Saratoga Construction built a modular house for us in which the pipes froze every winter since it was finished causing pipes to leak. We had major flooding this winter and had to have the heating system replaced because, according to the contractor, "Upon evaluating your heating system, we found no primary manifold on boiler to efficiently heat your living space. Under sized baseboard found in the garage with thermostat located too close to the boiler, making your thermostat have improper temperature readings. We found improper use of ***** bite type fittings that are not rated for heating systems. Being that your system is installed incorrectly and baseboard is undersized, these contributed to your house freezing up and creating the cracked pipes, that caused water damage throughout your home." Saratoga Construction has had complaints of this problem before and needs to make restitution. We want them to pay for the damage caused to our house by their shoddy workmanship and poor construction practices.Business response

Saratoga Construction LLC completed construction of this home on November 10, 2014, and we have not heard from this customer since January of 2018. This building is a garage with an apartment above, in a very rural area and over 1000 feet off the road. As of our last communication with the customer in 2018 it was left unoccupied in the winters with the heat turned down to 50 degrees. Because of this, and the frequent power outages in that area, we advised at that time that they should either have the property winterized each fall or a system installed to monitor interior temperature and notify someone if/when the heat or power went out. Apparently they didn't do either. I'm sorry to hear that their pipes froze this winter but this home was built to NYS code, passed all of the required municipal inspections, and the systems operated properly for several years. Our mechanical systems warranty expired in 2016, and in any case would not cover damage caused by lack of monitoring the property in winter conditions.
