      I signed a contract on October 25, 2021 with ******* zotinis of zotonis construction to finish my basement.I gave him a check for $15,000. On November 30, I texted him to find out what time his crew would be coming. He didn't respond. I found 5 others that he started work for and never completed. The start date for my basement was December 6, 2021 . No one showed up and he isnt answering his phone or texts. The last time he showed up for a job that I know of was the first week of October. I now believe he never intended to do my basement. The work he did for the others were not up to code, it was later learned. I also come to find out that he is not licensed for queens county **.He told me he was and gave me his license # ******. This number is/was his license for Nassau county.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      I have reached out to *** ********************** twice with no reply it took me two weeks to empty my basement so he could start the work on December 6, 2021. My house is now in disarray. He didnt even have the decency to call and tell me he wasnt coming. I know of at least five others that he has done this to and in one case the work we started and it didnt pass the building department inspection. It had to be torn down and done over, which cost a Customer a lot more money. At this point I want my money returned since *** ********************** broke the contract. I am willing to work out a payment plan with him. Please have him call me so we can get this resolved.

      I hired Zotinis Construction to renovated my Cooperative unit on 05/28/2021. ******* ******* collected two payments from me, totaling in $33,750. To this date, 12/05/2021, less than half the job has been completed, the job has been abandoned since September 2021, and ******* ******* has admitted that he spend my money on personal issues and cannot complete my job. There were frequent lies about when he was claiming to work, the amount of work that was being completed, and the materials that were purchased for the job. ******* ******* eventually admitted he spent all of my money on personal issues (bailing himself out of jail, lawyer fees, child custody battles, medical bills, etc.) and that he no longer has enough money to buy materials for and complete my job. I have kept a complete timeline of events, have a signed contract with ******* indicated the amount of money I have paid to date, and several pictures of my unit it is current state as he has left it (completely inhabitable).

      Contract Date: 8/31/2021 Total Contract Amount: $13,000 Amount requested and paid by/to Zotinis Construction: $6,500 The contract was unfulfilled by Zotinis and any attempt at communication is inconsistent and does not support the commitment of the contract.The work was not complete and the contract unfulfilled.The business makes false attempts to complete the work as the communication is inconsistent, including lying regarding the cost of the materials that were originally agreed upon. There are at least 5 to 10 other customers that I have come into contact with indicating that Zotinis Construction knowingly stole money that was to be used to fulfill contracts. The money was taken and contract not fulfilled and work not complete.As per the attachment, we have tried to hire someone else to complete the job, however, the quotes are coming in well above the balance on the Zotinis contract ($6,500) and any overage that has to be paid is the responsibility of Zotinis as calculated damages for breach of contract based on the suffered loss due to failure of Zotinis to fulfill the contract. An amount of $6,500 is due to *********************************** for the breach of contract as a reasonable measure to bring the situation that would have existed has the contract been properly performed.

      ******* Zotinis, owner of Zotinis Construction, abandoned our deck project and made me and my fianc scramble and puzzle piece our deck on our own. We signed a contract of a completed deck with timber tech material, and all material included, a concrete patio, and a patio door replacement for 19k. All his company did was demo my old deck, and put in the new frame of the new deck and ran off with 14k dollars of our money. This has been going on for two months already, and he has mentioned to us the whole time that he is sorry, and is having personal problems. I am in contact with other home owners in my town and other towns who hired Zotinis, and they are having similar problems like us. He promises to give us our money back, but we have not seen anything thus far.

      Myself, *************************** and my fianc, ************************************* have not heard from ******* Zotinis, owner of Zotinis construction in weeks regarding paying us back.  I have many messages from him stating he could not complete our deck because he has personal matters to deal with.  In the mean time, our contract expired with him and we had no choice but to puzzle our project together with other carpenters.  ******* Zotinis took 14 k dollars of our hard earned money and the work he did before vanishing does not come close to what we gave him.  There are many residents in my town that have experienced similar problems from Zotinis and they have reached out to us.  If ******* Zotinis gives us our money back, we agreed to resolve this and move forward.

      My husband and I hired Zotinis Construction to redo our patio and steps in our backyard. The total cost of the job was $17,000 which we paid on time. There are 2 flags of concrete that are pitched incorrectly and are crooked causing water build up. The gutters were damaged and causing water issues and our foundation needs to be repaired. They put white board around the areas of the foundation for a temporary fix. The steps that were built are also having water issues The gate that was installed is uneven and they used the wrong post. It has now been 4 months going 5 months that we have contacted ******* ******* over and over and was promised these issues would be resolved. I had to hire another person to fix the gutters (which cost over $500) bc we could not wait any longer. I have text messages promising they will come and he just doesn't.

      [We will not consider this resolved until we receive a full refund.  We had multiple contractors look at the issues that having caused by Zotinis Construction.  The steps they built are  not up to code, Cement has no expansion joints which will cause the patio to crack, the gate was installed with the wrong posts and does not close properly, we had to incur costs of $500 plus already to replace gutters that they broke.  The whole project has to be redone.  I do not trust them to do the proper work.  We have been in touch with multiple families that this has happen to from the same company.  They need to do the right thing.

My heart is very big and I feel horrible rather ashamed because it was not purposely. I am hoping in the near future I can solve this matter but at this point I am trying to figure things out.
