      AUTO PURCHASE FROM Subaru East Hills of ****** ************************************************** ***** Date of purchase 4/26/23 4/28/23 of new 2023 subaru Forester wilderness with 50 miles on odometer when purchased VIN # ****************** Subaru salesperson did not provide Forester milage 50 miles, did not provide lemon law document, Salesperson did not review car mechanics, safety features, technology features and operation of car. **************** is 0. Salesperson ***************************** and manager are nasty rude dishonest. They knew that I had sold my car. did not have transportation and took advantage of the situation.Subaru salesperson and manager agreed, verified DD214 USARMY and deducted $500 military discount from bill of sale/ sales receipt one and sales receipt two.as written and signed by the salesperson and myself. However, the $500 was added onto the sales receipt/ third bill of sale. BAIT AND SWITCH ORIGINAL FIRST BILL OF SALE CASH PURCHASE AGREEMENT FOR 2023 SUBARU WILDERNESS FORESTER IS $35666.43 SIGNED BY MYSELF AND SALESPERSON OF SUBARU EAST HILLS OF ****** SECOND PURCHASE BILL OF SALE FOR 2023 SUBARU FORESTER IS FOR THE AMOUNT OF $38859.18 THIRD PURCHASE BILL OF SALE FOR SUBARU FORESTER IS FOR THE AMOUNT OF $39355.11 BAIT AND SWITCH MANAGER THREATENED ME AND FORCED ME INTO PAYING $39355.11 CASH and KNEW I SOLD MY CAR AND NO TRANSPORTATION.I am requesting $500 Military Discount PLUS DIFFERENCE OF ORIGINAL AMOUNT OF PURCHASE PRICE FROM THE ACTUAL CASH AMOUNT THAT I PAID FOR 2023 SUBARU FORESTER $39355..11-$35666.43=$3688.68.TOTAL $4188.68 Subaru **************** and Subaru East Hills of ****** ** dealership did not contact me regarding this complaint.       Dear Better Business Bureau,

      Thank you for giving us the opportunity to review and answer this complaint brought by ***********************

      This complaint occurred because we made an honest mistake, which we caught prior to ********************** taking delivery of his vehicle.  We honestly forgot to add sales tax on the original Buyers Order of his vehicle.  We discovered this error, and, prior to delivery, we prepared a new Buyers Order which included the sales tax.  At delivery, the customer stated we should give him a bigger discount since we made this mistake.

      The second complaint occurred because Subaru offers a Military discount for which ********************** is not qualified.  It is a discount for active military and reservists,and it is also for retirees from the military or reserve within 12 months of retirement.  The original Buyers Order contained the $500 discount and stated, subject to verification.  ********************** does not qualify.  We added this amount back to the transaction.

      There was no bait and switch.  We made an honest mistake with the sales tax which the customer is attempting to leverage. Secondly, we added the military discount to the transaction indicating the need to qualify the customer.  The customer was not eligible, and his price rose by $500.

      There was no overcharge for this automobile.  There was no bait and switch.  There will be no refund.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      The attached documents verify Subaru of East Hills  ****** ** testimony is incorrect.  Subaru corporate told ******************************* that he would receive the $500 military discount based on his service as a veteran and verification of ******  Subaru of East Hills of ****** ** managers and salesperson also told ******************************* that he would receive the $500 military discount plus $1000 discount if he purchases the Subaru car from East Hills of ******. ******************************* believed that he would receive $500 military discount and $1000 discount toward the purchase of the car, acted in good faith and gave East Hills Subaru of ****** ** a $500 deposit toward the purchase of the car. However, ******************************* did not receive $500 military discount and $1000 discount toward the purchase of the Subaru car. The salesperson and managers of East Hills Subaru of ****** ** are dishonest and only interested in selling cars with poor customer service.

      Dear Better Business Bureau,
      Thank you for letting us know there continues to be an unresolved complaint.  We have reviewed ************************** complaint and his documents. 

       

      I will first call to your attention, that ************************** first document with the title ************ states the Military Discount is SUBJECT TO VERIFICATION.  

       

      Attached are the Subaru Military Discount Program Highlights that outlines what the Military Discount program entails.

       

      Also attached are the Subaru Military Discount Eligibility Requirements.  These requirements state a retiree is eligible for this benefit if he/she is within 12 months of retirement/discharge.  ********************** was discharged in ****, as per his service form he included as one of his attached documents.

       

      Finally, I contacted Subaru Corporate and asked them to weigh in on ************************** eligibility.  I've attached a copy of their email communication to me.

       

      I'm sorry ********************** does not qualify for this incentive.

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because: 

       East Hills Subaru of ****** ** salesperson and managers confirmed that ******************************* in front of witness ***************************** that he would receive the military discount of $500 plus a $1000 discount toward the purchase of the 2023 Wilderness Forester car.  Upon this offer ******************************* proceeded to get a bank check for the amount of payment as specified in sales receipt #1 which was sent to BBB.  When ******************************* went to bring the bank check, the salesperson said they made an error in the purchase price of the car and now it was almost $3000 more on the second invoice from East Hills Subaru of ****** **.  ******************************* acted in good faith and went to the bank and got another bank check for more money to give East Hills Subaru, the difference of their so called mistake.  When ******************************* looked at the second receipt $500 military discount and $1000 was not deducted from the price of the car.  *********************************** deposit of $500 was deducted from the price. The third receipt from East Hills Subaru was now a different price for the purchase of the 2023 Subaru Forester Wilderness.  I gave the salesperson and managers my DD214 and license with military verification. Salesperson and managers knew that ******************************* had no transportation no car and took advantage of the situation.  DO NOT PURCHASE A CAR FROM EAST HILLS ****** **

      SALESPERSON AND MANAGERS ARE VERY DECEITFUL DO NOT TRUST EAST HILLS SUBARU OF ****** **

      I WILL NOW PROCEED TO COMPLAIN TO THE FEDERAL TRADE COMMISSION AND MOTOR VEHICLE AUTO COMPLAINT
