      This contractor accepted a $130,000 down payment for a home renovation. After 58 days since demo, 50 of which he was not seen on the jobsite, his contract was terminated.When outstanding funds were requested, he would neither disclose amount of expenditures nor return any money. Since hiring a consultant, we confirmed that $30,000 -$35,000 was maximum out-of-pocket expenditure at the time of dismissal. With damages north of $30,000 for faulty work started, yet not completed per code or plans, plus interest and penalties, ER Construction currently owes me over $200,000.       In response to your inquiry about a complaint received by your office.

      Homeowner contracted ERC to demolish a house to the foundation and build a new one at site. Even before signing the contract he was asking ERC to start the project. Homeowner entered into a written contract on 4/18/23. After signing contract he again pushed to start even though he didnt yet make the agreed deposit. He eventually paid approximately 70% of the agreed deposit and ERC decided to start. Project began and homeowner eventually paid balance of deposit 4 weeks later. 

      Work performed to contract met all Brookhaven town codes and passed inspections. Next phase of construction required a progress payment. Homeowner tried to change the terms of payment which was not agreeable to ERC and would have put ERC into the red overall on the project. Homeowner is in breach of contract for failing to make progress payments as agreed, and payment for additional work performed outside the scope of the contract. Homeowner also filled their personal items in a construction container rented by ERC and rental company will not remove until items are removed. ERC continues to pay the monthly rental fee/agreement.

      Legal representation has been retained.
