In March 2021, I had Jim Benedict come to my home to give an estimate for a partial kitchen remodel. I received the estimate on 3/24/21, signed and returned it to him. He estimated the job could be done in August. I gave him $5000 deposit in July, through an employee of his that I know, and then emailed him 7/19 to see if I was on his schedule yet and to see when I could get sample flooring, countertops etc to look at. On 7/23 his office replied "I'll let Jim know, and try to get samples to you" Didn't hear anything after that. On 8/23 I emailed again to see if we are getting close to a date, I never heard a reply from them. So On 10/13 I emailed requesting my $5000 to be refunded. I did get a reply to that. They will only refund me $3750, and are keeping $1250 for restocking fees! They had nothing to restock as they had no idea what I wanted for my job! Can you help get my $1250 back? BBB spoke to Jim at business and the following was relayed:
I was away on vacation and scheduled to start the customer's job soon after returning. When I returned, two employees had left. One was my lead foreman who left to start his own company. ***** is his wife's aunt and a week prior to the job starting wanted to cancel the contract and hire her niece's husband. We had a verbal conversation and she was told if she cancelled the contract at this point she would receive 75% back and 25% would be kept to cover materials already purchased, restocking fees we would incur, and time spent putting the job together. She said she wanted to cancel anyways and was mailed the 75% refund.
