      April 8, 20** Order #*********** I ordered an A8 Aipas eTrike advertised with horn & turn signals. What I got had no horn or turn signals. ****** (who has not given his last name) claimed it was not advertised with horn & turn signals, though it was. Aipas since my complaint changed their ad, but the Aipas ad is preserved by the Wayback Machine record for May 6, 20** where the horn & turn signals are shown *********************************************************************************************************************************** Aipas NY argued that their ad did not say horn & turn signals, but here is the Wayback quote:~"Feature Configuration The bicycle is also equipped with a horn, brake light, front headlight, and turn signal lights."This is clearly shown by Wayback Machine. I also have screen shots.I ask for $300 to cover the equipment, its installation labor, & all my trouble trying to get re-imbursed. I don't want to return the eTrike.

      Dear Better Business Bureau,

      We are writing to address the complaint filed by ************** regarding the A8 ********************* Tricycle.
      Firstly, we want to clarify that we never advertised the A8 ********************* Tricycle as having turn signals or a horn. These features pertain to other models unrelated to the one ************** purchased. ************** has referred to information from a website called The Wayback Machine claiming it proves we are scamming him, but the information he provided relates to another website (www.aipasbikes.com), not ours (www.aipasny.com).

      We offer all our customers a ****** full return policy. However, ************** contacted us in late July, demanding $300.00 for a turn signal and horn kit. We have made multiple attempts to resolve this issue via email, but ************** has been completely irrational and unwilling to settle the matter amicably. Both we and the factory tried to explain that he was confused or mistaken about the features of the A8 trike, but he remains unwilling to be reasonable.

      In an effort to satisfy ************** as a valued customer, we offered him a choice between an additional $100 discount or a turn signal kit. He accepted the $100.00 but then became defiant and unwilling to cooperate, demanding $300.00, which is far more than the value of the items in question. Additionally, ************** has filed a chargeback with his bank. We sent him a letter requesting that he cancel the chargeback, provide a letter of withdrawal from his card company, and sign the settlement agreement we sent. His response was that he wouldn't cancel the chargeback until we paid him the $100.00 first.

      We tried to explain to him that this is not the standard procedure. After many attempts of trying to reason with **************, we have sadly come to the conclusion that he may have cognitive issues that prevent a reasonable resolution or is trying to perpetrate an illegal act. We have attached a string of emails between ************** and our company, now we are preparing to respond to the chargeback and provide our evidence to his card company.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      Unfortunately, ******, the AipasNY representative (who doesnt give his last name), has shown a persistent disinterest in telling the truth.
      I notified him very quickly after I received the A8 Aipas eTrike that it did not have a horn or turn signals though such was advertised as part of
      the eTrike.  After scheduled deliver on May 8, 20**, I discovered that it had no turn signals nor horn.  I then emailed AipasNY support
      on May 13, 20** as follows: ~Q:

      The A8 finally arrived; thanks for shipping.  I put it together & tried it out, but could not find any way to make a trun signal work. Hype on A8 says: "Prioritizes rider safety with a comprehensive set of features, including a bright headlight, horn, and taillight equipped with a brake light and turn signals. These advanced lighting and signaling systems enhance visibility and communication on the road."

      But I can't find any evidence of turn signals nor horn on this A8.  And I see no way to activate them.  The Manual says nothing about any turn signals.  So assuming that the A8 came as advertised, please tell me how to use the turn signals & horn.  Thanks.

      So the late July claim is false.

      There is no confusion on what was offered on my part.  The horn & turn signals were advertised as part of the A8.  The Wayback machine did preserve an ad stating thus, preserved before Aipas was able to wipe off the internet that claim.  However, recently I noticed that Aipas.com still had that claim.  On the grounds that AipasNY is a dealer of  Aipas, the main companys definition of the product is valid. But it is not just Aipas.com which made the claim, also AipasNY did on their web site from where I bought the eTrike.
      I think that ****** probably knows that very well.  AipasNY no longer displays that ad information. However, I did make a screen shot from AipasNY displaying the claim of a horn and turn signals. I shall attack the screen shot, which is clearly labed a* ********************************* . a comprehensive set of features, including a bright headlight, horn, and taillight equiped with a brake light and turn signals.

      Eventually ****** offered a $100 refund, which I accepted.  I did not become defiant nor ask for $300. That is false.  I am still willing to accept $100 settlement. All ****** has to do is to send me that $100.  He may refund my bank card $100 or send me a check endorsed for all debts, or any reasonable way. But there is no way I will withdraw my chargeback before he pays me. He has by email a statement that I will settle for $100 already. If I withdrew my chargeback, he could then refuse to pay me, & what could I do then?  I dont believe his claim that it is impossible to simply refund my $100 to my bankcard either.

      We are writing in response to the letter submitted by ******************************* regarding his purchase of the A8 ********************* Tricycle from our website.


      We would like to clarify that ************** has been untruthful about the information he provided in his complaint. While it is true that we offered him a $100.00 adjustment, he has failed to follow proper bank procedures by refusing to cancel the $300.00 chargeback he initiated with his bank. ************** is demanding that we pay the $100.00 before he cancels the chargeback, which puts us at risk of paying twice for his misunderstanding of the product's features.


      ****************** claim that our website advertised the A8 with turn signals and a horn is incorrect. He has referenced information from The Wayback Machine and screenshots that do not accurately reflect the current or past advertising on our website. The information he cited pertains to other models, not the A8.


      We also want to emphasize that we have clear and transparent company policies on our website. Unfortunately, ************** has shown carelessness in reading and understanding these policies. We refuse to comply with his unreasonable demands until he cooperates with standard bank procedures by canceling the chargeback.


      We remain committed to resolving this issue fairly and ask that ************** follows the appropriate process so we can move forward.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because: of stubborn AIPAS NY rep.

      I have been truthful as the attachment & screen shot show.  The attachment/screen shot (sent directly to BBB as rebuttal after initial interaction with AIPAS New York, show A8 in them.  I see no reason why AIPAS NY cannot just refund into my bank card $100 or send me a $100 check for all debts.  AIPAS NY will have a record of their refund to show to the Bank.  I will drop the charge back completely with the bank upon receipt of $100, which was AIPAS NY's offer.  If I dropped the chargeback, I would have no recourse, and AIPAS NY cannot be trusted, as it says falsehood about myself, though it has A8 visible in the WaybackMachine/Screen shot.  Incidentally, last time I looked at the apparently main AIPAS website, the claim about the horn & turn signals for the A8 was still up!  BBB should check that also before it gets pulled down.    Since the ad is clearly visible as for the A8, it is incredible that the AIPAS NY rep should continue with their false claim.

      AIPAS NewYork will not lose an extra $100 on this.  It is incredible that AIPAS NY should claim that my information is wrong, since it is visible.
      I don't believe that there is any violation of Bank Procedures by giving me a $100 refund. Perhaps BBB will know that.

      I think that it is foolish for AIPAS NY to act the way it is acting as it stands to get a bad advertisement for itself via BBB.  AIPAS NY shoots itself in the foot.

      The settlement of $100 may not make me whole for all the time I have spent on this & the installation of the equipment on my eTrike.
