On June 18, 2022, Final Look Painting, owned and operated by Mr. John Sodaro entered into a contract to perform work on the home of Dr. and Mrs. **** ******** ***, my clients, located in ******, New York, for a total amount of $3,700.00. After entering into this contract with Final Look Painting, Dr. and Mrs. **** ******** *** wrote a $2,000 check as a deposit, which Final Look Painting cashed. Less than a week after entering into this contract, Mr. Sodaro attempted to unilaterally modify the contract without the consent of Dr. and Mrs. **** ******** ***. This modification Mr. Sodaro proposed, an additional $1,600 for priming and a third coat of paint, was rejected. Due to this rejection, Mr. Sodaro claimed that he could not complete the work agreed to in the contract signed by both parties. On June 25, 2022, Dr. ******** requested via text that the $2,000 deposit be returned to him and his wife. Later, on June 29, 2022, Mr. Sodaro agreed via text to return the $2,000 deposit. Dr. ******** sent a text on July 2, 2022, confirming that both parties were in agreement that the $2,000 deposit would be returned by July 31, 2022. Mr. Sodaro confirmed this agreement via text stating, “yes the agreement’s good we’re good to go…” Therefore, a letter was sent via certified mail on August 5, 2022, requesting that the $2,000 deposit be returned by Mr. Sodaro via check to Dr. and Mrs. **** ******** *** by August 19, 2022. As of today’s date, September 1, 2022, Mr. Sodaro has not returned the $2,000 deposit to Dr. and Mrs. **** ******** ***. Nor has he returned any portion of the deposit. My clients are requesting that Final Look Painting and Mr. Sodaro return their $2,000 deposit back to them immediately via check via U.S. Mail. It has now been more than 60 days since Mr. Sodaro agreed to return the $2,000 to them.Business response

BBB spoke to John at the business and the following was relayed: I am willing to refund the customer the $2,000. It would have to be in payments initially, $100 a month beginning in December until the Spring when I will be able to refund the balance left.Customer response

On November 22, 2022, Final Look Painting made an offer through the Better Business Bureau to my clients, Dr. and Mrs. **** ******** ***. This offer from Mr. Sodaro was, “I am willing to refund the customer the $2,000. It would have to be in payments initially, $100 a month beginning in December until the Spring when I will be able to refund the balance left.” Dr. and Mrs. **** ******** *** respectfully reject this offer. First, Mr. Sodaro agreed to refund my clients their full $2,000.00 deposit on June 29, 2022 via text. This text message was submitted with my clients original complaint to the BBB. Mr. Sodaro has not made any sort of payment to my clients since June 29, 2022. Mr. Sodaro has not shown good faith in this process, particularly when my clients were willing to work with him when he needed additional time to refund their deposit. Text messages that were submitted with the initial complaint to the BBB show that my clients allowed Mr. Sodaro additional time until July 31, 2022, to refund their deposit. These text messages also show that Mr. Sodaro only asked for additional time to return the deposit after July 31, 2022, and after follow up from my clients as to the status of the refund. Additionally, even after this, my clients gave Mr. Sodaro until August 19, 2022, to refund their $2,000.00. He failed to make even a partial payment prior to this date. Therefore, this offer is rejected as Mr. Sodaro has not acted in good faith. Secondly, the offer made by Mr. Sodaro is incredibly vague and leaves room for him to continue the practice of promising to refund the $2,000 in installments, but never actually doing so. It is unclear what “Spring” would mean in terms of a date when Mr. Sodaro would refund the balance of the $2,000.00 owed. Therefore, in addition to the lack of good faith shown by Mr. Sodaro, this offer is also rejected due to his vagueness. Sincerely, ********* ********* ****
