We bought three tickets city bus tour Hop-On Hop-Off. We did the reservations on December 20. for a tour on January 11-2023. We decided to cancel on December 25, but the agency refuses to refund the money. $147.00. Please help!Initial Complaint

On July 7, 2022 I was approached by a street sales man from the business Grayline City Sightseeing New York. He approached me and told me that if I was wanting to take a Ferry to see ********************* that he had tickets available @1pm @ pier 16. I purchased the tickets and went to pier 16. Upon arrival to the ticket booth I was told that all ferry tickets were sold out. I told her that the salesman told me this was good for 1pm. She informed me they have constant issues with these street salesmen selling tickets that are already booked. There were 5 other people in line with the same issue. I ran back to where this salesperson was 20 min. later and informed him I was unable to use the tickets and wanted my money back. He promised my refund and took my Credit card and gave me my receipt with the voided transaction and credit of $123.00 to my card. I never received my money back. I called, and was directed to email Grayline Sightseeing after no help. I recieved an email from Grayline Sightseeing telling me, because it was a street sale, they do not have to refund me my money. I was sold unusable tickets, and then PROMISED a refund. I was also printed a credited receipt.- I want my promised refund back as this was a scam/hussle by these street salesmen!Business response

Back on November 8th I researched tours for *************. I came across the websit* ******************************* I made a purchase for one of my families to include a 2 attractions flex pass and also a 3 attraction flexpass. The list of attractions included on this flexpass was a *****************/***** Island tour. This was a tour that my families expressed the most interest in. On Nov. 11 when I went on the website to purchase additional tickets, I decided to call ahead to get clarifications on their bus tour. During my conversations with the representative, I was informed that *********************/***** Island tour was not included on the flex pass. I informed the representative that per their website, that was included on the pass. I also told them that I had screenshot to prove that this was the case. The representative then informed me that the website where I purchased the tickets was outdated. I asked if that was the case, why not shut it down because as it stands, the website is operational and still taking money. $173 was taken from my account so I asked for a refund so that I could find the tickets I needed. I was told that I had to have insurance to get the refund, which I did not have. I told them, considering that they falsely advertised their packages, that I was due a refund. I continued to call for days after the incident to inquire about my refund and I was just given the run around. I arrived in *** 2 weeks later and attempted to contact someone again in regards to my refund. I spoke with a gentleman that told me he processed a refund. If good faith that my refund was in fact process, I repurchased with another company out of my pocket. 1 week later, I called to follow up about my refund. I was told that they were still processing. Finally, Jan. 4, almost 2 mons later, I called again because the funds had not hit my account. They have gone back to saying they can't issue a refund without insurance. In July 2021, I purchased 3 x 3 Day Flex passes (at a cost of $89 each) to be used in ************* AFTER 1st Nov - as this was the date the service would restart according to The ******** Sightseeing Pass website (which has now been altered). According to their website :"With the **** Pass, you have 72 hour Uptown and Downtown Hop-on Hop-off bus tours as one of your attractions. The Brooklyn Hop-on Hop-off Tour is good for 24 hours and also counts as one of your attractions. The ******** at Night and Best of Manhattan Double ****** Tours are available for one time use and each counts as one of your attractions on your Pass." Upon our arrival in *** we discovered that the service had not been operational in 2 years! There was not a single "City Sightseeing" bus to be found anywhere, our vouchers were not accepted at any of the tourist attractions we had bought them for, the address they have listed at the ************** is false and their phones go unanswered (in spite of spending hours calling and being placed on hold) and no-one could help us. When I called them again today (after having returned home), I finally spoke to a woman who was insistent that they did in fact have buses running - which is entirely 100% untrue. In spite of their "Money Back Guarantee" on their website, I was told that they would not in fact refund without the purchase of Insurance! Legally, my claim is against THEM and insurance has no relevance as it was due to NO fault of my own that THEIR own service is not operational. It's a complete scam. We spent nearly $300 on these vouchers and got ZERO value out of it. I have since discovered from the reviews on their ******** page that there are hundreds of people who have fallen victim to this same scam and yet this company is still selling their fake services online to this day! Someone has gone as far as starting a ******** page where people can share their stories of this scam. (**************************************************Customer response
