Kaitlyn (Katie) S******, the owner/sole proprieter of KMS Painting in Middleburgh, NY took a $2,250 ***** payment from me on February 11, 2022 as a deposit for painting our home in Cobleskill, NY. but never started the work. She provided written quotes for our paint job. She was very aggressive with requesting a deposit in order to secure a spot on her schedule for the spring of 2022 to be started "when the weather breaks" according to her February 21, 2022 text. Spring and Summer 2022 came and went with no sign of Ms. S****** to start our job. After another promised start date in September 2022 was ignored, a text from Ms. S****** on October 11, 2022 stated that she "didn't forget about you guys." Now approaching winter, we asked for an updated quote to reflect the exterior to be completed no later then May 2023, which she promised several times to send but did not deliver. In March 2023 we still hadn't received an updated quotation, or any sort of firm date. Having lost all confidence in Ms. S****** after more than a year's wait, with her routinely ignoring our messages, and with NO services provided, we requested our deposit be returned via *****. She stated on March 29, 2023 that she could not make a refund via *****, and that she could only send us a certified check because "I need a receipt on my end." I told her she'd have a receipt from *****. She insisted on a certified check, but would not tell us when she'd send it. She then stated on April 2, 2023 that she was "...super sick. If I'm not better tomm (sic) I'll have my mom do it." To date, no check received. She mostly now ignores our text messages and phone calls, but did text on April 21, 2023 that she was going to refund our money. Again, we are met with a lack of response and endless excuses - but no refund via any method...check or otherwise. We demand Ms. S****** immediately return our $2,250 deposit in full. I have documentation for all of the above. Thank you for your assistance.Business response

I signed a contract with KMS Painting in Middleburgh NY,, on March 15, 2022 to paint my entire house exterior. As of today, June 28, 2022 she has not painted my house as promised in emails and she has failed to refund my $4250 for a deposit on a job she never started. She repeatedly put other jobs ahead of me after telling me I would be first. I believe it was just a ploy to get my money I have screen shots of her emails promising the above and screen shots with dates of other houses painted. Now she is saying she will refund the money but nothing has happened.. . I paid her thru *****, and It only takes a minute to refund with *****.Customer response

In March and May of 2020 I paid a total of $3,250 which was half of the total to KMS Painting to do work on my house. I received lots of excuses as to why the work wasn’t getting done. In February 2021 this contractor cancelled the job and said they would give me my deposits back. I’ve received a few payments and as of this date, 9/13/21 I’m still owed $2,000. I’ve asked for this to be paid off several times. I have recently learned that this has happened to several people. I feel I’ve been more than patient and would like this balance to be paid in full. I have all texts proving everything I have just saidBusiness response

I am currently out of work from a major back surgery and I have been in contact with Mrs. ***** **** ******. I was making payments to her until I was hurt. Current balance is $2,000.00 and will be made as soon as I can which I have indicated to her and been in contact.Business response
