      I engaged the services of Cardwell Construction Co. last May 21, 2021 for a driveway rip-out and new asphalt, for a quoted price of $3300, after meeting with their sales rep, Mike V. The rip-out took place on 8/21/21. During the rip-out I was told by Rich (one of the principals of the company, I believe), that I would need more crushed stone than originally thought, for an additional charge of $300. I questioned this at first, but then agreed to the additional charge. Per the agreement, after the rip-out was done, I paid $1800 by check, half of the now, new total of $3600. Way after the established waiting period, due to rain and other customers ahead of me, I finally had the new asphalt poured on 11/3/21. On that day I went into my garage and noticed Cardwell's multi-thousand pound steam roller sitting on my $2000, epoxy garage floor! Dumbfounded at first, I asked the driver (Rich I believe), why he was parked there. He had not asked for permission to do so. If he had, I probably would have said , "No way," or questioned him extensively why he felt he had to park the machine in my garage!?! He kind of nonchalantly mumbled something like, "...that's how we do it." When the job was done, the garage floor was a mess, but like a good customer, I paid the balance due of $1800 by check, per the agreement. Afterward, with the warmer weather, I was able to thoroughly wash and dry the garage floor. I detected some damage that was not there before the steam roller incident; brought it to the attention of Mike V. and the company, and was told by Mike on 1/11/22, his company, "...was walking away from any damage claims;" this after he apologized profusely, and said it should never have happened! Please see the attached "Statement of Complaint Against Cardwell Construction Company," dated April 30, 2022, discussing this matter in greater detail.

      In response to Mr. ******* complaints Cardwell Construction repliesAfter multiple conversations discussing his concern, in regards to his new epoxy garage floor being damaged by a roller, with the office staff and the owner of the company we went out to review his concerns in person. At that time he was unable to show us any damage that was visible. Mr. ****** indicated that the lighting in the garage was not appropriate to view it so we agreed to return on another day and time. When we did, we still were unable to see any visible damage to his garage floor.  We are very sorry Mr. ****** does not feel his concerns were addressed, but without physical proof that damage was done to the garage floor we have no way of appropriately compensating him. We are sorry we could not come to a mutual resolution on this issue

      The contractor that did the original garage floor work is ******'s Contracting.  I spoke to ****** with reference to the "damage" to the garage floor.  He indicated he had met with ***** ******, upon *****'s request.  His diagnosis was that there was no structural or cosmetic damage and there was no need to reimburse ***** ******.  If, in fact, the diagnosis was any thing different than that I, the owner of Cardwell Construction Company, would have been happy to reimburse ***** ****** for damages done by my Company.

      Better Business Bureau:
      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Please be advised that as of this date I have not gotten a call back from Andrew, my garage floor contractor.  I have left numerous messages since my return from a Memorial Day vacation on 6/2/22.  Secondly, I spoke to Debbie at Cardwell Construction Company yesterday, 6/9/22.  She is holding fast to her discussion with Andrew. "... that there was no structural or cosmetic damage and there was no need to reimburse ***** *******"  I obviously disagree with that assessment.  The roughed-up, front edge of my garage floor is readily visible.  The picture I texted Andrew on/or about 11/11/21 showed some blemishes on the glossy finish in one area of the garage floor.  These are only viewable when the floor is clean and dry.  When Mike, from Cardwell, finally came out on 12/6/21, I made him aware of the situation.  I doubt if he could see the blemishes at this point because of winter's effects on the floor.  When Andrew finally came out on 2/2/22 he confirmed no structural damage and only slight cosmetic damage.  On the day of his visit the floor was damp, and it was hard to see the blemished areas, but he had seen them earlier in the photo I texted him on/or about 11/11/21.  In my view, since it's my floor, not Andrew's, it's my call whether I want to seek some kind of recompense for damages done to my property!  I clearly admit the damage is slight, but suitable recompense for me would have been a good-faith adjustment to the final bill acknowledging damage done in the course of providing a new driveway.  I never suggested a dollar amount.  I simply shared the estimate provided by Andrew at my request after he had an opportunity to see the texted picture.  There was never any kind of bill adjustment offer coming from Cardwell, until Debbie indicated her willingness to offer reimbursement had Andrew's diagnosis been anything different.

      Debbie At Business Relayed To BBB:

      Mr. ****** had his garage floor redone by another business.  He advised us that we had damaged his new garage floor.  We went out and inspected the garage floor.  We could not find any damages.  Mr. ****** said that the lighting was at the wrong angle.  The business owner that installed the floor went out to the the property to inspect the floor at Mr. ******'s request.  I spoke to the business owner and he said he couldn't see any damages.  We would be more than happy to address it if there was a problem we caused but we are not just going to give out $400.00 if no damages were done.

      Our driveway was paved by Cardwell construction on 10/28/20. We had been assured that there would be no seam as it is a wide driveway. I began emailing the company because communication by phone from the time of driveway tear out and paving was poor. I noticed the a drop in the blacktop because my ankle actually turned some. Also when shoveling the driveway, the shovel stops short when it hits this area. As per emails, I contacted Cardwell about this issue. The foreman came out and said it needed to be heated and rerolled . We requested an email stating this and requested again with no outcome. I sent several emails inquiring about the repair. The repair was never done and we had our driveway sealed as per her suggestion. I feel we should get a partial refund of the $5290 we paid in good faith of having a good job without a seam as we told.

      Cardwell Construction was unable to fulfill the customer's requests in the time frame the customer desired.  We were short on staff throughout the paving season, weather was not cooperating during the months of summer due to all the rain.  This made it difficult to catch up on all of our customers waiting for new driveways.  As a result, I called and spoke with Mr. ******** on Tuesday, November 16, 2021 to let him know we were able to attend to his complaint that afternoon.  At which point, Mr. ******** refused our services.

      The foreman who came out told us the repair would need to be done once the weather warmed up but before the driveway was sealed.  I informed Deborah C********* that the driveway would be sealed early September, as she had suggested the sealing being done around September.  As per Deborah C*********'s email of May 26,2021, she stated that her crew will start repairs mid June, waiting until that time because the ground is warm and they can be more accurate with the repairs.  I do not consider that the ground is still warm on November 16,2021. She called my husband after 12PM November 16, 2021 asking to come for the repair that afternnon, with no prior warning. As per email of July 20, 2021, she stated the office would call one week before scheduling, this did not happen. Neither my husband or I were home that afternnoon to move the cars in the driveway. We both wanted to be there when they came.  Our driveway was sealed as we had informed Ms. C*********.  The foreman had stated that they would heat the high areas on the driveway and then reroll, but we never received anything in writing despite 2 requests. Whatever was going to be done should have happened before we paid for the sealing. My husband was told that the width of the driveway didn't matter and there would be no seams. However we did not get the job that we were told or paid for.
