8/22 signed contract with $21,905 deposit.9/22 decided on new cabinets instead of refacing. NYKB sent change order **** for electronic signatures (8/23 still out for signature with NYKB unsigned). Despite not signing **, NYKB sent invoice for $18,995. Paid because work contracted to start 10/22.NYKB never furnished NOTICE OF CANCELLATION form required by The Rules of the City of New York (Rules) with contract or **.11/22 Building engineer replied to NYKBs application with 40 specific items to address. 4/23 NYKB resubmitted appl. and did not address any item.NYKB designer took us on 2 or 3 shopping trips, and using preferred vendor program, I ordered kitchen materials.2/23 paid NYKB $2,369.79 for materials and delivery. 5/23 cancelled contract and told NYKB to deliver; NYKB refused unless I paid more.2/23 asked for updated project plan. NYKB owner called about cancelling bathroom work and upset my wife and she gave me the phone. Owner said he didnt want to collect the 25% cancellation penalty. Three days later, NYKB emailed new payment plan and credit memo with bathroom cancelled and 25% penalty that owner said he didnt want.NYKB strongly resisted getting Poggenpohl cabinets. After ** was paid, NYKB said they only install Ultracraft or Bauformat cabinets. Met NYKB designer at Bauformat showroom to see the quality, and the first cabinet was broken. Ordered Poggenpohl and tried to get NYKB to work with them. Instead, NYKB asked me things they should have asked ********** directly, which ********** wanted NYKB to do.5/23 NYKB sent email showing no understanding of things I had been asking, things they had told me, or even what the project involved.NYKBs failures to responded to the building engineer, to work with ********** and to understand the project, what I had asked and what they had said, were too much. On 5/8/23 I cancelled the contract and requested the refund required by the Rules and kitchen materials delivery.Business response

Please find attached the original contract signed on 08/26/2022.
- See page 5 of the payment schedule which shows clearly what the deposit was made for. The interior design service, space planning and expediting is work that was done with the client by NYKB.
- See page 7 where it clearly states all deposits are not nonrefundable. See bottom initial of the client.
- See page ******************************************************** 3 business days following the contract signature. See bottom signature of the client and the owner.
Please find attached the Change Order signed on 09/19/2022.

- See page 7 where it states the client can cancel the contract in 3 business days following the contract signature. See bottom signature of the client and the owner.
We even gave a courtesy and followed with the clients request to cancel the bathroom part of the project and did not charge any penalty for the cancellation. As stated on page 7 of the original contract.

In regards to the purchased Materials we can deliver them after they pay the sales tax for the materials at any time.

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:The company does not dispute any facts in my complaint, refuses to refund any money, and attempts to justify keeping money that they did not earn. See the attached file for more detail.
