I am writing to bring to your attention my concerns regarding the reporting of my personal information to credit reporting agencies in connection with an alleged debt. After careful review, I have reason to believe that your actions may be in violation of the Privacy Act of 1974, 5 USC 552a, and 15 U.S. Code § 1681b. The Privacy Act of 1974 safeguards the privacy of individuals by regulating the collection, maintenance, and dissemination of personal information by federal agencies. Similarly, 15 U.S. Code § 1681b outlines the conditions under which consumer reporting agencies can provide consumer reports. I believe that your handling of my personal information may not comply with the provisions of these laws. In light of this, I hereby request that Capital Collection Management cease reporting any information about me to credit reporting agencies immediately. I am asserting my rights under the aforementioned statutes, and I am opting out of any such reporting by your agency. I kindly request that you confirm in writing within 30 days from the receipt of this letter that you have ceased reporting my information to credit reporting agencies. Additionally, I expect confirmation that any negative entries related to this alleged debt will be removed from my credit report. Failure to comply with this request may result in legal action to enforce my rights under the Privacy Act of 1974 and 15 U.S. Code § 1681b. I trust that your agency will take the necessary steps to address this matter promptly and in accordance with the applicable laws. Thank you for your prompt attention to this matter. We received your dispute dated 2/13/24 in which it was indicated that you have reason to believe that by us reporting this account on the Credit Reports that it is violation of the Privacy Act of 1974. We are allowed to credit report your account to the Credit Bureaus this is not a violation of the Privacy Act. We are governed by the FDCPA in which we follow all of the laws set forth to us. We have requested that this particular account be removed from bureaus and will be sending you a letter to the address that you listed on the complaint letting you done this has been done.
