    am filing a complaint against LCF Group due to their continued unauthorized withdrawal of funds from my business bank account, despite my business, ***********************, permanently closing as of February 1, 2025. Their actions have caused me financial harm, including over $900 in overdraft fees, and they are now threatening additional daily fees for failed withdrawal attempts on an account with no incoming ********** business had taken out a merchant cash advance with LCF Group. In early 2025, I received sudden notice that the building where my business operated had been sold to new owners, effectively terminating my lease. Upon learning this, I contacted LCF Group to inform them that my business would be permanently closing by February 1, 2025.LCF Group asked if I could immediately pay off the remaining balance in full. I informed them that I was unable to do so but was willing to set up a structured payment arrangement. They did not respond for several days, but continued withdrawing payments from my account.After struggling to get a response, I sent a letter revoking authorization for LCF Group to withdraw funds from my account. they informed me that they had placed a three-day hold while they determined their next steps. I contacted them again to ensure withdrawals would not resume, as my business was permanently closed and had no revenue. LCF Group then requested proof of closure, which I provided. *** continued withdrawing funds, overdrafting my account multiple times. When I followed up, they requested month-to-date bank statementswhich my bank does not provide just four days into the new month.Since they had previously accepted screenshots of my account balance, I provided screenshots clearly showing my account was overdrawn by $3,000 and had no incoming revenue. This time, they refused to accept the screenshots, insisting on a PDF statement, which I am unable to obtain.*** has continued attempting to withdraw funds

    I am filing a complaint against Last Chance Funding regarding unethical and misleading practices with my merchant cash advance account. On January 9, 2025, I was contacted and told that my payment for that day did not go through. When I asked why withdrawals were still being made from my account, I was informed I owed a final balance. I offered to pay off the remaining advance early and requested a total payoff amount. I was quoted $602.18 but was told the payment had to be made via wire transfer and could not be paid online. I was also told this amount did not include payments for January 8 and January 9. To ensure accuracy, I asked for confirmation of the exact payoff amount. The next day, another representative confirmed via email that the amount owed was $602.18 and provided wire instructions. I wired the full amount and sent proof of payment to Last Chance Funding. The following week, withdrawals from my account continued. I emailed the company for an explanation and requested acknowledgment of the wire transfer but received no response. On January 20, 2025, I was contacted by Last Chance Funding and told that my account was now in default and I owed $2,400 to settle it. When I inquired why the account was in default despite my full payoff, I was told there was no record of my payment, even though my bank confirmed the wire transfer was completed. I sent multiple emails and received no response. When I called, I was told my account was in default but no one could explain why. I was then pressured to borrow more money in exchange for the $2,400 settlement being forgiven. I was also warned that their records were accurate and that if I stopped payments, I would face legal action.

    I am writing to formally address an ongoing issue regarding LCF group incorrect reporting of my account status. It has come to my attention that the LCF Group is stating that I had a loan with their organization and that I am delinquent on said loan. I would like to clarify that I have never had any business dealings, nor entered into any loan agreement, with the LCF Group.Despite my repeated requests for verification of this loan, including requests for a letter confirming that no loan was ever issued to me, I continue to receive responses from their legal team directing me to a third party. The third party, however, has confirmed they have no control over what LCF Group states and cannot provide the documentation I am asking for. This response is completely unsatisfactory and leaves me in an impossible position, as I have no way of resolving this erroneous information.I must emphasize that their continued failure to provide clear documentation or acknowledgment that no loan exists in my name is in violation of consumer protection laws. I am requesting that LCF Group immediately provide me with a formal letter stating that I never took out a loan with your organization, and that I am not delinquent on any loan account with you.

    So I was paying then they took out a maintenance fee that I was not aware of so I stopped payment. Now they say I owe then over ***** when I already paid ***** and should have been paid off.

    Hello! I have had a loan with this business. We both agreed to $75 per week (I have been making my payment consistently for the past couple of weeks, screenshots attached)I wake up this morning to figure out they used my routing and accounting number (not sure how they got this information) and they took out $99. This is completely illegal. Again, as of today my payments are up to date so there is no reason to take anymore money out my account.I am requesting a refund immediately

Global Aerospace Technology is listed as a guarantor for her business. She claims in signing the security agreement, that they were authorized to sign on behalf of The Global Aerospace entity. If you feel that this was improper, we will require a police report to be filed and a copy provided to us. Upon receipt of the police report, we will remove the entity from the agreement and request the *** to be removed.     I've emailed, and they agree to a restructure on the loan amount and don't follow through. I don't want a lawsuit, I need help communicating with them. I just want to set up a new payment amount.

    And UCC lien was placed on my cash app account that was created by my former employer. I have attempted to verify that this account does not belong to my employer, and it in fact belongs to me, an individual. I contacted LCF and spoke with the collections manager, ******, who is very rude and condescending. I was asking questions in order to gain clarity, and she was very short, as if she didnt want to be bothered. There was no empathy whatsoever. I didnt sign the paperwork nor did I receive any money from this company. I again explained the situation that my former employer created the account, and that she has no association with the account. After expressing my displeasure with ******* tone, she ended the call. Im currently seeking the assistance of an attorney If I am unable to resolve this issue.

