            Advertising Review

            BBB sent correspondence to Utica Hemp Co. on February 2, February 17, and February 24, 2022, requesting modification or removal of advertisements on their website, https://uticahempco.com/, and all social media sites for all health and wellness claims for CBD and Hemp products. 

            BBB's Code of Advertising #34 Claimed Results states,
            "Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data."

            The sale of Delta 8 products, Hemp cigarettes and pre-rolls, and marketing hemp flower as a smokeable product is illegal in New York state. The website and social media sites feature these products as well as medicinal and therapeutic claims.

            Medicinal and therapeutic claims for CBD products is illegal per Cannabis Control Board by Sections 13 and 91 of the Cannabis Law, Chapter II of Subtitle B of Title 9 of the Official Compilation of Codes, Rulesand Regulations of the State of New York  Part 114. The FDA has not approved a marketing application for cannabis products for the treatment of any disease or condition other than Epidiolex, Marinal, and Syndros whch are only available by prescription from a licensed healthcare provider.

            To date, the business has not responded to our request.
