  Date of transaction: 9-2-2022 Job: Concrete Patio Paid upfront for material supplies. Check was made out for $1700 where purpose was written “Patio materials deposit.” We had a written contract for how much the project was in total and agreed verbally when Randy Peterson of ********* before and after landscaping would start my project. Randy promised the week of 9/12 to come out and start the project. He was a no show several times and I would text or call to follow up giving him several chances to to rectify the situation. He only came out and removed the pavers on one day and the next he did minor amount of digging and left my lawn a complete mess. First excuse, was his mother getting into an accident. I let it slide wanting to give him the benefit of the doubt. Second excuse was that him and his wife were at court for a traffic violation. At that point I had tried to request my money be refunded to me. He claims to have already bought the supplies and that he wouldn’t be able to start until the following week of 9-19-2022 because the trailer he uses is getting fixed up. He had begged for me to wait until Friday of 9-16-2022 to stop by in the afternoon to at least do some more digging. He once again failed to show up at all. I texted him to give me a refund to which he wouldn’t agree to since he had apparently paid for the material and performed some labor. I told him I was wiling to only compensate him $200 for the paver removal but want $1500 back. He still disagreed and claimed material as the primary reason. I had requested several times to see some receipts/in voices. He gave me nothing, not a shred of evidence. At this point he is refusing to even talk to me and after threatening to take him to small claims, he told me to go ahead. Which is what I am also going to be doing should he not return my money. I have all the evidence I need to win my case.

  Owner, Randy Peterson, was paid in full with a check cashed for a landscaping job. He was completing portions of the job as he was paid however, once paid in full he has not returned to finish the job. I have had dead plants sitting in my mulch for a few months. I contact him every week or so to ask when the job will be finished. IF he responds, it's always - I will be over next week to finish. That week comes and goes and the job has not been completed. I have $500 invested in plants and another approx $500 in other tasks unfinished. I text him one final message on 9/24 stating if the job was not completed including replacement plants by 10/1 I will pursue legal action. He stated the job would be completed by the end of the week and has not yet come to finish. I also have video footage of him removing a sheet of stainless steel from my property without authorization. This sheet of metal is worth approximately $300. 2 $500 payments of cash were made on top of the checks.
