the residence and address the issue. On August 6th around 9am our employees arrived with a natural weed treatment and a weed burner to mend any liquid asphalt if necessary after removal. Unfortunately this is not what Mr. ******* was hoping to achieve he refused the offer to remove the weeds and did not let our employees address anything.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. While it is true that W&D Paving did agree to send someone out to spray the weeds growing in the driveway we explained to them that we were going through a difficult family medical emergency which made our presence difficult to predict and that we wanted to be present when anyone arrived on the premises.  On August 5th, we spoke with someone from the office who said that a representative would come out the following day to “assess the problem”.  We attempted to explain to one of the representatives when they arrived that we were told that he was to “assess the problem” and that what he planned to do would not work as we had ourselves attempted to poison only to have the weeds return.  We also tried to tell him that we were needing to leave to travel down to New York City and that we needed to be present. We asked that he convey to his boss the fact that we were asking for a more permanent solution, not the need to continually apply poison.   Unfortunately this individual was quite rude and did not want to hear anything we tried to tell him. The solutions offered by W and D Paving will not rectify the problem since we have tried to kill the weeds ourselves using both “natural” remedies and strong chemical weed killers, only to have them return.  I must again state that had we known that poison was the only solution, despite the assurance given at the time of signing the contract we would not have paid $7,500 for a driveway that failed to last less than 3 months.  We ask again that the money we paid for a system that has failed be returned or applied as credit to the cost of an asphalt drive.  I am attaching photos of the dead weeds with new growth already popping up.  Regards, ** ****** *******

      In response to complaint ********: The request for a refund/credit is not something we can accommodate as this is not a situation where the product we installed is faulty or failing the problem in fact is surface weeds that I agree can be very aggressive. To explain airborne weed seeds blow around and drop to the driveway surface germinate and begin to grow and spread quickly. We offered to help remedy this by using a natural weed killer and weed torch this would have been a more aggressive approach to the removal of the weeds but our employees were told you did not want this done. We do not warranty/guarantee any stone driveways because proper maintenance is required. With that being said we have made numerous attempts to remedy this issue within reason. What we have tried to do from the beginning is help with the issue at hand. Refunding the money paid for your driveway is not something our business can provide as the cost was used for the material fuel and labor provided to install your driveway.

      BBB spoke to William at business and the following was relayed: From the pictures, I believe that grass clippings and weed seeds were blown from lawn mowing onto the surface of the driveway and germinating in the spring. We offered in good-faith and remain willing to use weed burner which will kill the weed cells and re-mend the liquid asphalt. The driveway was installed properly and was not installed over weeds.
