      I am beyond frustrated. Dave the owner of Nitram took on our deck job from ****** back in November/December. In February Dave took it upon himself to come “remove” our old deck; at that time Dave told us he was removing the old deck so that as soon as April or better weather came he could put in our new deck. This is not at all the case. Here we are in July; Dave came and took the old deck down with no intentions to build the new one, dave left posts in the ground so he did not complete a full deck removal and from my knowledge you need to pull a permit to even remove a deck which in fact was not done. In April Dave told lowes that he could no long do the job because he was too booked. This is also not true, when I called the town of Tonawanda I was told Dave did not have the right requirements to be pulling a permit in this town. Dave also had come to my house to do measurements in April and at that time he told me he had issues with the town guy and could not tell lowes this. This has left us with no deck for the last 5 months and I am beyond annoyed and aggravated with this whole situation. Dave proceeded to tell me that he finished his obligation with this project and ****** was aware. When I talked to the district manager at ****** she says otherwise that he did not fulfill his obligation because when he took the job he took the whole job not just removal and that they wouldn’t just have someone remove a deck without installing a new deck. Dave also left us a HUGE mess under the deck that my fiancé and I ended up having to clean because Dave never came back. I am tired of Dave’s lies and excuses, he is tells lie after lie to different people. Moral of the story he didn’t have the right requirements and he had caused some issue that the town inspector doesn’t like him and now we are left with the waiting game of no deck.

      Customer ***** is to direct all concerns to ****** **** *********** corporate office. Nitram enterprises is contracted by ****** to perform work for their customers. Nitram Construction was asked to assist in the deck project for the customer who filed the complaint. We were contracted to remove the old deck and install the new one until they put another contractor in place to handle their deck program. The customer was asked if they were good with the demo of old deck in order to speed up the installation process in the spring and they agreed. Nitram would not have done so if they did not have permission from homeowner and a separate P.O. from ****** corporate office. Nitram was released of installation of deck and acquiring of permit. The new contractor was hired and was being put in place after the tear out was performed. Nitram stopped the install and the pulling of the deck permit so the transfer to the other contractor could be done. This was not Nitram cConstructions place to communicate this to the homeowner, it was the salesman and corporate offices place. Nitram Construction stopped any and all work or obligation to said project at that point. The homeowner had several different avenues of communication with the salesman, store manager, district manager and to corporate support. Nitram Construction was no longer a contact point and the homeowner was looking for resolution and only turned their attention on the only contact that was responding throughout the entire process. Nitram Construction is not responsible for the install of the customer's deck and their attention should be directed to the ****** personnel responsible for the project and the new contractor installing the deck.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  Nirtram owner needs to own up to his obligation he had that he defaulted on due to his inability to finish the deck install. Dave was sneaky with offering to take down the deck he did in fact convince me that this would make the process smoother but really Dave just wanted a quick payment while he started up his company. Dave’s company was to do the full deck install but because Nitram was not able to pull a permit that’s why the deck installation could not be complete. Dave then tried to have a friend of his get subcontracted with lowes so then his buddy could pull the permit and he could still do the work because his friend could pull the permit. Yet here we still are dealing with the fact Dave decided to accept a job he could not complete. The excuses and him trying to make himself look good by throwing lowes under the bus is getting old and ridiculous. I have several communications that prove Dave’s excuses and lies are just that. Hopefully lowes can find someone soon due to Dave’s inability to finish the job. I have two young children and two dogs, it was important for us to get the deck in and quickly and Dave knew this; if Dave had any common sense he would have left our old deck for us that was still usable while we sit here and wait for our new deck to be built. This has been an absolute nightmare.   Regards, ***** *******

      Customer's opinion is there's to have at this point. The customer is contracted with ****** **** *********** and not NItram Construction. Although there is dialog with homeowner the end result is the contractor is not obligated to continue a response and ****** is the company that should be addressing these issues, not the subcontractor. We at Nitram Construction would like to apoligize for any mislead communication, while trying to help in this situation and ask the homeowner to direct their concerns to the company they contracted with, which is not at anytime Nitram Construction. Any and all here say should be kept to private conversations at this point as well. We ask that you read your contract and direct your concerns to the company you paid to perform said project. We apologize again for your inconvenience and ask that you contact ****** **** *********** for your resolution.
