    Pattern of Complaint:

On July 12, and July 26, 2022, BBB attempted to contact Apex Lift Equipment regarding a pattern of serious complaints. BBB received complaints alleging:

consumers paying for lifts and not receiving them. Initially they are met with excuses as to why the items has not been delivered, then they are unable to contact anyone when they request a refund. The complaints allege the business collected advance payments ranging from $29,500 to $64,900. The business failed to respond to the complaints through BBB’s complaint process.

BBB notified Apex Lift Equipment about the pattern of complaints and asked the business to voluntarily cooperate in eliminating the pattern by providing a written response outlining the specific steps it would implement in order to avoid similar complaints in the future. BBB also requested general information including the names & full contact information of the business’ principal officers and responsible management, affiliation with other businesses, the physical address of its principal office, copies of required competency licensing and a completed BBB Standard Business Questionnaire.

As of August 23, 2022, Apex Lift Equipment has not responded regarding the pattern of complaints or BBB's requests for information. BBB has concerns about Apex Lift Equipment’s business practices and urges consumers to use caution based on their complaint activity and lack of responsiveness.

In May 2022, We were in contact with Jim D***** VP Sales & Marketing in response to our recent search for a telehandler. He had just what we needed at a really good price and we agreed to purchase the lift. We cut two checks for $39,900 and sent them a photocopy of the checks with the agreement that we would give the driver the original check upon delivery. 1 week later (when the lift was scheduled to ship), they called and claimed that they found a leak as they were loading it to ship it. They said they would repair the leak and ship ASAP. Then it was delayed by parts not coming in (blamed COVID) and then we couldn't reach them for a while and ultimately they stopped communicating or answering the phone after offering to refund the money. So far no telehandler and no refund.

We were contacted by Jim D***** VP Sales & Marketing in response to our recent search for a 2015 ***** ***********. He had just what we needed at a really good price and lots of reasons why they were able to sell it to us at below market value. We took the bait and agreed to purchase the lift. We cut a check for $34,900 and sent them a photocopy of the check with the agreement that we would give the driver the original check upon delivery. 1 week later (when the lift was scheduled to ship), they called and claimed that they found a leak as they were loading it to ship it. They said they would repair the leak and ship ASAP. Then it was delayed by parts not coming in (blamed COVID) and then we couldn't reach them for a while (people out because of COVID) and ultimately they stopped answering the phone. My request for a refund is unanswered. In calling competing dealers in the area, we discovered that this business is not legitimate and that we have been scammed.

In March of 2022, we purchased a used lift in the amount of $52,500. (minor repair needed) In April of 2022, Apex was unable to do the minor repair to ship the equipment. Therefore they refunded $45,000 leaving a balance of $7,500. I have repeatedly tried to contact the company via email and phone to the salesman and office manager. No one answers the phone or the emails. Thankful for the partial refund but bad business to leave everyone hanging. Searcy Construction Services, Inc. ***** **** ###-###-####

I was contacted by APEX Equipment about a recent search for a 2017 ******* Gradle Machine. We spoke with the Vice President of sales Jim D****. We sent a photo copy of a check of $49,900 to secure the machine and agreed it was to be cashed in once we received the machine on our end but instead it was cashed in ahead of time. The machine was suppose to be shipped to us 3 Months Ago and throughout this process we haven't received any word from it but excuses about us getting the machine shipped to us. We contacted them numerous times and it seems as if our calls are being ignored. Invoice #**** for a 2017 ******* 10054 Serial Number #**************. Kyle A**** is the shipping manager, his email is ************************** & his phone number is ###-###-#### and their office phone number is ###-###-####. I highly believe this company is a SCAM and should be looked into, to prosecute those behind this well thought out SCAM

APEX lift equipment reached out to sell a forklift, after speaking with Jim, he sent pictures and specs via email and we decided to purchase the equipment. Everything was done digitally, he was communitive up until after the sale and has slowly stopped communicating. Bought a 2016 cat ******* from Apex lift and equipment. They told me it would be shipped the next week after they were done servicing it and had it inspected because it was a forklift type of machine it has to have inspection. I needed to pay for it before it would ship. Then they said a seal was out and couldn't get the part. Then part came in and said it was fixed . Said they were gonna expedite shipping! Nothing ever came and now no one will answer my email or phone calls.

The check has been cashed for more that 60 days now and now they are not responding to phone calls OR email and I do not have my equipment. I believe I have been scammed for $29,500. I am ready to pay whatever to catch these thieves.

We ordered a piece of equipment from this company (Paid for it). At first everything was good. Then we kept receiving excuses as to why they couldn't ship it. Now we aren't getting any response from them. After telling us that the machine would ship last Friday (07/15/2022)
