      We paid Richard D****, Jr. (RJ) of DAST Construction $3,500 via check on 11/01/22 and was postdated for 11/09/22. RJ deposited or cashed the check this his bank account on 11/09/22 (bank records available, as well as check image). He had written us a receipt that stated "Deposit for boiler system" for the same amount. His name is on the receipt. Since then, RJ had dug the trench for us to run a new propane line, and he did some previous work for us as well with no issue. Fast forward to February 2024 and after multiple calls/texts to set up installation, his original phone number (listed on BBB) has since been deactivated, website no longer valid, and emails being returned "undeliverable."

      He came out to look at our electrical issue, then got our money for supplies and never responded or came back out again

      I paid them to do work around my house they have made it unsafe, they left a mess, did not complete any major jobs I paid him to do. He left my furnace with a pipe wedged between the wall and the furnace door because he stripped the bolts out I also paid for the electrical box he bought a box but didn’t install it he left that in front of the electrical box I paid for a fence he did not use enough screws and panels are falling off and crooked I paid for a new chimney I got a used metal pipe out the back of my house he used muffler strapping he found in my garage to secure it to my house he drilled threw my foundation i believe he also did it incorrectly and has caused damage to my foundation I paid for a whirl pool and he arrived with a used what appears to be a bright red hot tub from a hotel room he stated if I did not accept that he would not bring me the chicken coop I paid them to have built he left my bathroom unusable I cannot use it as a hot tub because it floods water every where from the pipping he installed he removed all the structural support out of my bathroom wall and hung sheet rock with fern stripping he left live electrical wires exposed from the hot tub to an electrical socket the shower doesn’t work either he never installed the handles he was paid to put ice melt wires up and bought the incorrect size and installed them straight across because the wire wasn’t long enough instead of zig zagging the wire and going up the valley where I had ice jams he left my cellar a pig sty with black sut from the furnace I paid for insulation in the attic and for it to be installed and it was never done I paid him for a deck for labor and materials and he never installed the deck or bring the materials I have checks to prove I have written him I’d like my furnace tub chimney and ice melt wires and fence and electrical box and all other work paid for done

      Called business and was told that the consumer is not suppose to be contacting him or anyone else due to the harassments charges that was placed against her. I asked if the business told her to court and he said no. The local police was called and she was arrested for harassment and was told do not contact business or anyone else regarding this matter.

      I asked him to send me paperwork.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      I was looking at your email and noticed dast comments for the first time all is a bold faced lie I was not charged with harassment and I certainly wasn’t arrested. This can be verified by New York State police *********** ny barracks. This matter has not been resolved as I stated in my response to email I sent upon receipt of 9/13 email from you. I asked that this case be reopened but this far have received no response. I await instructions on what to do next.

      Paid Deposit 2/14 Start day 2/20 Worked off and on until 3/24 Paid a total of $13065 including deposit I hired this company back in February 2023 to do renovations on my older home. Richard D**** and I agreed to $1000 deposit and a labor contract-essentially I paid him every couple days with ****** or cash, with the $1000 deposit acting almost like a retainer to hold services and was to be used towards the last day of service. Work was mediocre at best. I didn’t understand the full extent of how badly Richard took advantage of me until I brought other contractors in. Several projects started and stopped midway. The window in the basement that he said was completed was floating, same with the laundry window that was left midway. A floor joist in the basement that was jacked up was cracked in two places to the point the integrity was shot and it was dangerous to not fix, which Richard didn’t seem inclined to tell me. **** ********** wires sticking out everywhere. The most obvious mistake was to the tub surround. The holes were clearly measured incorrectly. Richard told me I didn’t have to pay for that day of labor 3/24. Richard said he would be there the following Monday to work the remaining 6.6 hours which the deposit covered and fix the obvious mistake to the tub surround. The following Monday he said that his wife was having surgery and they’d be here on Thursday just to not show. This continued for a month. I asked Richard repeatedly to refund the deposit and replace the tub surround, which he straight refused to do and still refuses to do. Our last day of communication, Richard said he would be charging me the last day of labor and would refund $250. I’ve tried to remain amicable, given Richard chances to rectify the issues, refund the deposit, etc. I don’t want to have to escalate this, but he’s leaving me little choice. At this point the full deposit should be refunded, the tub surround cost and partial refund for misrepresentation of services provided.

      Paid Deposit 2/14/2023 Start day 2/20/2023 Worked off and on until 3/24/2023 Paid a total of $13065 including deposit On 3/24/2023 Richard, the owner, admitted to drilling the holes in the tub surround off centered and said he would be back the following Monday to fix it and he never showed. This is also when he said he would use the $1000 deposit towards his last day of service. Richard D**** never showed to fulfill the last day of work the $1000 deposit covered, because of this he has no right to keep it. Over the course of the next month I asked him several times to return the deposit and reimburse for the cost of the damaged surround, he refused. Richard D**** owes me the $1000 deposit he has no right to and the cost of the replacement tub surround he admitted to measuring incorrectly.