    The lcf group has called multiple times, to I guess tell me I don't qualify for a small business loan ... just to tell me they need me to have three months of banking ... I am recognized and certified as a LLC and as a business holding federal ein ... US title 15 subsection 1521 and section 636(i) and 636(j) ---The assistance programs authorized by sections 636(i) and 636(j) of this title are to be utilized to assist in the establishment, preservation, and strengthening of small business concerns and improve the managerial skills employed in such enterprises, with special attention to small business concerns (1) located in urban or rural areas with high proportions of unemployed or low-income individuals; or (2) owned by low-income individuals; and to mobilize for these objectives private as well as public managerial skills and resources. .. also violates 15 usc 1691 and 12 cfr ***************************************************************** income.Any adverse actions in a consumer credit transaction is illegal 12 USC 1431 Banks are required BY LAW to provide SMALL BUSINESS 50K-250K funding without showing documentation.All you basically need is an LLC & ???.

    Thank you for considering The LCF Group for your business funding needs. To clarify, The LCF Group does not provide credit, much less consumer credit.  The LCF Group purchases businesses future receivables.

    With that said, 15 USC 1691 (b) (3)specifically allows credit to be used to deny credit, to wit: 

    Activities not constituting discrimination
    It shall not constitute discrimination for purposes of this subchapter for a creditor
    (1)
    to make an inquiry of marital status if such inquiry is for the purpose of ascertaining the creditors rights and remedies applicable to the particular extension of credit and not to discriminate in a determination of credit-worthiness;
    (2)
    to make an inquiry of the applicants age or of whether the applicants income derives from any public assistance program if such inquiry is for the purpose of determining the amount and probable continuance of income levels, credit history, or other pertinent element of credit-worthiness as provided in regulations of the Bureau;
    (3)
    to use any empirically derived credit system which considers age if such system is demonstrably and statistically sound in accordance with regulations of the Bureau, except that in the operation of such system the age of an elderly applicant may not be assigned a negative factor or value;
    (4)
    to make an inquiry or to consider the age of an elderly applicant when the age of such applicant is to be used by the creditor in the extension of credit in favor of such applicant;or
    (5)
    to make an inquiry under section 1691c2 of this title, in accordance with the requirements of that section.

    Contrary to your claim, 12 cfr 1002 (6) specifically allows credit history (among other things) to be considered in evaluation an application for a financial product.

    I was not notified an aggressive *** would be filed for a MCA loan 90 days. I asked to pay $500 fee to have this removed as required by LCF and the attorney refused unless I paid more than loan amount which is an abuse of power knowing this would prevent me from purchasing commercial property. I asked this be removed Apparently the *** filed for that loan is on all business assets and our attorney is saying that it can come ahead of our lien position on the FF&E. I owe 10k this is preventing my closing. I have never defaulted on loan payment.

    5. Obligor hereby authorizes LCF to file, without the signature of Obligor, one or more ****1 Financing
    and/or Continuation Statements, and amendments thereto, relating to the Collateral. Obligor irrevocably
    appoints LCF as its authorized representative (coupled with an interest), with full authority in the place
    and stead of Obligor and in its name or otherwise, from time to time, in LCFs discretion, to take any action or
    execute any instrument which LCF *** deem necessary and advisable to accomplish the purposes of this
    Agreement,including, without limitation:

    You requested that we subordinate our UCC for a real estate transaction. We offered to take a 2nd position which has a
    subordination fee of $500 that would allow you to move forward and purchase your real estate property.

    In addition, on page 27 of the contract, there is an Advance Repurchase Addendum which states your advance purchase price options and deadlines.
    We offered this as an option;however, we did not receive the repurchase amount within the 30-day calendar period. Therefore, it is your
    responsibility to pay the remainder of the total payback amount that is stated in your contract.

    We apologize for any issues or misunderstandings that *** have occurred and would like to work with you to a find a resolution. 
    Based on your current payment status and good standing, you are eligible for additional funding from The LCF Group, should you need

    Your attorney denied my request to subordinate the *** Lien which held up my closing for my commercial property.  I offered to pay the fee your attorney *********************** was disrespectful demeaning, and extremely offensive.  He kept saying what is in it for me? The loan will be paid in full 1-2-2024.  Why would I need to pay off when I had already paid back what I had borrowed. The settlement amount offer at a lower rate was not granted because your attorney knew I needed the *** lifted and leveraged my situation for gain.  I want LCF to refund $1000 of my loan processing fees for causing my closing delay and being an unethical company.  Otherwise I will seek my attorney to take further action.  I will also be filing a formal compkaint on *********************** with New York Bar Association.  His behavior and aggressive and unprofessional attorneys must be held accountable.

    I do not accept LCF response the attorney acted unprofessionally and was extorting additional funds due the immediate need I had.  You did not respond to the refund I am demanding and an apology for the unprofessional behavior.  Our bank president was also deemed the actions of LCF group as predatory and advised to escalate this matter further.
