      7/20/2022 signed contract, 8/1/2022:Paid $10,000 deposit to purchase Modular Home. The home was to be delivered and set in he Fall of 2022. Moore"s Home did not provide a complete set of plans to summit to the building deartment foe approval. Had to hire Foundation contracror to draw plans hand have them stamped by a NYS Engineer. Foundation was installed in November 2022, but I was informed by Steve B**** that they would not be able to deliver and set the house until the spring. At that time out site work needed 2 days to set the beam and install the sill plate. In the Spring we hired the site work construction company to have the site fully prepared for Moore's Home. After a number of excuses by Mr. B**** on what had to be done to access my site, including cutting down my neighbors trees, I had my contractor meet with Mr. B**** to see what needed to be done. 6/20/2023, Mr M**** called me that he met with my contractor the the House woule be delivered on 6/22/2023 and I had to pay him the balance due the next day before delivery. I let him know I needed to verify what work my contractor had to complete before delivery. Mr. B**** said I had to get back to him within 10 min. My contractor got back to me latter that evening and informed me that Mr. B**** was not going to fulfill the contract and was selling the home to someone else. I Called Mr. B**** and he confirmed what my contactor told me and refused to return my deposit.

      BBB spoke with the business owner and the following was relayed: Customer bought this home over a year ago.  It was the display model.  So I had to take it down, wrap it up and get it ready to ship, which I did.  I would never have done any of that if I did not intend on following through, OK.  It was supposed to be in OCT but because of covid things were a little behind on both ends.  Then he called me the week of Thanksgiving and told me the concrete was in.  Well, by then we had to wait until after winter.  The steel beam on his property is still NOT installed ok.  That needs to be installed before we can do anything.  He tells me he is doing things himself.  The beam, to this day, is not in.  The home that he bought is the biggest module home that there is.  It needs special permits and escorts and all that to be transported.  He lives on a private road.  There is no way that I can get the home delivered up that road.  He wants me to try and deliver it so that when it doesn't make it up the road because the trees are too narrow then it is my fault.  I'm not falling for that.  I told him, he needs to clear the trees in order for me to deliver.  I've been waiting for him to do this for over a year.  I've been in business for 46 years and have an impeccable record- no complaints ever.  I would never have taken this model home down, wrapped it up and gotten ready for delivery if I didn't plan on following through.  The problems are on his end.  He needs the beam installed- he's got everything else I understand septic and electric and all that ready to go- but he needs the beam installed and he needs to clear his private road so that I'm able to make the delivery in accordance with the laws and regulations.  He put down a 7% deposit, ok.  That's been used up on the disassembly and wrapping and permits and everything else already.  And I haven't even been charging him storage fees like I should be.  Thank you.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. The contract is clear, house to be delivered in the fall, Mr. B**** did not deliver. There was no delivery schedule timeline on the contract. Mr. B**** informed me in late Nov. that he would not be able to set the house until the Spring. Again no schedule from Mr. B****. Mr. B**** met with my contractor on 6/20/23 and only one small tree was marked for removal. My contractor made plans with Mr. B**** to have the crane set the beam the morning of delivery. Mr. B**** called me at 3 PM on 6/20/23 that he was delivering and setting the house on 6/22/23. I informed Mr. B**** that this was short notice and would not be able to get up to the site until Fri. 6/23/23 and had to verify with my contractor what had to be done. He also wanted the final payment on 6/21/23, before the day of delivery as stated in the contract. He told me I had 10 min. to talk to my contractor and get back to him.  My contractor got back to me at 7:30 PM and told me Mr. B**** had contacted him was not going to del. the home and was selling it to someone else. I confirmed this by calling Mr. B**** and I was told the same. If Mr. B**** could not get up the road he should have refunded my deposit in Aug. 2023. Regards, ****** ********

      The business relayed the following to BBB: I've attached numerous pictures.  One of the pictures shows that I applied for the transportation permit 2 days before the scheduled delivery.  I had every intention on following through.  He is the one who no longer wants the job.  He let the basement foundation sit all winter.  He gave me the runaround with the delivery right before it was supposed to happen.  I'm the one at a loss, I have this sitting here.  It is not sold to anyone else so I don't know where that comes from.  I'm stilled owed money.  I've attached everything for BBB.
