The car dealer has not replaced a defective part for 8 months. The vehicle has a defective nox censor since April. 2022. The vehicle is not drivable. This part is covered under warranty. We have constantly been in contact with the company and are told we are on a waiting list, for the whole summer we have had a very expensive RV sitting in our driveway. Are understanding is that the company is being sued for this very problem and have done nothing to resolve the complaint.Business response

To whom it may concern, This client been told this is an issue with ********-**** ***, it is NOT the dealer's fault. Parts are back ordered and they can try at another location and will have the same outcome. This vehicle is In need of NOX sensors for the check engine light concern which he is fully aware are on backorder at the moment due to the EMP. The NOX sensors have been ordered for this vehicle but with the extremely high demand for the EMP recall, they take a while to come on (i.e. two other vans that we have had took 12 months to receive). His vehicle does not fall under the EMP recall. Murad A****Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Regards, *** ******* This matter could be resolved quickly if ******** would allow us to have the nox sensor replaced with another brand. There sensors are on back order because of a law suit. We were told that we have to have it replaced with their brand and by them or the warranty is not valid. Because of their negligence we are sitting with a rv that is unusable. All we as asking for is a reputable mechanic replace the part. Either let us fix the part or buy the vechile back.Business response

Please direct the client to the Manufacturer at * (***) ***-**** or the upfitter they purchased the vehicle from for further help. We do not sell camper vans and we always try to help with service. We bought a brand new 2021 Mercedes Benz Sprinter on September 7th with 30 day temporary registration and after 7 weeks past October 7th (expiration date) and not receiving the License Plates and Registration (we contacted them every week) and unable to drive this vehicle for 7 weeks. On November 22nd we took it to DMV and the DMV verified with the State and County of Taxation that nothing was ever paid and even called Romano Mercedes Benz and told them (Goran G**** Sales Manager) directly that the DMV would not issue Registration & License Plates unless we paid the DMV which we did. and since we had already paid Romano Mercedes we then provided receipts, proof of paid registration and simply ask for our money returned that was never paid to DMV as promised. Romano Mercedes said they can’t pay us until their 3rd party company they use pays them? What does that have to do with us exactly? Thus we’ve had to retain legal council and sent via certified mail demanding to be reimbursed. As of Decemeber 7th we still haven’t gotten a response from Romano Mercedes.Business response

to whom it may concern,Our check to the out of state registration/titling agency was dated 9/8/21. The agency cashed the check on 9/23/21. They, in turn, sent the paperwork and their own check for sales tax/DMV fees to the Nevada DMV. We have no knowledge as to the reason for the delay in processing between this agency and the Nevada DMV.We have been informed the client went to Nevada DMV and asked for the paperwork to be pulled, processed, and paid directly for the tax/titling/registration fees. It is unknown why the title agency's check was not used by the Nevada DMV.We are in the process of obtaining a refund from the titling agency and will foward the funds to Mr. ****** via Federal Express as soon as they are received by us.The client is mostly correct and is due a refund that we will process. Better Business Bureau: I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, ******* ****** The Dealership is failing to acknowledge that we reluctantly went to the DMV to register this vehicle in person as the vehicle was sitting in our driveway for 7 weeks with expired temporary plates as we waited patiently for them to arrive by mail as promised by the dealership. When we went to the DMV (6 hours of wait time). The DMV checked and doubled check with the State & County department of Taxation and the DMV department of Taxation and they had no record of anything being paid on this vehicle and the DMV even called the dealership and spoke to the Sales Manager Goran to let him know these facts. Furthermore, they told him the only way they issue Registration & License Plates for this vehicle is if we the clients paid the DMV. The dealership alleges that we pulled the paperwork which was categorically false as there was no paperwork to pull and we simply wanted to be able to drive a vehicle that had been sitting in our driveway for 7 weeks. We then sent proof on November 22nd, 2021 to the dealership: 1) Copy of the Registration 2) Photo of the the License Plate. 3) Copy of the DMV receipt of payment. We then asked politely to send us a refund for $8,005.35 (which is what they charged us for registration)! They refuse until they get their money back from whatever 3rd party company they hired, not our problem! We know demand $8,0005.35 + $275 for attorneys fees = $8,280.35 to resolve this matter.Business response
