      this company is calling me and hanging up on a regular basis. *** tried to explain that this debt they are calling me about from 2019, **************************, is out of statute and they continue to call and send letters.i dont want any further contact from them

      Upon receipt of your Complaint notice #********, we placed collections on Hold, updated the Complainants records and opened an investigation.
      Complainant alleges POM Recoveries, **** (POM) calls her and is hanging up on her on a regular basis. Our records reflect POM received the Complainants debt on 4/5/22 for collection of an unpaid account balance incurred by Complainant at her Provider on 11/17/19.  We reviewed our telephone records and confirmed we spoke to Complainant three (3) times since 4/5/22 and sent her three (3) letters.  One letter was sent to Complainant for Debt Validation because it is required by the Fair Debt Collection Practices Act (FDCPA).  A second letter was sent to Complainant on 2/7/24 after speaking to Complainant and obtaining her consent so Complainant would have her current account information.  In addition, a further review of our telephone records reflect POMs calls to Complainant were hung up on since 4/5/22 after the call was connected.  Lastly, we reviewed the call recording from our 2/7/24 contact with Complainant and there were no issues identified during the call with our Representative.

      Please let us know when we may remove the collections Hold we placed on Complainants account at your earliest convenience.

      I had weight loss surgery in 2021 thats was fully covered by the insurance like I was Told.I had Complications that landed me in the hospital due to the surgery. As my insurance(emblem) told me at the time . Those hospitals stays were covered because it was due to surgery. I was ** post op. This company is a debt collector trying to collect my hospital bills , that I was Told was covered. I acknowledged the initial letter requesting more info on why ? This being sent to me and to stop calling. Ive done this a few times. This time they called my grandmothers number asking for me. Someone named Radica. I know Once you acknowledge the debt , phone calls are suppose to stop.

      We received Complaint #******** via U.S. Mail on 10/21/22 and subsequently requested and received an electronic copy from *********************************** on 10/24/22.  The Complaint (U.S.Mail copy) did not include any attachments and the electronic (email) Complaint copy included 2 attachments.


      One of the two attachments to the electronic Complaint copy contained a handwritten note (attached) of what appear to be a telephone number ************ and a 3 digit number (extension) *** and the word Radhica.  We acknowledge the telephone number is assigned to POM Recoveries, **** and extension *** is assigned to our employee Radhica.  

      The second attachment is a document entitled Authorization to Release Health Info (attached) and it states in the first paragraph, Accordingly,to assist you with resolving the complaint you filed with the Better Business Bureau (BBB), we need your written authorization and signature below.  Without your authorization, BBB might not be able to provide assistance."  Complainant did not sign the Authorization to Release Health Info document and as such, we notified *********************************** from the BBB on 10/24/22 via email that our response to Complaint #******** contains health records.  ******************** confirmed via email 10/24/22 (attached) we are authorized to withhold our final response to this Complaint as a result of the unsigned Authorization to Release Health Info and we may respond as such via the BBB portal. 

      We respectfully await a response from the BBB requesting POM Recoveries, **** (POM) to either retain Complainants account on a Hold collections status or written confirmation POM may resume collection action(s).

      We received a signed Authorization to Release Health Info on 10/28/22 from the Better Business Bureau (BBB) for Complaint ID #******** (see attached) allowing us to proceed and bring closure to this matter.


      POM Recoveries, **** (POM) received an email from Complainant on 5/9/22 regarding his account from ************************ for his 10/18/21 Date of Service.  Complainant alleged in his email he was admitted to MOUNT SINAI SOUT ****** due to a complication to the surgery referred by my Surgeon.  I was in the post-operative period.  It should have been covered.  Also I was never notified of this before collections."


      Upon receipt of Complainants email dated 5/9/22, POM placed collections on Hold, updated Complainants records and opened an investigation.  We contacted ********************** carrier, EmblemHealth, and they responded with a letter stating that Complainants benefit summary has a $750.00 Co-Payment and is Complainants responsibility to pay.  We also obtained an Explanation of Benefit (EOB) statement from EmblemHealth confirming they paid your insurance Claim and ****************Payment responsibility is $750.00 for his 10/18/21 Date of Service.   Both documents are attached to our 6/22/22 reply we emailed to Complainant.

      Our email response we sent to Complainant on 6/22/22 is attached with ********************** Claim documentation and our email clearly requests Complainant contact EmblemHealth to answer any questions he has as to how they dispositioned and paid his insurance Claim.  EmblemHealth confirmed to us ****************Payment is correct and must be paid by Complainant in accordance to the terms of his medical plan.  It is unclear from Complainants prior correspondence he sent to the BBB that he contacted EmblemHealth as we requested he do to resolve his dispute.


      Please confirm receipt of our response to this Complaint and let us know when POM can resume collections for this matter.
