      On Aug. ******* I consigned with Scott Daniels Auction to sell my coin collections. Scott sold these coins at auction on or about Oct. ******* for $6462. The agreement I entered into with Scott Daniels states in part,(Scott Daniels will mail payment to the consignor approximately 45 business days after the auction close, together with a full accounting thereof.) As of May ******* I have not received payment. I have spoken with Scott several time in an attempt to secure payment with no results.

      Scott Daniels was contracted by my mother (who has dementia) on 1/7/23 to provide auction services for my parent's estate. The contract states that we would be paid approx. 45 business days after auction close, with a full accounting thereof. The highest yielding auction was held 3/11/23 and we have not been paid a dime (~ $10,000). The auction consisted of my dad's vast ****************** collection.I've had multiple ************** over the past 8 months trying to resolve payment and return of unsold property, only to receive multiple excuses and extensive delays. Much was due to Scott's extremely disorganized accounting practices. I questioned him on the accounting of many items & the response was always that he would have to look into it. He strung me along for months.When he sent me the adjusted 3/11/23 End of Auction report, I signed it on 5/22/23 with corrections, & said I would pick up the check and remaining items on 5/27/23. That day, he made an excuse that he didn't have a check because he said he still had items being returned & *** non-deliverable issues. This was a breach of contract. On 6/2/23, I emailed a list of outstanding items for pick up or payment. On 6/8, I told him I did not want the list to hold up payment from the 3/11 auction. On 6/15, he emailed that he would send the final accounting, checks, and returned items within the next 2 weeks. This didn't happen.After MANY emails, I finally received a check for $11k on 11/30/23, post-dated for 12/26. On 12/26, I received a letter stating he put a Stop Payment on the check because he says I disputed the funds. I merely asked for the accounting of how he came up with the amount on the check.Throughout the entire course of business, there has been unorganized accounting of the items taken from my parent's house, there has been a multitude of promises made yet undelivered, and there has been very skeptical business practices, specifically not identifying items sold or in his possession until asked.

      We understand that discrepancies in account balances can be concerning and frustrating, and we appreciate patience as we work to resolve this matter.
      We would like to inform you that, in response, we are diligently reviewing our records to ascertain the accurate amount owed. We acknowledge there is a disagreement between the amount cited and our records.
      We have also been in contact with the District Attorney's office, as mentioned. We believe in transparency and accountability, and we are taking every step necessary to ensure that all actions we take are in compliance with the law.
      Our goal is to have a mutually agreeable final accounting determined shortly. We are prioritizing this matter and we hope to present you with our findings and a proposed resolution as soon as possible. We are committed to fairness in all our dealings and want to assure you that we are doing everything in our power to resolve this matter.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      *** ******** has repeatedly made promises about forthcoming payments on the March 11th, 2023 auction. Thus far, he hasn't send payment. The only hint of payment was when he mailed a check, post-dated one month, and then put a stop payment on it right before it was to be cashed.  

      *** ******** has stated that he would appreciate patience as he works to resolve our matter.  I have been nothing but patient for over 10 months now as I've waited for payment.  The auction was held a full year ago and I was to receive payment within 45 business days.  That did not happen.  I continue to see a pattern of the similar responses that he is working on it, but I never see any results.  He has admitted he owes me the money for the auction. There is no reason I should be waiting for him to resolve the accounting on the items that he didn't sell and didn't return. The auction has been signed off on, and withholding payment is a breach of contract.  

      An acceptable response from him would be to provide an immediate date on when he will put a certified check in the mail for the auction and deer statue amount ($9,836.05), which he admits he owes.  *** ******** can then follow up with a full catalog and resolution of the inventory that was not sold and not returned.  I have already provided a list to him of these items in question.   

      *** ******** repeated failure to provide any type of accounting, to provide any payment, and to simply buy time, feels like fraud.  He should not be a business that the BBB endorses in any way, and his ability to advertise as an A+ business is misleading to the consumer.

      I, ******** ** *****, am the consignor on Scott **********************' contract. A contract he does not follow. The items in the auctions belonged to my brother, ***** ** *****. The contract states, payment of any and all items sold via auction, will be paid to the consignor or "To be Determined," 45 business days after the auction. The payee is ***** ** *****. Scott ********************** is not a man of his word. He held 2 auctions for my brother, ***** ** *****, the first on 4/23/22, the second on 5/21/22. He made excuses and played games by withholding payment for the first auction for much more than 45 days. I believe the first payment was finally made by August 2022.He now owes my brother, ***** ** *****, for the second auction held on 5/21/22. ***** ** ***** has been going to Scott ********************** for payment for the last 3 weeks, and Mr. ********************** continues to make excuses. It is now 4 months since the second auction. He owes my brother, ***** ** *****, a total of $6,426.75. Please help my brother, ***** ** ***** receive payment. Thank you.
