I hired Mr. Judware to maintain my lawn for the season. He gave me a quote of $1400 for the season with $700 down and $700 due in July. I signed a contract and paid the $700. Mr. Judware mowed my lawn once on May 17th and a second time on June 30th. While was unhappy with the job he did for a variety of reasons, I felt that had signed a contract and should honor it. However I could not find a copy of the contract and asked him to send me one so I could better understand the frequency of mowing I could expect and what was included. I was feeling I would need to find someone else to keep up if he was going to come so infrequently. He never responded to my request for a copy of the contract and has not appeared to mow again as of 6/17. I have now hired someone else but am out a lot of money since he kept my $700 which apparently covered two mows. ( the going rate is around $54 a mow).Business response

I was contracted by this customer for lawn care seasonal contract for 2024 which included cutting her property weekly from May 15th through October 1, 2024 The amount was for $700 down and the remaining balance of $700 on July 1, 2024 for the remaining of the 2024 landscaping season even though my season had not started until May 15 the weather had made the grass grow extremely fast So I decided to start the season early for her and all my other customers The customer had paid me the $700 down And I had cut her property all but a couple of times through the first half of this season The times that I did not cut was due to impeccable weather which would’ve burnt her grass to cut as states in contract that service will be performed unless impeccable weather conditions so the customer was not happy with her lawn was cut and had asked me to stop service as she was going to seek out another company when she asked me to do this. It was a week before July 1, which is the start of the second half of the season. And also when Payment was due for the second half of the season. And in our contracts. Hers and everybody else’s it states that a customer is allowed to request to stop service if written a month ahead and agreed on by both parties. Also stated in her contract as in everybody else’s it states that if a customer breaks or breaches contract, then it is considered services rendered and all remaining balance is due in full immediately. Seeing how it was the start of the second half of the season, I decided not to charge her the remaining balance of $700 for the second half that she had already paid $700 for the first half and the first half was completed so for these reasons I will not be refunding the customer $700 as I have done work and to her property and even started to season sooner than I was supposed to I wish customer all the best in the future as well. As you can see, I have provided you examples with just two different contracts from two different customers that are right in front of me I’ll say the same thing and state that any breach or breaking contract will be considered services rendered and any remaining balance. I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below. Please see the attachment, as I took pictures of my front lawn (initially, because I'd never had someone I paid to mow leave so much cut grass sitting on my lawn and later, because I became frustrated with the lack of frequency and haphazard job). I will not belabor this further and will accept any outcome. The business claims he mowed weekly, but he only came twice during the course of a month. He claims he didn't come other times due to weather, but the houses around my house were mowed when my grass grew longer. In addition, the people I hired to mow when I gave up on him noted that they had mowed multiple times since the start of summer. He did not provide me with a copy of the contract I had signed when I asked for it. I wanted to file this complaint because I relied more heavily than I should have on the business' statement in the **** **** app that he was BBB accredited and would like to save others from making a similar mistake. I hate filing this, as I really liked Jimmy. He did excellent plow work and pretty good lawn work. We had a good relationship. He said he had professional movers -untrue. He told me he’d hire 3 experienced movers. He had two kids. One left partway through the move and left the other one alone to do the rest. This slowed the move down a lot and I had to pay a lot more. Also, things are missing. The hardwood floors got terribly scratched because, even though I told them not to drag furniture, they did. The bedroom was set up in the living room. Boxes galore were put in the bedroom. With my disabilities, it is taking me a long time to get to the bottom of that. I showed Jimmy the floors and he said to have Paul inform of the repair cost. He also promised that once the bedroom was clear, they would move my furniture into the bedroom. As I unpacked, I realized that they set a box on top of my fairly new TV stand, but there was an iron picture frame under it. They just tossed the box on it and scratched my tv stand. They also scratched the newly finished hardwoods badly. I am missing things. My air fryer, a few months old. Also a file box. I had to pay $85.75 to get a new certificate of title for my car. The top grid to my weber grill. I’m still going through things. I told Jimmy and he made it clear he would do nothing about it. He said I never told him about anything going wrong which was untrue as again, he saw the floors, the bedroom and the living room. He knew it was taking me a long time to get through the boxes and when I did, that’s when I noticed the missing items. I still had him quote me for plowing this coming winter and he doubled the price to over $800. I’ve done research and no one is even close to that. I can’t help but think that this has something to do with the move. Upset and so disappointed in Jimmy.Business response

BBB spoke to James at business and the following was relayed: The customer never brought up any issues until after she received the quote for snow removal this year. I told her at the beginning we were not professional movers but would help her out.
