On 2/6/21 I signed a contract with Terry F from Terry's Asphalt & Paving for them to complete a tear-out driveway at my house. The quote for the job was $800 and he was paid in full on that day (verified on the contract and by my bank when he cashed the check). Per the contract the work was supposed to start in May 2021. May passed and I heard nothing from Mr. F  At the end of June I sent him a text letting him know we'd be out of town for a week, thinking it'd be a good time for them to complete the work. He responded with "Will see call you soon". I didn't hear anything after that. On 9/15/21 I sent a text to Mr. F inquiring about my driveway, because I knew it'd be Winter soon. He responded the same day with "Going to set you for next week". That didn't happen but he sent me a message on 10/4/21 stating "Going to set you up for Thursday". They came on 10/7/21 and tore up my driveway (not completely) and left it in pieces. They didn't clean it out. On 10/20/21 I sent a text asking if my driveway would be finished before it got cold, because there was no way I could use a snow blower on the driveway, or shovel it. He responded the same day with "next week". On 10/27/21 Mr. F sent a text asking if I still wanted them to add pitches around my house, which I feel was a ploy to try to get more money out of me. I responded that it'd depend on the cost, because my funds were low. He said okay, he'd see what they could do for me. On 11/5/21 he sent a text saying "I'd have a new driveway next week". On 11/12/21 I sent a text asking if they still were coming that day or the next and he said "Rain this morning. Plant closed. Saturday or Monday". They again didn't show up and I asked for a refund on 11/29/21. He said he'd return my money and do my driveway in the Spring. He sent a text on Easter 2022 saying he'd do my job soon, but hadn't shown up by June so my dad paid someone else to do the work. Told Mr. F and said I just need a refund. Got no response.

The Driveway was 800 SQ Feet We had to wait on the City Sidye walk people The was Putting in new sidewalk in that area.  so we waited the till they was done so we would wat have To cut the driveway. If we wait then the driveway would not have to be cut.  If you look at the other Driveways in the Area they are all have a patch on the back side of the driveway.  I did 7 driveways all of them do not have a patch. If look at her driveway it do not have a patch on the back side of the driveway. All the other driveway in the area have to look at that patch on there driveway for the next 10 or 15 years. Her driveway driveway don't have a patch because I waited, The driveway look great, and I don't think 800 square feet dugout for $800. dollars is too much.  I don't Think she understands the process, When you dig one out you must let the driveway set, the ground has to settle.  She said I had a ploy to get money out of her but I still wanted to add pitch around the To keep water away from the house.   It was I feet around the house & 50 feet around the total  get the grass out stone it and pave all around the house. She Admits on the letter that she wanted this. She ask me to do this. Was I suposed to do it for nothing. I gave her
a price of $800. To Be paid when we finished the driveway, that I don't think that was to much.  I don't think any of the prices way to much I think it was fair..  If I give the $800 Back that means I dugout the driveway 800 Square feet got it ready for another company so that means I did all the hard work, and got nothing for it. So BBB you let me know If that fair.
      Thank you

      Customer response

Hello... I do not accept this response/"explanation" from the business. First, the company took full payment for the job up-front.  A check was written and cashed within a wrek of them receiving it. Second,  the company came 6 months after a promised start date. Third, the company did NOT dig out the driveway completely. The other company had to complete the work, before they could proveed. Fourth, if the company claims they dug out the driveway, 2 months would have been plenty of time for the ground to settle. They came and detroyed my driveway at the beginning of October. The plants close mid-December. They had time to come and finish the job. But after me complaining that I was going to be suffering through the Winter, because my driveway in the state they left if, was unable to be snowblowed or easily shoveled, the owner (Terry Floyd) finally responded and said the plant was now closed (conveniently), and they would come in the Spring. He again did not show up in the Spring. One more thing to note is I believe the company's permit with the city is not valid (and wasn't then), and the company never called to have the gas lines or anything else marked before they started their work. They just started digging.  The issue here is not that the company did not give a good deal. The issue is the company took money to do a job they never finished.  They barely did anything, and left a mess that another company had to fix.

      Regards,
