    NY Attorney General and 43 Other State Attorneys General Sue 20 Generic Drug Manufacturers Alleging Conspiracy To Fix Prices And Allocate Markets For More Than 100 Generic Drugs

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the governments allegations, which have not yet been proven.

    On 5/13/2019, Attorney General Letitia James joined 43 states led by Connecticut Attorney General William Tong in announcing a lawsuit against Teva Pharmaceuticals and 19 of the nation's largest generic drug manufacturers alleging a broad conspiracy to artificially inflate and manipulate prices, reduce competition, and unreasonably restrain trade for more than 100 different generic drugs. The drugs at issue account for billions of dollars of sales in the United States.  The States allege that the Defendants’ conduct artificially increased prices to health insurers, taxpayer-funded healthcare programs like Medicare and Medicaid, and individuals who paid and continue to pay inflated prices for their prescription drugs.  

    The complaint alleges that Teva, Sandoz, Mylan, Pfizer and 16 other generic drug manufacturers engaged in a broad, coordinated and systematic conspiracy to fix prices, allocate markets, and rig bids for more than 100 different generic drugs. The drugs span all types, including tablets, capsules, suspensions, creams, gels, and ointments; and classes, including statins, ace inhibitors, beta blockers, antibiotics, anti-depressants, contraceptives, non-steroidal anti-inflammatory drugs. They treat a range of diseases and conditions from basic infections to diabetes, cancer, epilepsy, multiple sclerosis, HIV, ADHD, and more. In some instances, the coordinated price increases were over 1,000 percent.  

    The complaint lays out an interconnected web of industry executives where these competitors who met with each other during industry dinners, lunches, cocktail parties, golf outings and communicated via frequent telephone calls, emails, and text messages sowing the seeds for their illegal agreements. Throughout the complaint, defendants are described as using terms like "fair share," "playing nice in the sandbox," and "responsible competitor" to describe how they unlawfully discouraged competition, raised prices, and enforced an ingrained culture of collusion. 

    The lawsuit, filed in the United States District Court for the District of Connecticut, seeks damages, civil penalties, and equitable relief to restore competition to the generic drug market.  

    In addition to New York, Alabama, Alaska, Arizona, Colorado, Connecticut, Delaware, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Jersey, New Mexico, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin and Puerto Rico joined the suit.

    I received an email today from this company saying that I have an unsettled balance from almost 2 years ago. It lists the order number as ********, order date of 6/16/2022, past due amount as $104.75. I don't know what to do but I do not believe I owe them any money. I was signed up for a subscription for proactive skin care products. My orders were never correct, I placed multiple calls and emails every time my order was incomplete or contained items I never purchased. I was only supposed to receive orders every 3 months but I would get shipments at the wrong times and then get asked why I didn't pay for that order even though I wasnt supposed to be receiving an order at that time. I ultimately called and cancelled my subscription because it was stressful, my orders were never correct. It made me nervous that the orders were always wrong because I didnt want to be charged for items I either never ordered or never received. Now almost 2 years later, I get a threatening email that I owe them $104.75 and I need to pay now or its being sent to a collection agency. I do not believe that I owe them any money because during the call when I cancelled my subscription I ask whether there was any balance on my account because I did not want to have to deal with that company any more. I was told that no, there were no issues with my account and my account would be closed. Now, almost 2 years later, I feel boxed in. And after all this time how am I supposed to defend myself. I have zero faith in this company or reason to believe that this is accurate. And now I'm very nervous that I'm being threatened with creditors. I have great credit because I pay my bills. I do not want this to affect my credit but I do not feel comfortable dealing directly with this company as I have had nothing but problems and do not trust that this is accurate. If I'm wrong I will pay because I want this matter resolved, but I cant just take their word for it.

    Extraordinarily shoddy packaging and application. I actually have to have help opening the tube of lidocaine. One person holding the ridiculously complex top while the other presses the weak plastic tube into the cap and turns. The tube twists at the bottom and the middle so that after each opening the product squirts out uncontrolled. So far the medicine has not done what it is supposed to do, but I am instructed to apply 1g out of a 30g tube with no markings on it. I may or may not be getting the correct dosage. The product is slimy and greasy and NOT AT ALL what my physician led me to expect. I am all for generic meds if the product is equal in efficacy to name brands when properly used, but no product can be efficacious if it cannot be applied properly and in this case I seriously doubt that the application is the only problem. This is substandard foreign **** for which I am paying full *** manufacturers' prices.I will be complaining to the *** for allowing Taro Lidocaine to be sold in the *** and demanding that my insurer provide me with a name brand product that actually works.Please note that I am only marking this product with one star because the BBB system will not allow me to file this review without clicking a star and there are no negative stars.* ******* ****, **
