On July 22,2023 my business * ********* * *** *** bought two pieces of heavy equipment from Michael Carney of Carney Auto Sales. He fraudulently replaced the hours meter on the Mini Excavator according to Catipillar as we found out after it broke down and needs over $15,000 in work to repair. He misled us on the sale of this machine and will not help in any way to repair it. Manipulating the hours on a machine is a crime. Lettersent January 12, 2024 Dear Michael Carney, We purchased a ***** Mini Excavator and a **** ***** from you on July 21,2023. We purchased this equipment for $100,000.00 Check # **** made payable to you. We picked up the equipment from you in New York and trailered it back to New Hampshire. The ***** Mini Vin# ***************** is broken down. We brought it to *** and they did an Electronic test on it and found that the hours on the machine are invalid. The machine shows hours of 1394 but the electronic test has double those hours. The lifetime Hours from the Electronic test shows 2572. I have attached the electronic results. These hours were obviously tampered with before our purchase. The spin baron is wiped out, the amount of the wear on the chain is not conducive of only 1394 hours. We are kindly requesting one of these options from you. 1. Buy back this equipment from us. 2. Pay for the repairs. 3. Give us a portion of the money back for a machine with 2572 hours not one worth 1394 hours. 4. Or a trade of equal hours and value. (we would pay for the expense for the drop off and pick up) We hope that you will do the right thing and help us resolve this matter immediately. This is a very unfortunate situation, and we are willing to work with you and be as fair as possible to rectify this. Hopefully we can come to a fair compromise. If we do not hear from you soon we will have no other option but to contact the local Police and the Better Business Bureau. Please call me at ************ as soon as possible.Business response

BBB spoke to the business and the following was relayed: Everything was sold as is. There is no warranties. If there was a warranty, it would have been listed on the receipt. There isn't. I tried to help this guy out and don't appreciate what he's doing. I don't know if he is properly maintaining the equipment or what has gone on with the equipment over the last 6 months. But regardless, none of the equipment is under any warranty and the equipment was sold 6 months ago.Customer response

Did you not see these attachments and explanation in our response yesterday? Do you need more than this? February 13, 2024 Reg: Response to BBB To Whom It May Concern: The ***** Mini Vin# ***************** was not sold as is. That would have been listed on the Receipt/Bill of Sale.(see attached) This is in no way a warranty issue. We are not looking for warranty work. This Machine’s hour meter was tampered with at the dealership. This is a Federal offense. Attached again is the Electronic test from Caterpillar that found that the hours on the machine are invalid by over 1100 hours. The machine shows hours of 1394 but the electronic test has double those hours. The lifetime Hours from the Electronic test shows 2572. We have only used this machine for 326 hours since our purchase in July. We also maintain our Equipment daily and have receipts to prove that. This has nothing to do with the issue in our Complaint. We are kindly again asking for our money back from the machine or for Mr. Carney to Pay for the repairs. FYI - We also have submitted an online complaint with the FBI in NY. First of all, **** came to me last year in dire need of a used mini excavator and skid steer because his “burnt up in a fire due to lack of maintenance” that he admitted to, and his father confirmed when he was here. And being the person that I am I felt terrible. **** originally sent his father and employee down to inspect and put a deposit down on my personal excavator “which I purchased used as well”. When they were here they asked if I’d sell them my **** ***** too. Well, I wasn’t prepared for that but I was looking to upgrade both pieces of equipment so I agreed to sell both. So after we haggled back and forth about the price cause he didn’t want to give me what I needed out of them and keeped throwing it at me that it would be greatly appreciated if I would do him this huge favor and sell him both pieces cause he couldn’t work because he needed these two machines I finally gave in after I spent numerous hours talking to him “on the phone” and his father and employee in person because they exhausted me. Then on top of reducing my price $8500 dollars he asked for me to throw in the spare set of tracks for the skid steer that I had just paid $3000 dollars for but at this point I was done negotiating so I gave him those as well. Little did I know that after 6 months and over 500 hard worked and neglected hours **** would come back to me with an issue which doesn’t surprise me because the man doesn’t service any of his equipment and just works it to death which is the reason he came here to buy mine. I’m very disappointed that I thought I was doing a good deed for someone in need but it just goes to show that it doesn’t pay to be considerate.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. I found Carney Auto Sales on the ******** *********** selling this **** ********* for $59,000.00. He Buys and Sells equipment, this was not his personal excavator as he stated above. He also had 3 other **** excavators at his business exactly like this one. It is a total lie that we do not service our equipment and take care of them. We are in NH he does not know us. We have all the receipts to prove that we grease, do regular oil changes and steam clean machines etc. regularly. We did ask Mr Carney to come down on the price (which is normal practice), there was no so called haggling as he has suggested. We did not come there with the intention of buying a **** ****** however he did tell us he had one to sell if we were interested. He said it was out on a job and he could get it there for us. He was asking $74,000 and we paid $74,000.00 It was used and the tracks were completely wiped out on the machine. He told us he would throw in the used set of tracks he had. They were not worth $3000.00 ! I new set of tracks cost a little over $3,000.00 He offered them to us we did not haggle for them. We do not want this to continue to go back and forth like this. He says , she says.... As far as we are concerned none of these comments are necessary and he has not yet responded to the real issue. The issue that the hour meter was tampered or replaced! We were sold a piece of equipment that was not as new as was advertised. False Advertisement! We do not want this happening to anyone else. Regards, **** *********
