This transaction started on 10/15/21 with the original estimate. The price was $2780 for siding and trim on a detached garage at *** ******** ** ********* ** *****. First, the initial job was left incomplete with obvious trim/finishing pieces missing. After calling, they did come to finish that, but a week later a large piece is falling off, and the upper trim pieces are rippled, and installed crooked. When my son communicated this complaint to Jim, he blamed the wind. Furthermore, he flat out refused to come and fix the problem unless I paid additional money. Everything is documented below: pictures of the work, text of the refusal to repair, and copy of the contract which shows maximum wind loads.Business response

Response to Complaint #********: Result: $350 Service Call paid by Contractor. Repair completed (see enclosed photos). The Complaint has several fallacious points that need to be clarified. First, Complaint states: “First, The initial job was left in complete with obvious trim finishing pieces missing” . That is not true, there was three days in January (when this job was performed ) when the weather was below 32 degrees. We can’t install Siding with that temperature, the Siding will crack. She knew that. We told her and she agreed. The homeowner had not paid any money at that point and we were not paid till the job was finished. They inspected the job and there was no trim falling off the house at that time or we wouldn’t have been paid. Secondly, Complaint states: “After calling, they did come to finish that, but a week later a large piece is falling off and the upper trim pieces are rippled and installed crooked.” That is inconsistent with your sons text statement that the Trim fell off on Saturday April 30th, 20022 which is 4 months after the job was completed. So which one is it did it fall off a week after we did the job or did it just fall off with the recent storm we just had? If it’s what the complaintee says then it was hanging off the house for four months and they didn’t notice it? You may ask why is this important? it’s important because we had a extremely vicious wind storm at the exact time we had two other calls for siding repairs (see exhibit #1) and a tree fell onto my car causing $12,000 worth of damage (see exhibit #3, #5, and #6) at the same time the son wrote this nasty message: “Jim. These pictures are of my mothers garage. This work is absolutely unacceptable, and this needs to be addressed immediately. I must say with all the business we’ve done together, I am growing extremely disappointed with your quality of work”. This is the very contact which began this entire complaint. This message came in Saturday, April 30th at 6:05pm during my nieces birthday party. This is completely disrespectful to send this type of message on a Saturday night with absolutely no proof that it’s our workmanship and I provided numerous documentations of extreme weather conditions including $12k worth of damage to my car. I don’t put people to work on Saturday nights or weekends. I respect people’s personal lives and free time. It’s flat out rude. That could’ve waited till Monday especially when his mother said it happened five months ago. Furthermore, the very picture that was sent to me by the son shows a tree in direct contact with the soffit in the Trim area that came off (see exhibit #2). In the photo you see at least 25 branches within 1 foot of the facia board. Any type of wind is going to blow the tree(s) (which is in direct contact with the facia board) back and forth up against the Facia board and pull it off. His mistake was not even taking the time to remove the tree branch so it didn’t show it up against the Facia board in the photo. The antagonistic message left by the son is the wrong approach to get free storm repair damage done. He later goes on to say in his text message: “I didn’t know I had to be nice to the contractor”. Well when you’re asking for free storm repair work you should be nice. Although in this case not only do you not have to be nice but you can tell several misleading statements in order to get things done for free while everybody else pays for it. Thirdly, Complaint states: Copy of contract which shows maximum wind protection (sic Warranty)” - that warranty is for the siding. No siding blew off the house only trim that is in direct contract with tree branches. Fourthly, while we straightened the facia board out a little better they are missing gutters- gutters go on the facia board. They did not pay for gutters. That is a different crew you will have to hire. Aluminum is rigid and when you nail it it’s going to show some rippling it’s not made for 25 foot sections they need to install gutters over the facia board. Nailed aluminum just doesn’t fall off houses. It looked mangled as if something struck it or it was pulled off. It does not appear like it just fell off- look at the picture.
In summary, the sons approach (a 3rd party to the contract) was cruel, disrespectful, wrong and ill timed. The moms approach was littered with errors or misleading statements. We ask they go elsewhere for future work. This is not fair to the other customers that were nice and paid (like everybody else) to have there house fixed. This repair has been done see Exhibit #7 and #8. They need to trim back the trees or it’s going to happen again. Here is a lesson in Physics: When wind blows, it moves trees, when trees move and they are in contact with other objects they can dislocate those same objects loose as evident in the very photo provided by the son, the antagonist. I’m sad to say in this case “the system” did not work. We have one party with their reputation damaged and “out $350” (the cost of the repair) and we have another party that’s been unjustly enriched through insolence, deceit and misrepresentations. The one photo I sent previously is another customers house that was damaged the same week we'll call that exhibit 1. So these attachments are: Exhibit 2- (photo of trees not trimmed or kept away from the Garage and actually IN CONTACT with Trim work) Exhibit 3- My $12k+ car damage report form the same week, same storm), Exhibit 4- ******** News 70 MPH Winds. Now I will send the other photos in a separate email as my email capacity can only handle 4 attachments at once. Exhibit 5 and 6 is damage to Car. Exhibit 7 and 8 is finished Trim work after the storm and completed last week.
